About this file

This document contains answers to technical questions related to a federal contract opportunity for the Kerrville EUL Due Diligence Support contract, Solicitation Number 36C77624Q0332, issued by the Department of Veterans Affairs (VA) Program Contracting Activity Central (PCAC).

The key details are:

  • The contract is a single, Firm-Fixed-Price contract for due diligence support, set aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSB).
  • The scope includes tasks such as Section 106 consultation, ALTA survey, Phase I and II environmental assessments, archaeology study, and appraisal.
  • The VA will allow vendors to provide separate pricing for the Section 106 consultation and the development of a Memorandum of Agreement (MOA) or Programmatic Agreement (PA).
  • The VA has removed the requirement for Hazardous Materials Testing and Other TBD Studies (CLIN 0013) from the Performance Work Statement.
  • The appraisal should describe existing conditions but value the parcel as if it has been remediated.
  • This is a new project, with no incumbent.

Attachment 1 – Answers to Technical Questions - 36C77624Q0332 – Kerrville EUL

1. Section 106 - In Attachment E, the scope states “If it is determined that the project will have an adverse effect on identified historic properties, then the vendor will assist VA in the development of appropriate mitigation measures (i.e. Memorandum of Agreement (MoA) or Programmatic Agreement (PA)) pursuant to internal discussions with VA as well as all support services for its eventual execution.”

Including the cost for development of an MoA or PA is going to have a significant impact on the budget. Additionally, the scope provided does not include all the steps that would accompany the development of an agreement document, such as meetings, consultation measures, etc.

Typically, VA has separated out the cost for the Section 106 consultation from the preliminary reporting – will VA allow vendors to provide two separate quotes, one for the Section 106 consultation and one for the MoA/PA and create a separate CLIN for MoA/PA as well as provide a statement of work?

ANSWER: Yes, VA will allow vendors to provide separate prices for the Section 106 consultation and an optional MOA/PA CLIN. See Attachment 2 – Revised Price Schedule – Kerrville EUL.

2. ALTA Survey - The Table A provided in the ALTA Survey Statement of work does not request item 1 – marking corners. Marking corners is necessary for this project because VA is creating a new boundary for the leased area. Please indicate whether VA would like corners marked in the survey, and if so, please provide an updated Table A indicating as such.

ANSWER: Yes, please place monuments at all major corners of the boundary of the property (check item 1 in Table A).

3. ALTA Survey - Table A, Item 15 is only applicable if a drone or aerials are used. Given that the subject site is only 3-acres a drone should not be required. Will VA review and consider striking this requirement from the Table A – it would be beneficial from the standpoint of cost to VA.

ANSWER: Yes, we can strike item 15 from Table A.

4. ALTA Survey - Please confirm that the 3-acre area to be surveyed in the map provided in the SOW is still vacant. Items 7a-c (buildings), 9 (parking spaces), and 10 (buildings that share a wall with a building offsite) would not be applicable if the site is vacant. Please confirm whether the site is vacant and provide an updated table A if required.

ANSWER: These items can be struck from Table A – the parcel is vacant.

5. Phase II ESA SOW - No statement of work is provided for the Phase II ESA work. Is VA requesting a blind quote for Phase II ESA work since this is an optional task?

ANSWER: Yes, an estimate for Phase II (if Phase I dictates a Phase II is required) is required.

6. Phase I Archaeology SOW - No statement of work is provided for the Phase I Archaeology work. Is VA requesting a blind quote for this work since this is an optional task?

ANSWER: Yes, requesting a blind quote for baseline archeological study if needed.

7. CLIN 0013 - No statement of work is provided for CLIN 0013. Will VA please provide a statement of work for this CLIN?

ANSWER: CLIN 0013 Hazardous Materials Testing and Other TBD Studies has been removed from Task 5 of the PWS. Please see Attachment 1 - Revised Performance Work Statement - Kerrville Due Diligence Support.

8. Hazardous Materials Review/Recommendations – Task 4 & 5 - Does VA anticipate any coordination with state or local environmental officials will be required for these tasks?

ANSWER: No.

9. Appraisal Report - Instructions under Paragraph 4 state that the appraiser should evaluate the land in a “clean” state with no known environmental contamination. However, the instructions under Paragraph 6 state that the appraisal report must contain a description of the existing conditions of the property to include any known environmental conditions. Which of these instructions should be controlling for the PWS?

ANSWER: The appraisal should describe existing conditions but for purposes of valuing the parcel, they can assume the land has been remediated.

10. NEPA EA - Does VA anticipate that support for a public meeting will be required?

ANSWER: No, we do not anticipate the NEPA will require a public meeting. It will just be published.

11. Is this a new project or is here an incumbent?

ANSWER: This is a new project. This project has not been awarded previously.
