About this file
This document is a Justification and Approval for Other Than Full and Open Competition for the repair of a Rotary Union, a custom-made component for a Disorientation Research Device used by the Navy.
The key details are:
- The Naval Medical Research Command (NMRC) requires the repair of a rotary union that is near the end of its useful life. This is a precise, custom-made part that can only be repaired by the original manufacturer, DSTI Inc., which has the technical drawings and is the sole source capable of the repair.
- The estimated cost for the repair is $6,114, to be funded with FY24 funds. The Contracting Officer will determine the price to be fair and reasonable through price analysis.
- No other potential sources were identified through market research. NMRC has no plans to compete this requirement in the future unless another source emerges.

JUSTIFICATION AND APPROVAL
OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity.
This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet Navy Expeditionary Medical Research requirements.
2. Nature and/or description of the action.
The DRD is a one-of-a-kind device constructed with custom parts. DSTI was used for the original fabrication of this part, and they made two of these parts for the original order. This is not produced by any other company and DSTI has the technical drawings for this part. No other company can repair this part without these technical drawings or access to the original part.
DSTI is the only company capable of providing this repair.
3. Description of Supplies or Services:
NAMRU Dayton requires a rotary union repair that is wearing out and near the end of its useful life. This is a precision custom part designed to be used in the Disorientation Research Device.
It is constructed of stainless steel, with a length of 190 mm, diameter of 341.3 mm, through bore size of 208 mm, and 2 passages sized 19.1 mm. It is capable of tolerating pressures of 0-199 PSI. It must be repaired without imperfections that cause excessive wear during operation.
NAMRU-Dayton will be using FY24 funds in the amount of $6,114.00 to receive this repair.
4. Identification of the statutory exceptions permitting other than full and open competition.
The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and FAR 6.302-1 sole source (including brand name) acquisitions or FAR 13.106-1(b)(1) soliciting from a single source.
Use one of the following:

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
This specific component was manufactured for the DRD thus there is not comparable replacement item. No other item like it appears when doing a part number cross check. The previous statement in number 2 above explicitly explains why there is no other replacement option available on the market.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Market research was performed, the results of which are in paragraph 8. This requirement will be posted to the government point of entry in accordance with FAR 5.202.
7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer shall determine the anticipated cost to the Government of the supplies/ services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the DSTI’s commercial price list and will be determined fair and reasonable.
8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.
Market research was conducted by technical experts in the July/August 2024 timeframe. This research consisted of reviews of previous procurements for these types of repairs. DSTI is the sole manufacturer and service provider. Consequently, the Government’s technical experts determined that DSTI Inc. is the only source that can meet the Government’s requirements.
The results of the market research are attached.
