About this file
This is a Simplified Lease Acquisition Threshold (SLAT) Absence of Competition Memo and supporting Justification for Other Than Full and Open Competition (JOFOC) documentation for a federal real estate lease renewal.
The Mine Safety and Health Administration (MSHA) seeks to renew lease LOR07190 for office space located at 321 1st Ave E, Albany, Oregon 97321, expiring August 16, 2026. The renewal covers 3,146 assignable square feet (3,618 rentable square feet) for a 10-year term with 5 years firm. Market research was conducted through SAM.gov postings (December 11-26, 2023 and February 26-March 5, 2026) and searches on LoopNet and Crexi, yielding zero responses and no acceptable alternative locations. The cost-benefit analysis demonstrates that remaining in the current location generates $252,555 in aggregate cost savings over 10 years ($16.71 per assignable square foot annually) compared to relocation. The current location carries total rental payments of $1,659,570.32 versus $1,912,125.24 for the lowest-priced alternative. MSHA's mission requirement to remain within Albany city limits cannot be satisfied by any other available office space. The contracting officer certified that direct negotiation with the incumbent lessor at 321 1st Ave E represents the Government's best interest under GSAM 570.402-1(a), 570.203-2, 570.402-4, 570.402-5, and 570.402-6, supported by substantial duplication costs that cannot be recovered through competition per FAR 6.302-1(a)(2)(ii)(A).

Simplified Lease Acquisition Threshold - Absence of Competition Memo
Project Number: 3OR0245
Documentation to Explain the Absence of Competition
Lease number LOR07190 occupied by Mine Safety Health Administration (MSHA), will expire on 8/16/2026. As part of the Government’s review of the agency’s ongoing space requirements, it was determined that the current space represents the most advantageous location to meet the continuing needs of the tenant agency.
This determination is supported by the Succeeding Lease Analysis Tool, which is attached to this memo and summarized below:
Market research was conducted using the following:
CoStar / LoopNet / Crexi SAM.gov Contract Opportunities posting (required if over $25,000 Total Contract Value)
No responses received An advertisement requesting expressions of interest was listed on SAM.gov from
December 11, 2023 through December 26, 2023, and no responses were received.

The decision to pursue a succeeding lease action for this project is supported by GSAM 570.402-1(a) and 570.203-2 via the following rationale:
Cost based rationale The Succeeding Lease Analysis Tool was used to evaluate the expected costs of remaining in place to the costs of relocation to a new location. The analysis demonstrates that the Government could not expect to recover relocation and duplication costs through full and open competition. The expected cost savings for this action is $252,555.00 which represents savings of $16.71/ABOA SF
Mission based rationale The agency’s mission for this location requires a unique location and cannot be satisfied through any alternative locations. The agency’s mission and justification for a unique location is summarized below:

Justification for Other than Full and Open Competition Under Simplified Lease Acquisition Threshold
Memo to File
Existing Lease Number: LOR07190 Project Number: 3OR0245 Agency Name: MSHA City, State: Albany, OR Lease Action Type: Succeeding Rentable SF: 3,618 SF Average Net Annual Rent: $97,686.00 Proposed Term: 10 years, 5 years firm
Market research was performed as follows, and did not identify any potential acceptable locations:
● An advertisement requesting expressions of interest was listed on SAM.gov from December 11, 2023 through December 26, 2023, and no responses were received.
● The Leasing Specialist conducted searches on LoopNet and no results were returned.
This Memorandum documents that the contracting officer did not identify any potential acceptable locations through advertisement or market survey and serves as the written justification to negotiate directly with the present lessor in accordance with GSAM 570.402-4, No Potential Acceptable Locations, and FAR 6.3, Other Than Full and Open Competition.
Market research was performed and 0 potentially acceptable locations were identified. In accordance with GSAM 570.402-5 & 402-6, the contracting officer performed a cost-benefit analysis using the Succeeding Lease Analysis Tool (attached). The cost-benefit analysis indicates 1) “the Government cannot expect to recover relocation costs and duplication costs through competition” per GSAM 570.402-5(b), and 2) that “award to any other offeror will likely result in substantial costs to the Government that the Government cannot expect to recover through competition” per GSAM 570.402-5(b)(2); therefore, the contracting officer determined a single-source procurement is the most viable option.
MISSION BASIS AND/OR RELEVANT FACTS FOR STAYING IN PLACE
MSHA submitted a continuing needs requirement to remain within the City Limits of Albany, OR; however, there are no potential acceptable office spaces located in MSHA’s delineated area other than the incumbent lessor’s space. In order for MSHA to stay within the City Limits of Albany a succeeding lease is recommended.
CONTRACTING OFFICER CERTIFICATION
The Contracting Officer determines and certifies that the award of this procurement is in the Government's best interest, the anticipated cost to the Government is fair and reasonable, and that this Justification is accurate and complete to the best of my knowledge and belief.
