About this file

This is a Justification and Approval (J&A) for Other Than Full and Open Competition document prepared by the Naval Medical Research Command (NMRC) in Silver Spring, MD for the repair and refurbishment of custom-built critical components for the Disorientation Research Device (DRD) at the Naval Medical Research Unit in Dayton.

The J&A justifies a sole-source award to Siemens Industry, Inc. to replace and refurbish a damaged motor module for the DRD, citing that Siemens is the only manufacturer of this one-of-a-kind device and the only corporation with the knowledge, expertise, and access to provide the components. Siemens owns the engineering IP and applicable patents for the custom-designed DRD components. The statutory authority cited is 10 U.S.C. 2304(c)(1) and FAR 6.302-1 for sole source acquisitions. No market research was conducted since Siemens is the only reasonable service supplier, and no other sources expressed interest in the acquisition. The contract will be posted to the government point of entry per FAR 5.202.
