NOTICE TO OFFERORS

NOTICE TO ALL OFFERORS: The Government anticipates awarding a firm, fixed price contract in response to quotes/proposals received to this solicitation. As a result, the contract's pricing will not be subject to any adjustment on the basis of the contractor's increased costs due to COVID-19 and/or inflationary causes experienced during contract performance. Because a firm, fixed price contract places the maximum risk and full responsibility for all costs and resulting profit or loss on the contractor, offerors are advised to consider these risks when pricing their quotes/proposals.

1. This solicitation is for the procurement of Rescure Equipment Maintenance in support of CNRJ Fire & Emergency Services. It is anticipated that this solicitation will result in an award of a Firm, Fixed-Price Service type contract. Payment will be by Prompt Payment via WAWF.

2. The entire solicitation shall be filled out, signed, and returned as part of your quote. See block 8 on page 1 of the solicitation for the closing date and time.

3. The deadline for submission of questions regarding the solicitation’s terms, conditions, specifications, and/or the Statement of Work (SOW) / Performance Work Statement (PWS) is 2 days prior to the solicitation closing date.

All questions regarding this solicitation shall be submitted in writing via email to:

4. Award will be made to the quote/offer that represents the best value to the Government. Note: the Government reserves the right to consider the past performance of all quotes/offers, conduct a price, past performance tradeoff, and award to other than the lowest price quote/offer. Note: the Government reserves the right to consider the delivery timeframe of all quotes/offers, conduct a delivery and price tradeoff, and award to other than the lowest price quote/offer.

5. SINGLE AWARD FOR ALL ITEMS: Due to the interrelationship of supplies and/or services to be provided hereunder, the Government reserves the right to make a single award to the bidder whose quote is considered in the best interest of the government, price and other factors considered. Therefore, bidders who quote less than the entire effort specified herein may be determined to be unacceptable.

6. EXCEPTIONS: All bidders MUST note all exceptions from the solicitation’s terms conditions, specifications, and/or the statement of work / performance work statement, if any. It will be assumed that any quote without mention of any exceptions will take no exception from all specifications, terms and conditions, clauses, or provisions within the solicitation.

7. SOLE SOURCE: To be negotiated on a Sole Source basis for L.N Curtis & Sons Rescure Equipment Maintenance per FAR 6.302. Interested persons may identify their interest and capability by responding to the requirement or submitting quotations prior to offer due date, which will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination not to compete this action based upon responses received to this notice is solely within the discretion of the government.

NOTE: In accordance with 52.212-4(f), in part, "The contractor will be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the contractor." Defense Biometric Identification System (DBIDS):

Commander, Navy Installations Command (CNIC), has established the Defense Biometric Identification System (DBIDS) to improve management and force protection at Navy installations. http://dbids.dmdc.mil/#!/. DBIDS is a standardized process for granting unescorted access privileges to vendors, contractors, suppliers, and service providers not otherwise entitled to the issuance of a Common Access Card (CAC) who seek access to and can provide justification to enter Navy installations and facilities. Visiting vendors may obtain daily passes directly from the individual Navy Installations by submitting identification credentials for verification and undergoing a criminal screening/background check. Alternatively, if the vendor so chooses, it may voluntarily elect to obtain long-term credentials through enrollment registration, backing vetting, screening, issuance of credentials through a designated independent contractor DBIDS service provider.

Title: Perform annual inspection and testing of CNRJ powered rescue tools List of tools is attached.

1. Maintenance work is provided by Manufacture certified technician in accordance with current edition of NFPA1936 Standard on Powered rescue tool, Chapter 4.3. Maintenance report/certification of inspection/maintenance to be provided to CNRJ within 21 days after work completion. List of tools for maintenance/inspection is attached.

2. General: Unless otherwise specified hereinafter, the contractor shall furnish all labor, material, equipment, transportation and supervision necessary to provide all the maintenance.

6. Work Schedule: The work shall be performed from 0800 to 1545, Monday through Friday except U.S. Government holidays. The Contractor shall arrange his work so as not to cause interference with normal occurrence of the Government business.

7. Pre-Performance Conference: Prior to commencing work, the Contractor shall meet in conference with the CNRJ FIRE representative at each location to discuss and develop mutual understandings relative to scheduling and administering the work.

8. Activity Regulations: Obey activity regulations, including fire, traffic, safety, energy conservation, security, and environmental regulations. Personnel employed at the activity shall keep within the limits of the work (and avenues of ingress and egress) and shall not enter any restricted areas unless required to do so and are cleared for such entry. Wear hard hats, with the Contractor’s name prominently displayed, in designated hardhat areas. The contractor’s hours for the contractor’s work shall conform to para. ”Work Schedule” of this specification.

9. Examination of Premises: Offerers or quoters are expected to satisfy themselves as to the general and local conditions that may affect the cost of the performance of the work to the extent that such information is reasonably obtainable. It is considered impractical to determine, without inspection, the exact nature of the work and site conditions under which the work is to be performed. The government will arrange the site visit for the offerers or quoters, and give the notice to them.

10. Existing Work: Protect existing work which is to remain in place, be reused, or remain the property of the Government. Repair items which are to remain, and which are damaged during performance of the work to their original condition, or replace with new. Repair, reinforcement, or structural replacement shall have CNRJ FIRE representative approval. All work of this nature shall be performed at the contractor’s expense and shall be performed as directed by the CNRJ FIRE representative. At the completion of all operations, existing work shall be in a condition equal to or better than that which existed before the work started.

11. Temporary Work: Unless otherwise indicated, all existing objects which interfere with new work shall be removed temporarily and reinstalled upon completion of new work.

12. Clean-up: All debris in work areas shall be cleaned up daily or more frequently as necessary. Construction debris may be temporarily located in an approved location;

however garbage accumulation must be removed each day.

13. Disposal: All rubbish resulting from the work under this contract shall be disposed of by the contractor at his expense off U.S. Government property and at approved facilities for such disposal in accordance with Japanese Law, Japan Environmental Governing Standards (JEGS), and local regulations.

14. Fire Protection: The Contractor shall not be permitted to use heat or spark producing equipment and tools and heated products within hazardous area, except approved by the CNRJ FIRE representative. The contractor shall be fully responsible to prevent life and fire hazards. No smoking is allowed except in designated area.

15. Public Safety: Whenever the contractor’s operations create a condition hazardous to traffic or to public, the contractor shall furnish at his/her expense and without cost to the government, such flagmen and guards as necessary to give adequate warning to the public of any dangerous conditions to be encountered, and the Contractor shall furnish, erect, and maintain such fence, barricades, lights, signs and other devices as are necessary to prevent accidents and avoid damage or injury to the public.

NOTICE TO CONTRACTORS: Information for Contractor Employees Seeking to Enter Japan

1. The following is provided for the information of contractors to the U.S. Navy whose employees need to enter Japan to perform contract requirements. The information is current as of February 2023. While the information is believed to be accurate, policies and procedures are continuing to change on a regular basis.

2. See https://www.japan.travel/en/coronavirus/ for a list of the current restrictions and COVID entry procedures.

3. All contractor personnel arriving in Japan should utilize the process outlined in the attached USFJ Instruction to ensure they are recognized as members of the civilian component under Article 1.b. of the SOFA. The process requires that a contractor contact the contracting officer for the contract on which its employee will perform in Japan prior to the employee traveling to Japan. Contact is made through the Synchronized Pre-deployment and Operational Tracker (SPOT) system. The contractor will provide information to the contracting officer about the traveling employee. Following review, the contracting officer will issue the contractor a Letter of Authorization (LOA). The incoming contractor employee will hand carry a copy of the LOA and show it to the Japanese immigration authority at the port of entry as evidence of SOFA status.

Contractors who do not have current access to SPOT should contact their contracting officer for information about accessing SPOT.

4. This memo is intended to provide current information for contractors whose employees need to enter Japan to perform contract requirements. Nothing in the memo should be understood to change the terms or conditions of an existing contract. Any such changes must be made by an authorized contracting officer.

52.204-27 PROHIBITION ON A BYTEDANCE COVERED APPLICATION (JUN 2023)

(a) Definitions. As used in this clause--

Covered application means the social networking service TikTok or any successor application or service developed or provided by ByteDance Limited or an entity owned by ByteDance Limited.

Information technology, as defined in 40 U.S.C. 11101(6)--

(1) Means any equipment or interconnected system or subsystem of equipment, used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information by the executive agency, if the equipment is used by the executive agency directly or is used by a contractor under a contract with the executive agency that requires the use-

(i) Of that equipment; or

(ii) Of that equipment to a significant extent in the performance of a service or the furnishing of a product;

(2) Includes computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources; but

(3) Does not include any equipment acquired by a Federal contractor incidental to a Federal contract.

(b) Prohibition. Section 102 of Division R of the Consolidated Appropriations Act, 2023 (Pub. L. 117-328), the No TikTok on Government Devices Act, and its implementing guidance under Office of Management and Budget (OMB) Memorandum M-23-13, dated February 27, 2023, "No TikTok on Government Devices" Implementation Guidance, collectively prohibit the presence or use of a covered application on executive agency information technology, including certain equipment used by Federal contractors. The Contractor is prohibited from having or using a covered application on any information technology owned or managed by the Government, or on any information technology used or provided by the Contractor under this contract, including equipment provided by the Contractor's employees; however, this prohibition does not apply if the Contracting Officer provides written notification to the Contractor that an exception has been granted in accordance with OMB Memorandum M-23-13.

(c) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (c), in all subcontracts, including subcontracts for the acquisition of commercial products or commercial services.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (JAN 2023)

(a) Definitions. As used in this clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall—

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF.
