4 2.2.2

The Governments answer to #12 in in Amendment 0001 states that "that there is not an expectation of receiving reasonably priced offers from two or more responsible, small business concerns that manufacture nebulizers and accessories or supply nebulizers and accessories manufactured in the United States by another small business". There are items available that are produced and manufactured in TAA compliant countries. Why specifically are you making this requirement for the US and not considering TAA compliant countries?

Answer The Government believes it has properly interpreted policy guidelines.

6 2.2.2

What market research did the VA conduct to adhere to the VA’s Procurement Policy Memorandum with respect to Implementation of the Veterans First Contracting Program?

Specifically, what is the VA referring to in response to Question #12 in Amendment 0001 when it refers to “initial and refreshed” market research conducted to determine that it was unlikely that the VA would receive offers from two or more responsible VOSB or SDVOSB offerors and that award could be made at a fair and reasonable price that offers the best value to the government?

Answer

The Government performed market research when the requirement was initially sent to the SAC and once again when the requirement transferred to the NAC. Please see FAR Part 10 for more information.

7 General

The technical requirements that are listed seem to be outdated, primarily for the portable nebulizer.

There are newer technologies widely available today that deliver equal results that do meet the 52.225-5 Trade Agreements (OCT 2019)(19 U.S.C.

2501, et seq., 19 U.S.C. 33012 note). Is the Government open to receiving bids of these products?

Answer Yes. Absolutely interested in new better options if they are available and FDA approved.

8 Pricing

In regards to answer for question #8 in Amendment 0001, the Government has based this decision on market research, that if was conducted 3 or more months ago, is now outdated. The landscape of production and manufacturing changed drastically recently with much uncertainty on when it will begin to "normalize". Is the Government open to performing new market research?

Answer

The Government understands how challenging the current commercial marketplace is, especially in terms of supply chain management risks and constraints. To that end, the solicitation delivery requirements were amended via Amendment 0001.

The Government believes its market research efforts are current and relevant.

9 General The requirement for re-usable filters is unnecessary since the standard filters are reusable. Is this SLIN necessary?

Answer

Please see 2.4 REQUIREMENTS, Accessories/Supplies, #8 Non-Disposable (Handheld) Nebulizer Sets, page 11 and 46; first bullet point has been revised. Filter and Cap have been deleted. Disposable Filters (#9) and Non- Disposable Filters (#10) are manufacturer-dependent. If the manufacturer uses disposable they will need to list them or if they have re-usable they need to list them. IF they use both then they need to list both. If their devices don’t have to have any filters or if they don’t use them they need to state that or use N/A. It is machine dependent.
