About this file

This is a Justification for Other Than Full and Open Competition document for a succeeding lease award by the General Services Administration.

The GSA seeks to award a succeeding lease to the incumbent lessor, Tampa GSA MEPS, LLC, for 25,248 assignable building area/27,398 rentable square feet of office space at 3520 West Waters Avenue, Tampa, Florida under lease number LFL61858. The current lease expires June 16, 2026, and the new lease term will be fifteen years with a ten-year firm period. The Military Enlistment Processing Command (MEPC) requires only a back-up generator as an improvement to support this location. The leased space is located within a defined geographic area in Tampa bounded by SR 589/Veterans Expressway to the north, Interstate 275 to the south and east, and SR 60/Veterans Expressway to the west. No vacant federal space is available as an alternative. The GSA conducted market research using CoStar and identified four potentially acceptable locations within the delineated area. A SAM.gov advertisement was posted on March 3, 2026, for 21 days. The contracting officer determined the proposed rental rate is fair and reasonable based on market surveys showing rental rates in the area ranging between specific dollar amounts per RSF (amounts redacted). The justification cites 41 U.S.C. 3304(a)(1) and GSAR 570.402 as statutory authority. A cost-benefit analysis demonstrated that relocation would result in substantial duplication costs and move expenses that would not be recovered through competition, making continued occupancy at the current location the most economical option for the government.

Revised 10-23-2023

Justification for Other Than Full and Open Competition, Succeeding Lease

U.S. General Services Administration

GSA

Public Building Service- Office of Leasing

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

PROJECT NUMBER: 3FL0638

Agency Name: Military Enlistment Processing Command (MEPC)

1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.

The General Services Administration currently leases 25,248 ABOA/27,398 RSF of office space at 3520 West Waters Avenue, Tampa, Florida under lease number LFL61858. The current lease expires on June 16, 2026. Approval is requested to negotiate a succeeding lease with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The procedures for pursuing a succeeding lease are detailed in GSAR 570.402: Succeeding Leases.

2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

(INCLUDING ESTIMATED VALUE).

MEPC submitted a continuing need letter for 27,398 rentable square feet of office and related space on February 6, 2024. MEPC requires only a back-up generator to support this location. A modified TI allowance was established for this project and is based on an independent government estimate for the required improvements.

This requirement is for 25,248 ABOA/27,398 RSF of space for a fifteen (15) year, ten-year (10) firm lease on information quotes received in response to advertisement $ which is a levelized per rentable square feet per year $ and a total contract value of $ figure based on information quotes received in response to advertisement. The delineated area is defined as:

North: From the intersection of SR 589/Veterans Expressway and SR 568, proceed east on SR 568 until its intersection with SR 597. Proceed south on SR 597 until its intersection with Van Dyke Road. Proceed east on Van Dyke Road until its intersection with Simmons Road. Proceed south on Simmons Road until its intersection with Crenshaw Lake Road. Proceed east on Crenshaw Lake Road until its intersection with U.S. 41/N. Nebraska Avenue.

East and South: Proceed south on U.S. 41 until its intersection with Interstate 275. Proceed south and then west on I-275 until its intersection with SR 60/Veterans Expressway.

West: Proceed north on SR 60 and continue north onto SR 589 until its intersection with SR 568.

There is no vacant Federal Space available.

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through: FAR model deviation 6.103-1 of the FAR Council’s model deviation to FAR Part 6 (adopted by GSA RFO-2025-06, Class Deviation for FAR Part 6) and GSAR 570.402. In accordance with GSAR 570.402, use of the sole source authority is appropriate where it is determined that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.

4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

It is in the best interest of the Government to remain at the current location. Award to other than the current Lessor would require relocation of the entire requirement and would cause MEPC to incur move and replication costs that would not be recovered through competition. Relocation costs are estimated to be $ . Additionally, this allows the Government to make use of existing tenant improvements, avoiding replication costs of $ for specialized space to support the MEPC mission. A cost-benefit analysis was completed following the procedures set forth in GSAR 570.402-6. The cost of relocating MEPC using the low cost quote exceeds the cost of remaining at 3520 West Waters Avenue.

The total savings to the Government is $ .

5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

Per the requirements of GSAR 570.402, the GSA Lease Contracting Officer placed an advertisement on the Contracting Opportunities domain of SAM.gov on March 3, 2026, for 21 days. In addition, a national broker contractor conducted market research using Costar.

6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO

THE GOVERNMENT WILL BE FAIR AND REASONABLE.

Recent market surveys conducted by Public Properties in Tampa, FL showed the rental rate within the delineated area ranges from $ - $ per RSF.

Therefore, the proposed rental rate for this succeeding lease with a levelized rent of $ is within the current market range for this submarket and is deemed fair and reasonable by the GSA Lease Contracting Officer.

7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.

GSAR 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition.

On February 6, 2026, Public Properties conducted market research using CoStar and identified four (4) potentially acceptable locations including the incumbent that might meet the agency’s needs within the delineated area. In addition, PBS posted an advertisement conforming to GSAR 570.402-2 on the Contract Opportunities domain of SAM.gov website on March 3,2026. The incumbent Lessor’s expression of interest indicated what the rate would be per RSF.

See Figure 1 below for the results of the market research and SAM.gov advertisement, including the incumbent.

8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.

In accordance with the requirements of GSAM 517.207(b), the lessor’s performance under this lease has met the Government’s expectations for quality performance. The most recent inspection by the Government’s property manager documented that the Lessor has done a good job in maintaining the space in accordance with the lease requirements and is responsive to the Government.

9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION.

Tampa GSA MEPS, LLC- incumbent

10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.

There are no systemic barriers to competition. If the agency has a continuing need for space upon lease expiration, GSA will follow all authorities, regulations and policies applicable to lease acquisition. Should there be remaining useful life in the Government’s improvements, the Government will consider the cost of moving from the existing location, and the cost to build out new space when deciding whether to undergo a competitive action.

Additionally, objective scrutiny will be given to the customer agency’s mission and security requirements (if applicable) to eliminate unnecessary agency space requirements that may be deemed unduly restrictive.

11. CONTRACTING OFFICER CERTIFICATION.

By signature on this Justification for Other than Full and Open Competition, the GSA Lease Contracting Officer certifies that the award of a succeeding lease of 27,398 RSF is in the Government’s best interest and that this Justification is accurate and complete to the best of the GSA Lease Contracting Officer’s knowledge and belief.
