EXECEPTION TO FAIR OPPORTUNITY

Multiple Award Schedule (MAS)/ Multiple Award Contract (MAC)

Orders under MAC/ Fair Opportunity – FAR 16.505, DFARS 216.505-70, PGI 216.505-70

Purchase Request Number: 37133-67 Contract Number: HC1028-12-D-0024 Task/Delivery Order Number: 0171 Procurement Title: Defense Finance & Accounting Service (DFAS) Interoperability (IOP) Support Contracting Office: Defense Information Systems Agency (DISA)/Defense Information Technology Contracting Organization (DITCO)/Joint Interoperability Test Command (JITC) Mission Support Section (PL8315) Estimated Value: $32,748.14 Authority: FAR 16.505(b)(2)(i)(C)

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this exception to fair opportunity pursuant to the authority of FAR 16.505(b)(2)(i)(C).

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

a. Requiring Agency:

DISA/JITC

2001 Brainard Road, Building 57305 Fort Huachuca, Arizona, 85670

b. Contracting Office:

DISA/DITCO/PL8315

2300 East Drive, Building 3600 Scott Air Force Base, Illinois, 62225

2. NATURE/DESCRIPTION OF ACTION(S):

a. The nature of this action is to modify the current cost-plus-fixed-fee (CPFF) task order (TO) against the Testing and Evaluation (T&E) Multiple Support Services (MSS) indefinite-delivery/indefinite-quantity (ID/IQ) contract, held by TASC, Inc., a large business. This modification will add 445.40 labor hours to the functional area analyst (Prin), 7.20 hours to the systems analyst (Inter), 6.50 hours to the secretary 3, and 3.60 hours to the intelligence systems analyst, to support additional interoperability testing.

b. The lifecycle cost will increase by $32,748.14 from $7,309.16 to $40,057.30, which is a 141% increase of the current lifecycle cost.

3. DESCRIPTION OF SUPPLIES/SERVICES:

a. The Defense Health Information Management System (DHIMS) provides information management and IT solutions that capture, manage and share healthcare data for the military's Electronic Health Record (EHR). The EHR is used by the military's medical community and supports the management of more than 9.6 million Military Health System (MHS) beneficiary records. DHIMS provides one of the largest and most comprehensive EHRs in the world and is committed to delivering clinical information technology (IT) solutions that enable continuity of care and timely administration of benefits to Service members and their families (http://dhims.health.mil).

b. The contractor is required to collect data from the EHR during interoperability testing, and provide a Statement of Joint Interoperability Readiness. In doing so, the contractor will provide a formal Quick-Look Report as well as a formal Operational Evaluation Report input after conclusion of data analysis, to the Army Medical Department. Additionally, the contractor shall provide summaries of test progress, document test results, and provide recommendations for enhancing the task operations during the test event.

c. The period of performance end date remains unchanged at March 27, 2014 through March 26, 2015.

4. SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE

PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF

THE ACQUISITION REQUIRES USE OF AN EXCEPTION TO FAIR OPPORTUNITY:

(a) Exception to Fair Opportunity. IAW FAR 16.505(b)(2)(i)(C): The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical modification to an order already issued under the contract, and all awardees were given a fair opportunity to be considered for the original order.

(b) Description of the Justification. DFAS IOP support task order was awarded as a CPFF task order to TASC on March 27, 2013 following a fair opportunity competition using the JITC T&E MSS IDIQ contracts. The awarded contract was modified on August 22, 2013;

Modification 02 to include additional testing and travel requirements. Because the additional task falls in scope with the current DFAS IOP Support task, the logical modification is to an order already issued under the current contract.

All contractors were given an opportunity to submit a proposal for the original award.

Three proposals were received in response to the RFP.

(c) Justification:

(1) Minimum Government requirements. The Government requires highly specialized, multi-disciplinary knowledge, minimal secret security clearance, and the need for staff to be available immediately to continue support operations. These support operations require the contractor’s staff to have knowledge/understanding of DFAS IOP requirements.

(2) Proposed sole source contractor. The incumbent contractor TASC, Inc. is the contractor that can perform the work for the least amount of cost to the government and customer, due to the amount already invested, and still meets the testing schedule timeframes due to their extensive knowledge and current testing of the DFAS system.

TASC received the award of the existing task order HC1028-12-D-0024-0171 through fair opportunity under the T&E MSS contract. Therefore the logical choice is to continue work on the task order.

(3) Discussion regarding cause of the sole source situation. The reason for this sole source submittal was due to the decisions of the DFAS Program Office to delay testing criteria until the Battle Casualty code was signed by Chief of Staff for the Director of Healthcare Operations, and implemented by the Services. This modification is a logical increase to existing work. Holding a separate fair opportunity competition simply to increase the level of effort for the exact work already under contract would result in the needless and substantial duplication of costs and resources as well as possible degradation of the mission and loss of customer support and confidence.

(4) Demonstration of unique source. TASC, Inc. is the only qualified contractor capable of providing these services within the time and funding constraints imposed by the DFAS Program Management Office. TASC, Inc. is in place now, with proper security clearances supporting this task and is capable of continuing without interruption. No phase-in or ramp-up will be required to expand this support. Therefore, it is not in the best interest of the government to compete this task at the present time. Additionally, since TASC, Inc. developed the initial DFAS plan, the use of another contractor would require the development of a new plan.

(5) Procurement discussion. The original task order was competed among all seven T&E

MSS contractors. Three offerors participated in this competition, of which TASC, Inc. was evaluated as the lowest-priced, technically acceptable offer. This increase is required to support the additional labor hours required to support the DFAS IOP test and certification requirements.

(6) Impact: If JITC were to compete this task, based on historical experience, it could delay the start of the task up to three months based on the timelines to issue a competitive task and up to six months to get a tester with clearance and full knowledge and understanding of DFAS. Selecting another prime contractor would increase costs due to the estimated 480 labor hours (or two months), based on historical experience, to familiarize themselves with the system well enough to develop a test plan and carry out the test. To compete the task, bring the next contractor on-line and up to speed on DFAS, if it isn’t TASC, Inc. would not meet the customer’s acquisition schedule. Selecting another prime contractor would increase costs by approximately $10,000 - $30,000 due to the need to familiarize themselves with these services and in turn solicit quotes based on historical data.
