JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. ContractingActivity.

NA VSUP Fleet Logistics Center (FLC) Jacksonville Regional Contracting Department 110 Yorktown A venue Naval Air Station Jacksonville, FL 32212

2 Description of the Action Being Approved.

J&A No. 121-003

Award of a Firm Fixed Price contract where only one responsible source is available that will satisfy agency requirements for the USS Little Rock Starboard (STBD) Combining Gear from Original Equipment Manufacturer (OEM) RENK Systems Corporation, under other than full and open competition.

3. Description of Supplies/Services.

On 21 October 2020, the USS Little Rock had a complete failure of its Starboard (STBD) side Combining Gear. The Power Train Tech Warrant Holder (TWH) and the Southeast Regional Maintenance Center (SERMC) Chief Engineer have placed the STBD Combining Gear into a non mission status of Repair before Operating (RBO). The USS Little Rock is currently undergoing repairs to the STBD Combining Gear within its Emergent Continuance Maintenance Availability (ECMA V), in Mayport, FL. The need for these parts for the repair of the Combining Gear Assembly is also illustrated in Casualty Report (CASREP) 20076-22. To complete the repair on the USS Little Rock, replacement material can only be acquired through the OEM, RENK Systems Corporation.

During disassembly of the STBD Combining Gear, the OEM RENK Systems Corp. identified the output shaft and bearings Gl, G2, G3 were not required to be removed as part of the STBD Combining Gear disassemble. However, based on the damaged condition of the removed GT input shaft, Idler Gear, Low Speed and High Speed shafts and the associated 13 bearings, it is expected that the output shaft and bearings are damaged as well. OEM RENK Systems Corporation has recommended that the output shaft and bearings be replaced.

SERMC is in concurrence with this recommendation. The STBD Combining Gear is the main driving force for the ship's propulsion and without this emergent repair, the ship is inoperative. See attachment 1 for the requirements list of RENK Combining Gear Parts.

4. Statutory Authority Permitting Other Than Full and Open Competition.

41 U.S.C. 1901(e)(2), Special Rules for Commercial Items, as implemented by FAR 13.501 (a)

5. Rationale Justifying Use of Cited Statutory Authority.

RENK Systems Corporation, the OEM, is the only authorized manufacturer and retail source for all parts that will be installed into an existing gearbox. There are no authorized distributors or other known sources for the required parts.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market research was conducted in accordance with FAR Part 10. FLC Jacksonville posted a Sources Sought Notice (SSN) on beta.sam.gov on 08 January 2021 with a response date of 12 January 2021. There were no responses to the Sources Sought notice. RENK Systems Corporation was contacted via email and telecom to confirm that they are able to supply the items for this requirement. RENK Systems Corporation confirmed that they are the sole manufacturer and distributor of the RENK Systems Combining Gear and parts. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraphs 5 and 6 above, for any company other than RENK Systems Corporation to provide the required supplies.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSUP FLC Jacksonville has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NA VSUP FLC Jacksonville will assess whether competition for future requirements is feasible
