Justification for Other Than Full and Open Competition
This is a Justification for Other Than Full and Open Competition (FAR 6.103-1) document for solicitation SPE7L126Q0786 issued by the Defense Logistics Agency (DLA) Weapons Support (Columbus).
The acquisition seeks to procure 1,701 battery storage units (NSN 6140-01-400-2901) on a firm-fixed-price basis with a 100% option for additional quantities. The items are spare parts for C-5 Galaxy aircraft weapons systems. The Government has determined that only ACME Aerospace, Inc. (CAGE Code 6HAR8) possesses the capability to furnish supplies that are form, fit, and functionally interchangeable with those currently used on the supported end item. The authority for this limited competition is 10 U.S.C. 3204(a)(1), implemented under FAR 6.103-1 as an AMC 3 acquisition (second or subsequent time directly from the manufacturer). The AMSC code D designation applies, indicating that competitive data is unavailable. The Government will conduct fair and reasonable pricing analysis through comparison of proposed prices to historical data and will request certified cost or pricing data as necessary.
The Government conducted extensive market research efforts to identify potential alternative sources, including a Sources Sought Notice posted on SAM.gov on 4/3/2026 (yielding no responses), a market survey on 2/18/2026 (with ACME as the only vendor contacted and no other responses received), procurement history review, and general internet search—all yielding no alternative manufacturing sources. The acquisition will be synopsized on SAM.gov and posted to the DLA Internet Bid Board System for a minimum of 10 days. Dealers of the approved source will be solicited. The solicitation includes a DLAD Procurement Note (L04) permitting submission of alternate offers and requesting technical evaluation for future procurements. The Government encourages interested vendors to contact the DLA Weapons Support Source Approval Monitor for information on becoming an approved source.
