About this file
This document is a Limited Sources Justification under FAR 8.405-6 for an Automated Pharmacy Robot System for the Department of Veterans Affairs (VA) Fredericksburg Healthcare Center. The VA is conducting a sole-source acquisition, under the Multiple-Award Schedule Program, to purchase an Automated Pharmacy Robot System and related equipment from ScriptPro USA. The justification states that ScriptPro is the only vendor that can meet the VA's requirements, as the system must interface with the existing ScriptPro system at the Richmond VA Medical Center. The total award value is $742,231.03, with a contract period of performance from 09/09/2024 to an unspecified end date. The VA conducted market research but was unable to identify any other vendors that could meet the requirement. The justification provides details on the specific equipment and software to be procured, as well as the rationale for the sole-source award to ScriptPro.

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
|_| FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:
|X| FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
Currently, ScriptPro is the only Automated Pharmacy Robot System in Federal Supply Classification (FSC) Groups 65 and/or 66. In accordance with VAAR 808.004-70(b), “Contracting officers shall consider these priority contract vehicles, [Federal Supply Classification (FSC) Groups 65 and/or 66], before using other existing contract vehicles.
Further, the Fredericksburg HCC requires a system that interfaces with the system currently in place at the Richmond Veterans Affairs Medical Center (VAMC), which is ScriptPro. This system tracks prescriptions across the Richmond VA healthcare network. The use of another Automated Pharmacy Robot System would result in a disruption in tracking patient prescriptions from one facility to another in the Richmond VAMC area of responsibility (AOR). According to GSA contract #36F79719D0135, attempting to interface another vendor’s system into the existing ScriptPro system at the Richmond VAMC and facilities within the AOR would result in voiding the warranties on equipment currently deployed.
|_| FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.
|_| FAR 8.405-6(b): Items peculiar to one manufacturer:
|_| A patent, copyright or proprietary data limits competition. The proprietary data is:
|_| These are “direct replacements” parts/components for existing equipment.
|_| The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:
The deployment of ScriptPro’s Automated Pharmacy Robot System at the Fredericksburg HCC represents the best value to the government because it will maintain a homogeneous prescription refill system within the Richmond VAMC. This will support the continuity of patient care from facility to facility within the Richmond VAMC AOR.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.
GSA Advantage! was searched using keyword Robotic Prescription Dispensing System; the only products that could meet the needs of the VA was the ScriptPro Robotic Prescription Dispensing System. On 07/15/2024, a sources sought was posted on GSA eBuy; three response were received from Flavorx, Inc., L1 Enterprses, Inc., and Claflin Service Company (CME). None of the respondents could provide a product that could meet the VA’s needs. The VA Rule of Two cannot be met.
(7) Any Other Facts Supporting the Justification:
There are no other facts to support this justification.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
VA will continue to perform market research on future requirements to determine the availability of competition.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
