About this file

This is a General Instructions to Bidders document issued by the Brodhead Creek Regional Authority for a Pavement Patching Services contract. The solicitation seeks sealed bids for the patching and paving of road openings related to Authority excavations resulting from waterline repairs. Bids must be submitted exclusively through the PennBID website by June 24, 2026, at 2:00 P.M. to the Authority's office located at 410 Mill Creek Road, East Stroudsburg, Pennsylvania 18301. The Authority does not guarantee a specific quantity of materials will be purchased; rather, materials will be ordered on an as-needed basis, with provided quantities serving only as estimates to inform bidding and establish the 10 percent bid deposit requirement. The contract term is one year from the date of award, with bid opening and review scheduled for a subsequent Board meeting. Bidders must complete all requested work within 45 days of work areas being provided to the contractor or face a penalty fee of $100 per day.

Bids shall be submitted without state sales tax as the Authority is exempt. Each bid proposal must be accompanied by a bid deposit equal to 10 percent of the total maximum bid made payable to the Brodhead Creek Regional Authority in the form of a certified check, cashier's check, money order, or bid bond from an approved surety company licensed in Pennsylvania. The winning bidder's bid deposit will be retained by the Authority for the contract length to cover liquidated damages, while unsuccessful bidders' deposits will be returned upon contract execution. All bids must be firm and cannot be withdrawn for 30 days from the bid opening date. The Authority reserves the right to reject any and all bids or parts thereof and will award the contract to the responsible bidder submitting the lowest bid for each item while complying with bid conditions. Bidders must clearly note any technical exceptions to specifications in writing and submit three references of similar job experience along with documentation of equipment type and size to be used for the paving work.

The total maximum value shall be the sum of all line items/Subsections being bid. The quantities provided on the bid sheet are only an estimate of what might be needed for the contract period. The main purpose in providing a quantity is to give the supplier some idea of quantity for the bid and also have a firm number to establish the 10% bid deposit amount.

7. All bid proposals shall be viewed in Penn BID and read at the above time at the
