PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT (PWS)

COMMANDER FLEET LOGISTICS CENTER PEARL HARBOR (FLCPH)

UNDERWATER HULL CLEANING, ANNUAL PREVENTATIVE MAINTENANCE, CALIBRATION,

CERTIFICATION AND ULTRASONIC THICKNESS (UT) READING OF YON 328

1.0 BACKGROUND

1.1 Fleet Logistics Center Pearl Harbor (FLCPH) is one of six regional supply centers providing integrated logistics support to the Navy in six major areas: Material Management, Terminal Services, Contracting, Fuels, Personal Property and Mail. FLCPH supports 30 home port vessels, 35 shore commands, other DOD activities and the largest employer on the island of Oahu-Pearl Harbor Naval Shipyard. The FLCPH Fuels Department mission is to store, manage and deliver fuels to support the needs of the Pacific Fleet. This includes operating and maintaining infrastructure to support its mission.

2.0 SCOPE/OBJECTIVE

2.1 FLCPH seeks a contractor to perform underwater hull cleaning, annual preventative maintenance, calibration, certification and Underwater Ultrasonic Thickness Gauging-Commercial (UWUTG-C) which provides instruction for measuring plate, sheet, and pipe in the thickness ranges of 0.125 to 10 inches:

• Fuel Barge YON 328

All work shall be done in accordance with the following Regulations and Standards:

(a) ASTM E797/E797M-10

(b) ASTM E1316-94B, Standard Terminology for Nondestructive Examination

TESTING Methods

3.0 PERFORMANCE REQUIREMENTS

The Contractor shall perform all necessary tasks described in this PWS. This includes:

3.1 Contractor will provide all personnel, equipment and material to perform underwater hull cleaning and UT Readings of YON-328.

3.2 It will be Contractor responsibility to provide:

• Diving services

• Hydraulics

• Generator

• Underwater Photographic services, still and video (as required)

3.3 Work Description: Contractor shall provide underwater hull cleaning inspection and non-destructive testing on YON-328 that is located at Pier H-1 Building at 1757 Neosho Ave, Joint Base Pearl Harbor-Hickam. The contractor shall provide all necessary personnel, diving tools, equipment, transportation and materials to complete all necessary services. Diving operations will normally be performed within ten (10) feet of the surface, but shall not exceed twenty (20) feet in depth. Diver shall have free access to the surface without obstruction with exception of small craft underwater hull when conducting inspection or hull cleaning. The contractor shall contact the Government TPOC immediately upon award. Once work begins the contractor shall have uninterrupted access to the hull until work is completed. It shall be noted that the hull will not be emptied.

3.4 Prior to cleaning, the contractor shall photo document the existing condition of each hull with a min of 25 pre-cleaning photographs. After cleaning, the contractor shall photo document each hull with a min of 25 post-cleaning photographs. Pre and post cleaning photographs must be taken from the same location on each hull. The contractor shall provide a photograph key showing the location of each pre and post photograph taken. These photographs shall be provided in hardcopy and electronic form.

3.5 Contractor must remove 100% of all soft and hard growth fouling on each hull. Care must be taken not to damage the anti-fouling paint. Contractor will identify the type and percentage of fouling on each hull, using NSTM Chapter 81, Waterborne Underwater Hull Cleaning of Navy Ships.

3.6 Contractor shall visually inspect the underwater hull for damage and corrosion. The contractor shall document and report the condition of zinc anodes, condition of anti-fouling paint, dents and or deflections in the shell plate, pitting, and bare metal. When reporting, rough dimensions and location on hull must be identified. For bare metal report rough dimension, the location on the hull and type of corrosion (i.e. rust, heavy rust, scale and base metal delamination) must be identified.

Cracks and or liner indications shall be reported immediately to the TPOC. Pitting depth shall be verified by using a pit Gauge or V-WAC gauge and all pitting where a 25% reduction in base metal thickness has occurred shall be reported to the TPOC. Conduct visual inspection of hull using COMUSFLTFORCOMINST 4790.3 Volume IV, Chapter 12, “Hull Inspection of Ships and Craft” and NAVSEA S9086-DA-STM-000-NSTM, Chapter 100, Hull Structures.

3.7 Conduct Ultrasonic Thicknesses Gauging (UTG) on each hull. Contractor shall take a min of 300

UTG readings on each hull. UTG readings shall be taken on an evenly spaced grid pattern along the flat bottom and both port and starboard sides above the turn of the flat bottom up to the waterline. UTG must be performed IAW COMUSFLTFORCOMINST 4790.3 Volume IV, Chapter 12, “Hull Inspection of Ships and Craft” and NAVSEA Tech Pub T9074-AS-GIB-010/271 Requirements for NONDESTRUCTIVE TESTING Methods. Contractor shall use an A-Scan type display (UTG machine) to verify digital thickness readings taken on rough, pitted or corroded surfaces. Suspect areas, as determined by visual inspection shall have several additional readings taken. Any area showing a reading less than the minimum allowable shall have additional readings taken in an expanding fashion to determine the actual extent of excessive deterioration. UTG report shall be provided in hardcopy and electronic form.

3.8 The Contractor is responsible for ensuring the areas in which work is being conducted is left in its original state. The contractor shall provide electronic and hard copies of cleaning and inspection reports, to include recommendations for future maintenance and repairs.

3.9 Additional Repair Work: Historical examples of additional repair work for this requirement include re-bolting loose zinc anode hold down bolts. For additional repair work necessary to complete the inspection that is outside of this example, the Contractor shall submit the request to the technical point of contact (TPOC) for review to determine if the additional repair is within scope of this PWS. The TPOC must then submit the request to the Contracting Officer who will make the final decision if the additional work is within scope of the PWS and contract. The request should include the details of the additional work and estimated cost for any additional parts, repairs, and travel (if necessary). No additional work can begin without the approval of the Contracting Officer and a bilateral completed and executed modification to the contract.

3.10 REPORTS: The contractor shall provide field report(s), no later than five (5) business days after performance, which shall describe the Services performed, and operational test results of equipment to ensure that equipment is performing within tolerances and specifications. This report may be combined with repair lists.

3.11 TRAVEL: No travel will be required for this contract

5.0 QUALITY ASSURANCE

5.1 The Contractor shall be responsible for implementing and maintaining a Quality Control Plan

(QCP) to ensure that the work performed meets or exceeds contract requirements and results in the correction of potential and actual problems. The QCP shall be implemented on the first day of contract performance and a copy of QCP shall be provided to the TPOC prior to contract performance.

a. The QCP shall outline the Contractor’s plan to ensure the quality of performance requirements as outlined in this PWS. The QCP shall address what will be reviewed and shall outline actions to be taken by the Contractor, should the review(s) identify areas requiring remedial action.

b. The Contractor shall keep records of any inspections and corrective actions taken, as outlined in the QCP and shall make such records available to the TPOC upon request.

c. Nondestructive Testing (NDT) Examiner certified diver / inspection personnel using this inspection procedure in accordance with Paragraph 2.0.

d. UTUTG-C Inspection personnel. Underwater UTUTG-C Inspection personnel are responsible for performing UTUTG-C per this instruction when directed by a repair procedure.

5.2 Periodic Progress Meetings: The TPOC and/or other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor’s performance. At these meetings, the TPOC will apprise the Contractor of how the government views the Contractor’s performance and the Contractor will apprise the government of Problems, if any, being experienced.

Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

5.3 GOVERNMENT FURNISHED PROPERTY AND SERVICES

The government will be responsible for providing:

• Pier access, staging area for Contractor’s vehicle and equipment

• Un-interrupted access to YON’s

• Fresh water access (garden hose connection compatible, but contractor shall provide their own hose)

The contractor is responsible for providing:

• Shore power. The contractor must provide its own power for any associated equipment to include towable dive system.

5.3.1 RECORDS, DOCUMENTS AND WORK PAPERS: The government will not provide technical information, technical reference manual and/or drawings of systems or equipment.

6.0 CONTRACTOR QUALIFICATIONS/REQUIREMENTS:

6.1 WORKMANSHIP/CERTIFICATION: The Contractor shall perform all work in a professional manner with skilled personnel that are trained and certified to work on the barges listed.

Personnel manipulating the probe while performing inspections to this procedure must hold a certification specific to underwater wet ultrasonic thickness gauging-commercial (limited certification is Acceptable) as specified in Paragraph 2.0.

Contractor’s UTG procedure must be approved by an ASNT level II NDT Inspector. Contractor shall provide a copy of their approved Ultrasonic Thickness Testing UTG procedure for review prior to use (the approved procedure and diving plan shall be submitted with the quote).

Personnel performing inspections to this procedure must hold Level II certification in UT for plate and sheet. The certified UT inspector interpreting the instrument can be the driver or a topside certified UT inspector who is in constant video and audio communication with diver.

6.2 In accordance with current Department of Defense and Homeland Security requirements, performance of all work under this contract is restricted to US Citizens and US Nationals only.

The Contractor shall provide proof of this requirement upon request of the TPOC.

6.3 Security Requirements: This contract does not require a security clearance level and clearance granted by the Defense Security Service (DSS). Should contractor personnel receive or suspect they have learned of classification information beyond their level of clearance, the Contractor shall identify and immediately report suspicions to the TPOC.

6.4 Confidentiality: This project, all materials provided to the Contractor by the Government, test results, conclusions, and recommendations obtained thereof from the Contractor shall be considered Government property. The information shall not be disclosed, copied, modified, used (except to fulfill contract requirements) or otherwise disseminated to any other person or entity at any time to include, but not limited to, inclusion in any database external to the Government without the Government’s express consent.

6.5 The Contractor shall furnish experienced personnel to perform all work specified within this PWS.

The Contractor is required to comply with Public Law 105-270, Section 5(2)(A). This law states that contractors will not perform inherently governmental functions. Section 5(2)(A) of this Public Law defines the term “inherently governmental function” as “a function that is so intimately related to the public interest as to require performance by Federal Government Employees.” Per Section 5(2)(B), inherently governmental functions include management of Government programs requiring value judgments, conduct of foreign relations, selection of program priorities, and the direction of intelligence and counter- intelligence operations. Per Section 5(2)(C), inherent governmental functions DO NOT include (i) gathering information for or providing advice, opinion, recommendations, or ideas to Federal Government officials; or (ii) any function that is primarily ministerial and internal in nature.”

When performing work associated with this PWS, the Contractor personnel shall make clear to all individuals they deal with that they are Contractor employees and not DOD employees.

6.6 The Contractor shall not manage, supervise or task DOD civilian employees or military personnel while performing the tasks within this PWS. The Contractor shall not make any commitment to non-DoD personnel which commit the expenditure of US Government resources.

6.7 All Contract personnel shall be clearly identified (i.e. company shirt, pin, visible company ID, etc.)

in a visible location to show who their employer is.

6.8 The Contractor shall not establish an employee-employer relation with FLCPH and shall not provide personnel services to FLCPH under this PWS.

7.0 BASE ACCESS

7.1 Defense Bio-metric Identification System (DBIDS)

7.2 The Contractor is responsible for obtaining base access to Joint Base Pearl Harbor-Hickam

(JBPHH) and must have Defense Bio-metric Identification System (DBIDS) credentials issued by the Nimitz Pass & ID Office. DBIDS is a force protection program designed to manage personnel, property and installation access. The Nimitz Pass & ID office is open 24 hours, seven days a week to accommodate DBIDS requests and is located at 1250 South Drive, Bldg. 3455, outside Nimitz Gate. The Contractor may retrieve fillable forms from www.cnic.navy.mil/om/dbids.html.

The Contractor shall submit all forms to the TPOC within ten (10) working days prior to the period of performance for all individuals to gain access to JBPHH. While the Government shall sponsor the Contractor for base access after award it is the Contractor’s responsibility to obtain the DBIDS credentials.

7.3 THE FOLLOWING NAVSUP LOCAL TEXT IS HEREBY MADE PART OF THE STATEMENT OF

WORK/PERFORMANCE WORK STATEMENT

Contractor Unclassified Access to Federally Controlled Facilities, Sensitive Information, Information Technology (IT) Systems or Protected Health Information

Homeland Security Presidential Directive (HSPD)-12, requires government agencies to develop and implement Federal security standards for Federal employees and contractors. The Deputy Secretary of Defense Directive-Type Memorandum (DTM) 08-006 – “DoD Implementation of Homeland Security Presidential Directive – 12 (HSPD-12)” dated November 26, 2008 (or its subsequent DoD instruction) directs implementation of HSPD-12. This clause is in accordance with HSPD-12 and its implementing directives.

APPLICABILITY

This text applies to contractor employees requiring physical access to any area of a federally controlled base, facility or activity and/or requiring access to a DoN or DoD computer/network/system to perform certain unclassified sensitive duties. This clause also applies to contractor employees who access Privacy Act and Protected Health Information, provide support associated with fiduciary duties, or perform duties that have been identified as National Security Position, as advised by the command security manager. It is the responsibility of the responsible security officer of the command/facility where the work is performed to ensure compliance.

Each contractor employee providing services at a Navy Command under this contract is required to obtain a Department of Defense Common Access Card (DoD CAC). Additionally, depending on the level of computer/network access, the contract employee will require a successful investigation as detailed below.

ACCESS TO FEDERAL FACILITIES

Per HSPD-12 and implementing guidance, all contractor employees working at a federally controlled base, facility or activity under this clause will require a DoD CAC. When access to a base, facility or activity is required contractor employees shall in-process with the Command’s Security Manager upon arrival to the Command and shall out-process prior to their departure at the completion of the individual’s performance under the contract.

ACCESS TO DOD IT SYSTEMS

In accordance with SECNAV M-5510.30, contractor employees who require access to DoN or DoD networks are categorized as IT-I, IT-II, or IT-III. The IT-II level, defined in detail in SECNAV M- 5510.30, includes positions which require access to information protected under the Privacy Act, to include Protected Health Information (PHI). All contractor employees under this contract who require access to Privacy Act protected information are therefore categorized no lower than IT-II. IT Levels are determined by the requiring activity’s Command Information Assurance Manager.

Contractor employees requiring privileged or IT-I level access, (when specified by the terms of the contract) require a Single Scope Background Investigation (SSBI) or T5 or T5R equivalent investigation, which is a higher level investigation than the National Agency Check with Law and Credit (NACLC)/T3/T3R described below. Due to the privileged system access, an investigation suitable for High Risk national security positions is required. Individuals who have access to system control, monitoring, or administration functions (e.g. system administrator, database administrator) require training and certification to Information Assurance Technical Level 1, and must be trained and certified on the Operating System or Computing Environment they are required to maintain.

Access to sensitive IT systems is contingent upon a favorably adjudicated background investigation. When access to IT systems is required for performance of the contractor employee’s duties, such employees shall in-process with the Navy Command’s Security Manager and Information Assurance Manager upon arrival to the Navy command and shall out-process prior to their departure at the completion of the individual’s performance under the contract.

Completion and approval of a System Authorization Access Request Navy (SAAR-N) form is required for all individuals accessing Navy Information Technology resources. The decision to authorize access to a government IT system/network is inherently governmental. The contractor supervisor is not authorized to sign the SAAR-N; therefore, the government employee with knowledge of the system/network access required or the COR shall sign the SAAR-N as the “supervisor”.

The SAAR-N shall be forwarded to the Command’s Security Manager at least 30 days prior to the individual’s start date. Failure to provide the required documentation at least 30 days prior to the individual’s start date may result in delaying the individual’s start date.

When required to maintain access to required IT systems or networks, the contractor shall ensure that all employees requiring access complete annual Information Assurance (IA) training, and maintain a current requisite background investigation. The Contractor’s Security Representative shall contact the Command Security Manager for guidance when reinvestigations are required.

INTERIM ACCESS

The Command's Security Manager may authorize issuance of a DoD CAC and interim access to a DoN or DoD unclassified computer/network upon a favorable review of the investigative questionnaire and advance favorable fingerprint results. When the results of the investigation are received and a favorable determination is not made, the contractor employee working on the contract under interim access will be denied access to the computer network and this denial will not relieve the contractor of his/her responsibility to perform.

DENIAL OR TERMINATION OF ACCESS

The potential consequences of any requirement under this clause including denial or termination of physical or system access in no way relieves the contractor from the requirement to execute performance under the contract within the timeframes specified in the contract. Contractors shall plan ahead in processing their employees and subcontractor employees. The contractor shall insert this clause in all subcontracts when the subcontractor is permitted to have unclassified access to a federally controlled facility, federally controlled information system/network and/or to government information, meaning information not authorized for public release.

CONTRACTOR’S SECURITY REPRESENTATIVE

The contractor shall designate an employee to serve as the Contractor’s Security Representative.

Within three workdays after contract award, the contractor shall provide to the requiring activity’s Security Manager and the Contracting Officer, in writing, the name, title, address and phone number for the Contractor’s Security Representative. The Contractor’s Security Representative shall be the primary point of contact on any security matter. The Contractor’s Security Representative shall not be replaced or removed without prior notice to the Contracting Officer and Command Security Manager.

BACKGROUND INVESTIGATION REQUIREMENTS AND SECURITY APPROVAL PROCESS

FOR CONTRACTORS ASSIGNED TO NATIONAL SECURITY POSITIONS OR PERFORMING

SENSITIVE DUTIES

Navy security policy requires that all positions be given a sensitivity value based on level of risk factors to ensure appropriate protective measures are applied. Contractor employees under this contract are recognized as Non-Critical Sensitive [ADP/IT-II] positions when the contract scope of work require physical access to a federally controlled base, facility or activity and/or requiring access to a DoD computer/network, to perform unclassified sensitive duties. This designation is also applied to contractor employees who access Privacy Act and Protected Health Information (PHI), provide support associated with fiduciary duties, or perform duties that have been identified as National Security Positions. At a minimum, each contractor employee must be a US citizen and have a favorably completed NACLC or T3 or T3R equivalent investigation to obtain a favorable determination for assignment to a non-critical sensitive or IT-II position. The investigation consists of a standard NAC and a FBI fingerprint check plus law enforcement checks and credit check. Each contractor employee filling a non-critical sensitive or IT-II position is required to complete:

• SF-86 Questionnaire for National Security Positions (or equivalent OPM investigative product)

• Two FD-258 Applicant Fingerprint Cards (or an electronic fingerprint submission)

• Original Signed Release Statements

Failure to provide the required documentation at least 30 days prior to the individual’s start date shall result in delaying the individual’s start date. Background investigations shall be reinitiated as required to ensure investigations remain current (not older than 10 years) throughout the contract performance period. The Contractor’s Security Representative shall contact the Command Security Manager for guidance when reinvestigations are required.

Regardless of their duties or IT access requirements ALL contractor employees shall in-process with the Command’s Security Manager upon arrival to the command and shall out-process prior to their departure at the completion of the individual’s performance under the contract. Employees requiring IT access shall also check-in and check-out with the Navy Command’s Information Assurance Manager. Completion and approval of a System Authorization Access Request Navy (SAAR-N) form is required for all individuals accessing Navy Information Technology resources.

The SAAR-N shall be forwarded to the Navy Command’s Security Manager at least 30 days prior to the individual’s start date. Failure to provide the required documentation at least 30 days prior to the individual’s start date shall result in delaying the individual’s start date.

The contractor shall ensure that each contract employee requiring access to IT systems or networks complete annual Information Assurance (IA) training and maintain a current requisite background investigation. Contractor employees shall accurately complete the required investigative forms prior to submission to the Command Security Manager. The Command’s Security Manager will review the submitted documentation for completeness prior to submitting it to the Office of Personnel Management (OPM); Potential suitability or security issues identified may render the contractor employee ineligible for the assignment. An unfavorable determination is final (subject to SF-86 appeal procedures) and such a determination does not relieve the contractor from meeting any contractual obligation under the contract. The Command’s Security Manager will forward the required forms to OPM for processing. Once the investigation is complete, the results will be forwarded by OPM to the DoD Central Adjudication Facility (CAF) for a determination.

If the contractor employee already possesses a current favorably adjudicated investigation, the contractor shall submit a Visit Authorization Request (VAR) via the Joint Personnel Adjudication System (JPAS) or a hard copy VAR directly from the contractor’s Security Representative.

Although the contractor will take JPAS “Owning” role over the contractor employee, the Command will take JPAS "Servicing" role over the contractor employee during the hiring process and for the duration of assignment under that contract. The contractor shall include the IT Position Category per SECNAV M-5510.30 for each employee designated on a VAR. The VAR requires annual renewal for the duration of the employee’s performance under the contract.

BACKGROUND INVESTIGATION REQUIREMENTS AND SECURITY APPROVAL PROCESS

FOR CONTRACTORS ASSIGNED TO OR PERFORMING NON-SENSITIVE DUTIES

Contractor employee whose work is unclassified and non-sensitive (e.g., performing certain duties such as lawn maintenance, vendor services, etc .... ) and who require physical access to publicly accessible areas to perform those duties shall meet the following minimum requirements:

• Must be either a US citizen or a US permanent resident with a minimum of 3 years legal residency in the United States (as required by The Deputy Secretary of Defense DTM 08-006 or its subsequent DoD instruction) and

• Must have a favorably completed National Agency Check with Written Inquiries (NACI) or T1 investigation equivalent including a FBI fingerprint check prior to installation access.

To be considered for a favorable trustworthiness determination, the Contractor’s Security Representative must submit for all employees each of the following:

• SF-85 Questionnaire for Non-Sensitive Positions

• Two FD-258 Applicant Fingerprint Cards (or an electronic fingerprint submission)

• Original Signed Release Statements

The contractor shall ensure each individual employee has a current favorably completed National Agency Check with Written Inquiries (NACI) or T1 equivalent investigation or ensure successful FBI fingerprint results have been gained and investigation has been processed with OPM.

Failure to provide the required documentation at least 30 days prior to the individual’s start date may result in delaying the individual’s start date.

9.0 HOURS OF PERFORMANCE:

Normal working hours are Monday through Fridays, excluding Federal Holidays between the hours of 7:00 A.M. to 3:30 P.M. No access is available after hours or weekends/holidays.

10.0 FEDERAL HOLIDAYS (To include Presidential Executive Orders)

New Year’s Day 2nd of January Dr. Martin Luther King’s Birthday 3rd Monday in January Presidents’ Day 3rd Monday in February Memorial Day 5th Monday in May Juneteenth 19th of June Independence Day 4th of July Labor Day 1st Monday in September Columbus Day 2nd Monday in October Veterans’ Day 10th of November Thanksgiving Day 4th Thursday in November Christmas Day 25th of December

If the Federal holiday falls on a Saturday, the holiday is observed on the proceeding Friday. If the Federal Holiday falls on a Sunday, the holiday is observed on the following Monday.

11.0 PERIOD OF PERFORMANCE:

The Period of Performance is from the date of contract award through 30-September 2026. All work must be completed no later than 30-September 2026. After award, the contractor shall contact the TPOC to coordinate base access and scheduling of the work.
