1.0 BACKGROUND:
NAVSUP FLCSI HQ has a requirement for the maintenance of various Mobile Conveyor and Roller Machines (Manufacturer Newland) in various locations listed below, for a base period from April 2025 to April 2026 plus 4 option years.

1.1 The Contractor will supply all necessary maintenance including but not limited to, labor, repair parts, good operating condition as determined by the original manufacturer’s specifications. The Contractor shall not be liable for repairs necessitated by abuse, misuse, unauthorized modifications, neglect, accidents, improper operation, or any external causes including, but not limited to, fire, water, and power failures. For the causes listed above, the Contractor shall submit in writing to the Government a description of work required to repair the system and request the consent of the Government to restore the equipment to the good operating condition for which payment will be made under a separate contract.
1.2 Contractor shall provide 1 Preventative Maintenance (QPM) visit per year per local site (Italy, Spain or Greece), up to a maximum of 3 days, which shall include but not be limited to the following which will be quoted in a separate CLIN along with the Emergency Visit) :
1. Inspection, adjustment and calibration of Conveyor/Roller for proper operation.
2. Installation, repair and/or replacement of parts as indicated by the contractor after inspection of equipment covered under this maintenance agreement.
3. Unlimited support in requisitioning proper parts for repair.
1.3 The Contractor shall provide up to 1 emergency visit per local site (Italy, Spain or Greece), and repair service during regular business hours to meet published performance specifications for service other than operator function, damage by third party, acts of nature, etc. as required upon equipment failure. The monitoring Government representative will provide the contractor a detailed description, via telephone, of problems encountered. The repair service will include labor, travel, living expense, and if applicable, minor parts coverage to be included in the above mentioned CLIN).
1.4 The Contractor shall provide 1 belt per mobile conveyor at the start of the contract which will be quoted in a separate CLIN per local site (Italy, Spain or Greece).
2.0 COMPETENCY OF CONTRACTOR PERSONNEL: All services performed under this contract shall be performed by competent personnel, fully trained to perform the required maintenance in accordance with the best commercial practices without unnecessary delays or interference with the government functions. The maintenance personnel shall have completed applicable maintenance training and experience.
3.0 SPARE PARTS INVENTORY, TOOLS, AND INSTRUMENTS: The Contractor shall maintain, within 2 weeks delivery time to the local site (Italy, Spain or Greece), to include part replacement of consumable and non consumable parts. Only new standard parts shall be used in performing repairs.
3.1 Parts Authorized for Requisition:

4.0 SINGLE POINT OF CONTACT: The Contractor shall identify a 24-hour/seven day a week single point of contact (service facility and corresponding telephone number) for Government personnel requesting services to be performed under this contract. If the point of contact is not within the local XXX calling area, the contractor shall provide a cell phone number for such service.
5.0 DAMAGED MATERIALS: The Contractor shall replace any Government-owned materials, which are damaged by malfunction of Contractor-maintained equipment, Contractor-provided equipment, or by Contractor fault, with material of equal or better quality.
6.0 PROOF OF RESOURCE: Upon request by the Government, the Contractor shall show evidence of proper level or resources to perform tasks under this contract, such as ownership or licensing of spare parts, diagnostic and repair tools, documentation and employment of personnel.
7.0 MAINTENANCE: The Contractor shall provide on-call, on-site maintenance service during the principal period of maintenance (PPM) from April 2025 to April 2026, to include an additional 4 option years for the maintenance and equipment covered by this contract. All maintenance will be done according to the Manufacturer specification and standards.
8.1 PRINCIPAL PERIOD OF MAINTENANCE (PPM): The PPM for the listed equipment shall be 0800-16:00 hours, Monday through Friday, excluding Local Country (Italy, Spain, Greece and Rota) and US Government holidays (New Years, Martin Luther King Day, President’s Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving, and Christmas).
8.2 ANNUAL PREVENTATIVE MAINTENANCE (APM): The 1 APM visit up to a maximum of three days, which will include but not be limited to the following:
1. Inspection, adjustment, and calibration of Mobile Conveyor, for proper operation.
2. Replacement of consumable/non consumable parts as indicated by the Contractor after inspection of the equipment covered under this maintenance agreement.
3. Unlimited technical telephone support.
8.3 EMERGENCY VISITS AND REPAIR SERVICE: The Contractor shall provide up to 1 emergency visit and repair service per year during regular business hours to meet published performance specifications for service other than operator function, damage by third party, acts of nature, etc, as required upon equipment failure. The monitoring Government representative will provide the contractor a detailed description, via telephone, of problems encountered. The repair service will include labor, travel, and minor parts coverage and consumable parts. Non consumable parts will be included in this contract.
8.4 MAINTENANCE AND REPAIR SERVICE RECORD: The contractor, is required to report all annual and emergency visits; report must indicate the time the service was requested as well as the time service was completed, and document all maintenance. The report shall also contain the type of service that was requested, with a brief description of the repair action.
9.0 RESPONSE/REPAIR TIME:
9.1 The Contractor shall provide a 24-hour/seven days a week telephone point of contact for receiving service calls.
Down time and response time clocks start when the Government makes contact at the single point of contact and will end when the equipment is returned in good operating condition.
9.2 Response time for emergency service for equipment covered under this contract shall be within 48 hours after notification that on-site repair is needed. Response time is defined as arrival on-site.
9.3 Repairs shall be completed within not more than 5 working days after notification. Repair time exceeding ten working days is subject to the “untimely repair” provision. If part is requisitioned from Manufacturer, repair must be completed within 5 working days from the arrival of requisitioned part.
9.4 All repair/response times exclude days that occur on Saturday, Sunday, (Supporting Country, Italy, Greece, or
Spain) Government Holidays and US Government holidays (See 9.1).
10.0 CONDITION OF EQUIPMENT PRIOR TO END OF CONTRACT: Prior to termination or expiration of this contract or removal of any equipment from this contract, the Contractor shall certify in writing that the equipment covered is eligible for maintenance by the Manufacturer. If any equipment is not eligible or is not in good mechanical, electrical, or operating condition, the Contractor agrees to return the equipment to a level suitable for Manufacturer maintenance, or reimburse the Navy any charges including, but not limited to travel, parts, labor required to place equipment in good mechanical, electrical, and operating condition as specified by the Manufacturer.
11.0 NEW, ADDITIONAL, OR DELETED EQUIPMENT:
11.1 The Government may modify the contract to include additional Government-owned equipment by providing a
30-day written notice to the Contractor. The Contractor must reject the addition of this equipment if they do not have appropriately qualified personnel.
11.2 The Government may modify the contract to delete Government-owned equipment by providing a 30-day written notice to the Contractor or a shorter notice when agreed to by the Contractor. The Government may extend or cancel the date of discontinuance by submitting a written notice to the Contractor 15 days prior to the stipulated discontinuance date.
11.3 Equipment additions that do not constitute a substantial increase in Preventative Maintenance effort required by the Contractor shall not result in adjusted contract price (i.e., addition of individual equipment items to expand systems capabilities). Substantial equipment additions will result in adjustment of the Preventative Maintenance line item price accordingly. The circumstances involved in each individual occurrence will be considered.
12.0 GOVERNMENT REGULATIONS: All contractor personnel performing work under this contract shall comply with all applicable Navy and local regulations. Of specific concern are regulations regarding security, wearing of badges, access lists, and safety.
13.0 SITE REQUIREMENTS: The Contractor shall maintain equipment site requirements (electrical, location) in accordance with Country and Local Base Requirements.
14.0 SECURITY REQUIREMENTS: Mobile Conveyor/Roller Systems is located in Fleet Mail Center and
Contractor is required to sign in and out of Postal Facility and must have an authorized escort at all times.
15.0 CONTRACTOR ACCESS: Subject to security regulations the Government shall permit the Contractor access to Base, so the Mobile Conveyor equipment can be properly maintained.
1. Sigonella – Refer to attached NASSIGINSTRUCTION 5530.3B, completion of package turned into POC of Sigonella at least 30 days ahead of time. Upon request, fillable forms can be provided.
2. Naples – Passport or ID upon arrival plus courtesy copy to POC 5 working days ahead of time.
3. Souda – Passport number provided to POC of Souda 5 working days ahead of time and same passport to present at time of arrival.
4. Rota – Completion of attached package ROTA PASS INSTRUCTIONS.and turned into POC of Rota at least 30 days ahead of time. Upon request, fillable forms can be provided.

52.204-20 Predecessor of Offeror (AUG 2020)
(a) Definitions. As used in this provision--
Commercial and Government Entity (CAGE) code means--
(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or
(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.
Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.
Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(a) Definitions. Inverted domestic corporation and subsidiary have the meaning given in the clause of this contract entitled Prohibition on Contracting with Inverted Domestic Corporations (52.209-10).
(b) Government agencies are not permitted to use appropriated (or otherwise made available) funds for contracts with either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation, unless the exception at 9.108-2(b) applies or the requirement is waived in accordance with the procedures at 9.108-4.
(c) Representation. The Offeror represents that--

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A
FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that--

ADDENDUM TO FAR 52.212-1
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

It is emphasized that this is solicitation is issued in accordance with the procedures of FAR Parts 13 and 13.106- 2(b)(3), which are intended to streamline source selection and be minimally burdensome for both the Navy and the quoters interested in competing for this requirement. The procedures of FAR Part 15.3 do not apply to this source selection. While not an all-inclusive list, some examples of FAR 15.3 requirements that do not apply are the late is late rule, competitive range determinations, the FAR Part 15.3 rules for discussions, formal evaluations plans, and formal evaluation documentation. Any references in the solicitation to offer/offeror shall be deemed to mean quotation/quoter.
The following clause is tailored in accordance with FAR Part 12.302(d) and replaces the foregoing clause, FAR 52.212-1, in its entirety:

Questions to this RFQ are due by 1300 local time (Catania, Italy time) on 07 April. 2025 and will be submitted electronically, in writing to julissa.a.ormenonarvaez.mil@us.navy.mil and all the emails specified above, with RFQ#: N6817125Q2010 in the subject line. Other methods of submitting questions are not authorized and will not be acknowledged or addressed. All items detailed below must be submitted for the quote to be considered complete.
The Government reserves the right to not evaluate incomplete quotes.
NOTE: Quote Delivery: Offerors are advised that delays can be experienced with the Government’s e-mail system.
Additionally, the e-mail system capacity for each e-mail is 10MB (better if smaller). E-mails greater than 10MB will not be delivered and will not be considered. Therefore, quotes exceeding the size limit must be sent via multiple e-mails. Zipped files are not accepted.
QUOTE INSTRUCTIONS & REQUIREMENTS:
1. A quote will be accepted in the English language only. Any quote received in other than the English language will be rejected.
2. All quotes shall be in Euro Currency (or US Dollars).
3. The Quoter agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of the Quote.
4. System for Award Management (SAM). The Contractor shall be registered in the SAM database prior to the award of this contract. Further information and guidance regarding SAM can be found at the SAM website:
www.sam.gov.
Quotes shall consist of the following:
1) TECHNICAL SPECIFICATION: Vendor shall submit technical specification sheet identifying the item quoted, including part number and manufacturer, as well identifying whether the item meets the minimum requirements and salient characteristics described in the SOW above.
2) PRICING INFORMATION:
STANDARD FORM (SF) 1449: The contractor shall submit a signed copy of the SF-1449 Solicitation/Contract/Order for Commercial Items, with blocks 17a, and 30a through 30c completed.
Contract Line Item Number (CLIN) Pricing, within the SF1449, MUST BE FILLED OUT.
All solicitation amendments must be acknowledged or signed and returned with the quote.
Note: Each quote should contain the contractor's best terms from a price and technical standpoint. It is the contractor’s responsibility to ensure that there are no discrepancies presented within the information contained in its quote. Potential quoters are hereby notified that in the event there are discrepancies within information in a quote will be rejected.
