About this file

This is a Sole Source Justification document for an urgent procurement of maintenance and winterization services for the Chief Naval Officer (CNO) Ceremonial Barge, to be awarded as a firm-fixed-price contract to Chris Washburns Boat Yard, Inc. (CWBY), a small business. The contract period of performance is December 13, 2024 through June 16, 2025, with funding from FY25 Operations & Maintenance, Navy (O&M,N) appropriations.

The justification explains that CWBY is the only contractor within 122NM radius capable of craning the CNO Barge Chesapeake out of water and performing the required 27 maintenance items within the urgent timeline. The barge cannot be transported outside Washington DC due to safety concerns and engine conditions. While Mid Atlantic Regional Maintenance Center (MARMC) was considered, they could only support 3 of 27 requirements and couldn't meet the December timeline. The work includes addressing INSURV safety discrepancies, engine overhaul, and modernizations. Due to urgency, the procurement was not publicized on FEDBIZOPS under FAR 5.202(a)(2) exemption, though the justification will be posted within 30 days of award.

SOLE SOURCE JUSTIFICATION

1. Identification of Agency and Contracting Activity.

Requiring Activity: Naval Support Activity Washington (NSAW) Port Operations, Craftmaster 1411 Parsons Avenue SE Ste 343

Washington Navy Yard, DC 20374

Contracting Activity: NAVSUP Fleet Logistics Center (FLC) Norfolk Contracting Dept., Fleet Directorate 1968 Gilbert Street, Suite 600 Norfolk, VA 23511-3392

2. Description of the Action Being Approved.

This is an urgent sole source action for the provision of maintenance and winterization of the Chief Naval Officer (CNO) Ceremonial Barge, required to be awarded prior to 12 December 2024 as a firm fixed-price contract to Chris Washburns Boat Yard, Inc. (CWBY), CAGE Code 9G5Z9, a small business. This is a new requirement.

3. Description of Supplies/Services.

The Contractor shall perform essential equipment winterization, repairs, and modernizations onboard the CNO Ceremonial Barge.

Period of performance for this requirement is 13 December 2024 through 16 June 2025.

The estimated total value of this action is

The resultant contract will be funded with FY25 Operations & Maintenance, Navy (O&M,N) appropriations. These funds are currently available.

4. Statutory Authority Permitting Sole Source.

The statutory authority permitting this sole source action is 41 U.S.C. 1901, Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a).

5. Rationale Justifying Use of Cited Statutory Authority.

The required timeline for maintenance, as directed by Naval Support Activity Washington (NSAW), Naval District Washington, and Commander Navy Installations Command, is from 13 December 2024 to 16 June 2025. This period is necessary to address The Board of Inspection and Survey (INSURV) safety discrepancies, overhaul engines for crew and guest safety, improve reliability and prolong CNO

. Additionally, this timeline ensures that half of the scheduled crew season can still be accomplished, minimizing the impact to Diplomatic Mission.

CWBY is the only vendor who is able to support this procurement without transporting CNO Barge Chesapeake to Hampton Roads. CNO Barge Chesapeake is currently located in Washington DC and is not capable of transporting outside of that area for maintenance due to safety concerns of the vessel, unknown condition of the engine, and its inability to maintain safe speeds without the engine overheating and potentially causing additional damage. If the CNO Barge Chesapeake cannot be serviced near its current location additional support to have a tug pull the barge or have it trailered for movement would be required, potentially adding an estimated to the overall cost. Additionally, other avenues of completion are unable to meet the urgent timeline for the start and completion of the required winterization, repairs, and modernization, while still allowing time for the crew to conduct sea trials verifying repairs.

CWBY is the only contractor within the area that has the capability to crane the CNO Barge Chesapeake out of the water and to complete the work within the urgent and compelling time frame required by mission needs. in the best interest of the Government to sole source award this urgent requirement to CWBY.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a Description of Market Research, if applicable, and a List of Interested Sources, if any.

A formal work package was submitted to Mid Atlantic Regional Maintenance Center (MARMC), however they can only support three of the 27 requirements to ensure the proper winterization, repair, and modernization of the CNO Barge Chesapeake. Additionally, MARMC cannot fulfill the urgent timeline and was only able to support a start date in February or March 2025.

NSAW conducted market research in the local area and found CWBY to be the only contractor in a 122NM radius with the ability to crane CNO Barge Chesapeake out of the water and perform all required winterization, repair, and modernization within the timeline required.

Due to unusual and compelling urgency, a synopsis of the proposed procurement was not published in FEDBIZOPS. FAR 5.202(a)(2) exemption applies. If this procurement complies with the time periods specified in 5.203, NSAW will not be able to fulfil its mission and the CNO Ceremonial Barge will incur further damages. This sole source justification will be posted within 30 days of award.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

There is no expectation that this requirement will be needed in the future, therefore this is a one-time buy.

9. Contracting Point of Contact. The point of contact at NAVSUP Fleet Logistics Center Norfolk Fleet Directorate is
