52.212-1 Instructions to Offerors - Commercial Items Mar 2023
Period of Acceptance of Offers
(c) Prices must remain effective for 60 days after solicitation close.
Award on Initial Quotations The Government retains the right to award without discussions. Offerors shall assume the Government has no prior knowledge of their experience and will base its evaluation solely on the information presented in the offeror’s quotation. Therefore, offerors are encouraged to provide their best quotation with the materials requested for evaluation. However, in the event that discussions are considered necessary, the Government retains the right to limit the number of offerors included in the competitive range for purposes of efficiency.
Evaluation Criteria The evaluation of quotes and the determination as to the equality of the products shall be the responsibility of the Government and shall be based on information provided by the offeror. The Government is not responsible for locating or securing any information not provided in the quotation by the offeror. To ensure that sufficient information is available, the offeror must furnish, as part of the quote, all descriptive material necessary for the purchasing activity to determine whether the products meet the salient characteristics of the requirement. Vendors proposing to modify a product to make it conform to the requirements of this advertisement shall include a clear description of the proposed modification and clearly mark any descriptive material to show the proposed modification. Quotations that do not have descriptive material will not be considered for award.
Quotations offering “equal” products (including products of the brand name manufacturer other than the one (1) described by the brand name) will be considered if such product is clearly identified in the quotation and is determined by the USCG to meet the salient characteristics of the required items. If offering an equivalent product, the brand name of the equivalent product shall be clearly identified in the quotation. Unless visibly identified as an equivalent product, offered items shall be considered as the brand name unit.
Price The offeror shall provide pricing as requested in Attachment 2-Schedule. Any quantity discounts and discounts for prompt payment should be included in this section. The offeror’s quotation will be evaluated using one (1) or more techniques defined in FAR 13.106-3, in order to determine if it is fair and reasonable.
Completion of FAR Provisions and Clauses:
The offeror shall complete and provide with the quotation the provision at FAR 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Oct 2020).
Offerors shall check the applicable boxes in paragraph (d) (1), and (2) of the provision at FAR 52.204-24.
