1. Introduction:

The VA Denver Logistics Center (DLC) is a field office within the Department of Veterans Affairs, Office of Acquisitions and Logistics and the National Acquisition Center, located in Golden, CO. The DLC’s primary mission is to procure and distribute selected Prosthetic items for the Department of Veterans Affairs on a nationwide basis.

This performance work statement outlines the requirement for ASL services at the Department of Veterans Affairs (VA), Denver Logistics Center (DLC). According to Americans with Disabilities Act (ADA), the employer shall provide sign language interpreters or other effective means of communication for Hard of hearing/Deaf individuals. The ADA states that “no individual shall be discriminated against on the basis of disability in the full and equal enjoyment of the goods, services, facilities, privileges, advantages, or accommodation of any place of public accommodation by any person who owns, leases or leases to, or operates a place of public accommodation.”

Per 29 C.F.R. S1630.9 (a), A reasonable accommodation is a modification or adjustment to a job, the work environment, or the way things are usually done to enable a qualified individual with a disability to have an equal employment opportunity. The ADA requires reasonable accommodation:

-to ensure equal opportunity in the application process
-to enable an employee to perform an essential function of a job
-to allow an employee to enjoy equal benefits and privileges of employment.

Reasonable accommodations include telecommunication devices for the deaf, visual alarms, assistive listening systems, visible accommodations to communicate audible alarms and messages, and for deaf employees who rely on sign language, provision of qualified interpreter services. For some individuals and for some jobs, it may be necessary to have interpreter services available on a regular basis. For other employees or for job applicants, occasional interpreting on an as-needed basis may be enough. The ADA requires employers to make sure that deaf employees can communicate effectively when necessary. This includes special occasions, meetings, training, job evaluations and communication, concerning work, discipline or job benefits.

Additionally, 29 C.F.R. 1630.2 (o)(2)(ii) states that employers should consult with deaf employees about the type of accommodations that are needed in order to make its facilities and work environment accessible.

1.1 Objective: This contract will ensure the VA meets the requirements outlined by the ADA in providing personal interpreter services to accommodate VA staff.

2. Scope of Work: The DLC requires ASL interpreting services to ensure persons with a hearing or speech disability can communicate with, receive information from, and convey information to fellow employees.

The contractor shall provide certified interpreters who are current active members on the Registry of Interpreters for the Deaf (RID). Multiple interpreters may be needed to accommodate interpreting services for minimum three (3) hours up to a full 9-hour workday. A qualified certified interpreter means someone who can interpret effectively, accurately, and impartially, both receptively – understanding what the deaf person is saying and expressively – having the skill needed to convey information back to that person and using any necessary specialized vocabulary.

Interpreter shall conduct communication services between staff and provide briefings or reports of concern from communications.

2.2 Contractor Competency: All interpreters shall be RID certified and able to read, write, speak and understand English. Certifications will be provided to the Government upon request.

The local POC shall be available to meet face-to-face within three (3) hour of notification in the event of a required meeting, or emergency.

2.3.2 Non-Personal Services: This is a “Non-Personal Services” contract. The personnel rendering services are not subject, either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees. Contractor employees should only receive directions from the contractor’s supervisor other contractor managers. Communication from the VA Contracting Officer or Contracting Officer’s Representative (COR) should be directed thru the supervisor or key personnel, and not directly to the interpreters. Should any VA employee other than the COR or Contracting Officer (CO) ask or direct any Contract employee to deviate from established production requirements, priorities, or performance procedures and requirements, the Contractor employee will refer the matter to the COR or CO for resolution.

2.3.3 Key Personnel Substitutions: The Contractor may provide substitutions as long as the interpreter meets the specifications outlined in Paragraph 2.1.
