Amendment 1 Question/Answers
1. Question: Are Site visits authorized and POCs for those?
Answer: Yes, please see attached Addendum Instructions to Quoters Amendment 0002 and Attachment 4 Site Visit Locations VISN 12.
1. Question: Is the GOV affirming that if a State requires the Prime Contractor/Accountable entity to be licensed – so that all elements in the Pharmaceutical Chain of Custody are licensed – specifically the GOV requires a Distribution License for those States (where a VAMC/CBOC reside)? Additionally, this is State Law for most of the States in the US (but no all). Lastly concerning this question, how is the GOV confirming that a vendor has the requisite license to distribute Medical Oxygen to VAMCs within those States that require licensing? Please note, the VAMC is not the end user.
Answer: IAW SOW Section 6 of the solicitation, contractors are only required to provide annual verification of their manufacturers’ current licensure, registration, or permits. It is the contractor’s responsibility to ensure that it maintains all federal, state, and local licensure per FDA requirements.
1. Question: Page 10 of 68 – Paragraph 7.1 Insurance Requirements: How is the GOV going to discern that the offeror is insured for NAICS 325120/221210 – the actual requirement for this work to comply with the RFQ, and not just the dollar values listed in the RFQ? Is this addressed on page 23 of 68, the operative work being “kind:” (a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract. Specifically – does this mean insured for NAICS 325120/221210?
Answer: Per the Statement of Work and C.6 Supplemental Insurance Requirements, quoters are required to carry general liability insurance in the amount of $1 million and provide a copy of this documentation with its quote.
1. Question: GFE Tanks only (none in VISN 12): How will the GOV pay for the NFPA Annual Maintenance described on Page 7 of 68 Para 3.3? Please note “Minor Maintenance” is a non-qualifying directive, as the Acquisition.GOV Glossary of Terms does not list the work “minor.” Please remove this requirement – In practical terms, a vendor must deploy the “on call” Technician to assess the situation, and make repairs – which often requires parts, and may involve an overnight stay. Please confirm that this is the GOV’s intent that the vendor repair GFE without a cost? Fitting, testing, deicing, alarm adjustments often required a third party to conduct, hence the Vendor should be providing a quote – especially deicing where the tanks the GOV identifies in the Schedule of Items could be undersized given the Pandemic response. Simply put, the GOV must pay a Small Business for fixing GFE equipment via an approved quote, and there are authorized CLINs on the RFQ SOI – CLIN AE (description: Deicing, Bulk Liquid Oxygen System Repair -- yet there are no GFE Tanks at the VISN 12 facilities) Please clarify. NOTE: The Contractor is responsible for ALL maintenance on Contractor Owned Tanks/Equipment.
Answer: VISN 12 does not have Government owned tank systems, however, Section 3-Government-Furnished Property has been included in the Statement of Work in the instance it intends to purchase tank systems in the future. The Government has added a line item to Attachment 2 Schedule Items 0002 for GFE Annual Inspection and Maintenance services. IAW Section 3 Government Furnished Property, subsection 3.4 minor maintenance includes validating that the fittings are securely fastened to the system, testing, minor deicing and adjusting alarms as required.
IAW the Statement of Work Section 3 Government Furnished Property, subsection 3.4 states in part, that in the event ice buildup occurs that cannot be remedied by the contractor during regular minor maintenance, the Contractor shall furnish the VA with a quote to remove ice buildup from the liquid bulk oxygen tank system. After the VA reviews and approves the quote, it may place a stand-alone order to authorize the work.
Question: Page 12 of 68 para 9.4 – what is the rationale for expecting the driver to convert 100/CCF to gallons on site? This can be done in the billing, yet the GOV CLINs in Attachment 1 for usage have a unit of measure of per 100/CCF (all CLINs)? This is explained in detail on page 14 of 68 of the RFQ. This is addressed again in B.3 Page 16 of 68 per 100/CCF – succinctly, what is the GOV’s requirement to have the driver convert their delivery clearly expressed in SCF/CCF and explained well in the RFQ? Again, a vendor is fully capable of billing in both units for visibility – as the UNIT of Measure (being billed) is per 100/CCF. This is addressed again on page 14 of 68 para 15.1.
Answer: The driver shall ensure that the conversion between gallons, ft³ (CF), and CCF quantity is accurate so that these numbers listed on the delivery slip will be consistent with the details on the resulting invoice in order to facilitate invoice certification.
1. Question: How does the GOV want the offeror vendor to affirm in writing, the 13 CFR 125.6 - LIMITATIONS ON SUBCONTRACTING (for services 50%) – as required by the revision last year? Is there a separate form provided by the GOV or should this be clearly stated in our offeror as per Page 28 of 68 para-C.11 (d) states: VAAR subpart 819.70 and SBA regulations on small business size and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting requirements in 13 CFR 121.406(b) and 125.6?
Answer: All quoters shall complete the attached clause 852.219-78 VA Notice of Limitations on Subcontracting—Certificate of Compliance for Supplies and Products. (See Attachment 3 Clause 852.219-78 that is being included)
1. Question: What is the GOVs due diligence for an offeror providing (7) year pricing that is significantly under the IGE, i.e., how can an offeror perform this work at such a reduced cost – especially given providing Bulk Liquid Oxygen, which is in high demand during the Pandemic?
Answer: During industry day the Government queried the commercial marketplace to determine if suppliers could provide pricing for 7 years. It was confirmed via those meetings that suppliers could provide pricing for up to 7 years.
1. Question: Page 6 of 68 Para 1.3 states the GOV POCs will be provided 20 days after award, can the GOV get these faster as transition coordination will begin immediately after award, please? This is especially confusing in that Page 15 of 68 Para 13 states: In the event that a declared National or State Emergency has been declared at the time of award the Contractor shall submit the written action plan and protocols to the Contracting Officer and COR within 48 hours of award notification.
Answer: The VA will make every effort to provide a list of CORs immediately upon award.
1. Question: Page 16 of 68 state the Contract ceiling of $3,000,000 for (8) VAMCs in VISN 12 (to include the VAMC Minneapolis). How did the GOV derive this estimate that over (7) Years ($3,000,000 / 7 = $428,571 per year further divided by 8 facilities per year = $53,571 per year. Can we please review the ceiling?
Answer: Minneapolis VAMC is not included in the VISN 12 acquisition. The Ceiling amount was derived from historical usage to include a buffer.
1. Question: Page 51 of 68 Paragraph b. - Can the GOV provide justification for using LPTA as it is discouraged by the GOV and requires Contract File inclusion? Comment: FAR Clause 15.101-2(c)(6) states “The contracting officer documents the contract file describing the circumstances that justify the use of lowest price technically acceptable source selection process.” FAR Clause 15.101-2(d) states “contracting officers shall avoid, to the maximum extent practicable, using the lowest price technically acceptable source selection in the case of a procurement that is predominantly for the acquisition” of certain products/services of which “health care services and records” is identified in 15.101-2(d)(1). We respect the Contracting Authority’s range of Solicitation Options. However, the FAR Cite in these questions also requires the Contracting Officer document the circumstances for using LPTA – please identify those circumstances.
Answer: This procurement is being conducted under FAR 13, therefore, 15.101-2(c)(6) is not required. VA has clearly described its minimum requirements and would not realize value from a quote that exceeds them. The agency believes that quotes will require little subjective judgement by the SSA as to the desirability of one quote over another. We do not therefore believe that quoters could provide added value or benefit that would justify a tradeoff. We have determined that the lowest price reflects the total cost of the supply being acquired.
1. Question: Can you explain the GOV’s rationale why Recent, and Relevant Past Performance is not an evaluation Metric? Managing a VISN Level (8 VAMCs) critical Bulk Liquid Oxygen supply during a pandemic, to include emergency orders, tanks upgrades/transitions is a complex task. Please confirm the Contracting Officer is the sole determinant via “Responsibility Matters” which 52.209-5 and/or FAR.209-7 - (Administrative, have they paid their taxes, are they convicted of crimes)? Furthermore – the revised FAR Clause 15.304(c)(3)(iii) states “Past performance need not be evaluated if the contracting officer documents the reason past performance is not an appropriate evaluation factor for the acquisition.” Please explain the GOV’s rationale of bridging an SDVOB offeror’s ability to perform at VISN Level in respect to FAR 15.304 and FAR 209-7 (page 49 of 68 of the RFQ)? Our questions are relevant because the GOV’s rationale must be documented in the Contract File as per: “Pursuant to the guidelines identified in FAR Clause 15.101-2 (b)(1) which states, “If the contracting officer documents the file pursuant to 15.304(c)(3)(iii), past performance need not be an evaluation factor in lowest price technically acceptable source selections.”
Respectfully, our question specifically asks for the GOV’s rationale for evaluating this complex requirement without requiring Recent and Relevant Past Performance when the Awarded SDVOB is the accountable entity to the GOV and is required to meet FAR 52.219-4 LIMITATIONS ON SUBCONTRACTING. The GOV’s rationale is required for inclusion into the Contract File?
Answer: This procurement is being conducted in accordance with FAR 13.106; Although past performance is not a separate evaluation factor for this procurement, past performance will be reviewed as part of the Contracting Officer’s responsibility of determination.
1. Question: Requests that VA provide bulk oxygen volumes/quantities for each location.
Answer: See Attachment 2 Schedule of Items 0002.
1. Question: 4.3 States that Column E shows minimum need. Please clarify the maximum previous need, required to contemplate our offer and accurately size the systems. In addition, for each location, the Pricing Schedule states "Facility SQ Footage" Please provide a detailed description of this section for each of the locations. If the below-listed number is oxygen, for example, is it per month or per year? The number of beds using oxygen is not static, therefore, as written, the solicitation does not allow for non-incumbent vendor(s) enough data on the requirements. Detailed usage/flow rate information and annual total historical usage for 2019, 2020, 2021, to ensure (especially due to Covid heightened usage) that the incoming supplier has accurate data to properly design and engineer safe and efficient systems with the correct tank capacities and associated vaporizers and equipment.
Answer: See Schedule of Items, Column J- Estimated quantities of the solicitation; these estimated quantities are based on annual average usage from 2019 and 2020, which accounts for fluctuations during COVID-19. Therefore, there is no minimum or maximum usage, only the estimates provided in the Schedule. On the Schedule, each facility’s square footage, tank sizes, fill point and the number of beds that utilize bulk liquid oxygen have also been included on the Schedule. The Government has included Attachment 5 Annual 2019_2020 Usage VISN 12.
Question: Please confirm the expected installation time frame and requests the VA’s consideration to allow our sub-contractor, Airgas, Inc., a minimum of 120 days lead time prior to implementation Answer: In coordination with the using facility and the incumbent contractor, contractor-furnished bulk tank systems must be installed, connected, and fully functional within one-hundred twenty (120) days of the effective date of the contract.
1. Question: 3.4 states that Government-owned equipment should be maintained by the vendor. Requests the VA’s consideration to add a line item for Preventative Maintenance Fee (Field Service Technician’s labor hours). The line item would be for a monthly Preventative Maintenance Fee as this charge should remain separate from the bulk oxygen product price. An additional/separate line item for Field Service Technician hours also should be considered as this would apply for any repairs that are performed during regular business hours, M-F.
Answer: See Attachment 2 Schedule of Items 0002, the Government has added a line item for GFE Annual Inspection and Maintenance services.
1. Question: 9.3 states we need to fill to maximum capacity. This can be accomplished as a general rule; however, there is a potential for the supplier to not be able to accommodate the exact maximum on every delivery. Please confirm that this is the VA’s understanding Answer: Government understands that there may be instances where the supplier is unable to accommodate maximum fills on every delivery, however, the contractor will make every effort to ensure that fills are at maximum capacity.
1. Question: B.3 states fixed price for the term. Please confirm that this is a firm fixed-price contract with the ability to adjust pricing for each of the option years Answer: This is a fixed price requirement as specified in section B.3. There are no option years for this acquisition; See Attachment (2) Schedule of Items 0002; quoters will provide pricing for each facility and ordering period. It is at the quoters discretion how it intends to price those ordering periods.
