AWARD, EVALUATION FACTORS AND OFFEROR SUBMISSION

AWARD

The Government intends to make a single firm-fixed-price award to the responsible offeror whose proposal is determined to be acceptable under all non-price factors and offers the lowest evaluated price. The Government reserves the right to make a single award for the base requirement and to exercise any or all option contract line-item numbers (CLINs) at the time of award. The decision to exercise options at award will be based on the availability of funds and the best interest of the Government. Additionally, the Government reserves the right to exercise one or more option CLINs after award at any time within the option period specified in the contract, subject to the availability of funds and in accordance with applicable contract clauses.

EVALUATION FACTORS

For evaluation purposes, factors are divided into price and non-price factors. Price will be evaluated separately from the non-price factors. The total evaluated price will include the base requirement and all option CLINs. The non-price factors will be evaluated on an acceptability (pass/fail) basis. Only proposals determined acceptable under all non-price factors will be eligible for award consideration based on price.

Factor 1: Price Factor 2: Technical Qualifications of Proposed Staffing Factor 3: Past Performance

FACTOR 1: PRICE

Evaluation:

The total evaluated price will include the base requirement and all options. Price analysis techniques contained in the Department of Veterans Affairs Class Deviation implementing the RFO for FAR Part 15, under which the price analysis procedures formerly found at FAR 15.404-1(b) are incorporated into the deviated FAR Part 15 text adopted by VA will be used to determine the reasonableness of total evaluated price to support the Lowest Price Technically Acceptable offer.

Offeror Submission Requirements:

Offerors shall submit a completed Pricing Schedule (Attachment 1) to include all option CLINs. Failure to provide a completed Pricing Schedule (base and option CLINs) may may render the proposal ineligible for award.

FACTOR 2: TECHNICAL QUALIFICATION OF PROPOSED KEY PERSONNEL

The Government will evaluate the qualifications of proposed personnel to determine whether the offeror demonstrates the capability to perform the required roles for this project. The Government will not assign strengths or weaknesses or conduct comparative analysis under this factor. Key personnel are those individuals whose qualifications, experience, and expertise are considered essential to successful contract performance and whose proposed capabilities are evaluated as part of the source selection. Persons evaluated under Factor 2 will be designated as Key Personnel in the resulting contract and will be subject to substitution restrictions.

Offerors shall submit the following as part of their proposal:

1. Identification of Key Personnel that will perform in the following roles:

• Project Management

• Quality Control

• Safety Compliance

For purposes of this evaluation, the following role descriptions apply:

Project Management:

Responsible for overall planning, coordination, scheduling, and execution of the construction work, including management of subcontractors, cost control, schedule adherence, and communication with the Government.

Quality Control:

Responsible for implementation and oversight of the Contractor Quality Control (CQC) program, including inspections, testing coordination, documentation, and ensuring all work complies with contract requirements, plans, and specifications.

Safety Compliance:

Responsible for oversight of site safety and health requirements, including implementation of the project safety plan, hazard identification and mitigation, OSHA compliance, and enforcement of safety procedures for all on-site personnel.

2. A brief resume for each identified Key Personnel shall be submitted. Each resume must clearly demonstrate that the individual meets the minimum qualification requirements below. Failure to demonstrate any required minimum qualification will result in a rating of Unacceptable under this factor.

Minimum Qualification Requirements:

Project Manager:

• At least five (5) years of experience supervising commercial, industrial, or federal construction projects

• Experience serving as a Project Manager or Superintendent on at least one

(1) construction project with a contract value of $2,000,000 or greater

Quality Control (QC) Manager:

• Current USACE Construction Quality Management (CQM) certification

• At least three (3) years of QC experience on commercial, industrial, or federal construction projects

Safety (SSHO):

• OSHA 30-hour Construction certification

• At least three (3) years of construction safety management experience

Each individual must demonstrate experience performing the specific role proposed.

FACTOR 3: PAST PERFORMANCE

Past Performance will be evaluated on an Acceptable / Unacceptable / Neutral

(Acceptable) basis. To receive a rating of Acceptable, the offeror must submit at least two (2) completed construction projects performed as the prime contractor that meet all recency and relevancy requirements identified below.

Failure to submit the required number of projects, or failure of submitted projects to meet recency and relevancy requirements, will result in a rating of

Unacceptable.

The Government will not assign strengths or weaknesses, compare offerors, or conduct tradeoff analysis. The evaluation is limited to determining whether the offeror has demonstrated a reasonable expectation of successful performance.

Recency Requirement

Projects must:

• Be 100% physically complete

• Have been completed within seven (7) years prior to the date of proposal submission

Projects not meeting both requirements will not be evaluated.

Relevancy Requirements

To be considered relevant, a project must meet all of the following:

• Magnitude: Final contract value of $2,000,000 or greater

• Scope: Construction work involving building system repairs, renovations, or infrastructure improvements

• Complexity: Work performed in an operational or occupied facility requiring coordination to maintain ongoing operations

Projects that do not meet all three relevancy requirements will not be considered.

Neutral Rating

If an offeror has no record of relevant past performance, or if information is unavailable, the offeror will receive a Neutral rating, which will be considered Acceptable.

Offerors shall submit past performance information using the Government-provided Past Performance Summary Sheet (Attachment X).

Provide one summary sheet for each project submitted. All fields must be completed. The Government will evaluate only the information contained within the summary sheet. Failure to provide sufficient information to determine recency and relevancy will result in the project not being considered.

Failure to submit the required number of projects meeting the recency and relevancy requirements will result in a rating of Unacceptable under this factor.

The Government is not required to review or consider extraneous materials submitted outside of the summary sheet.

Instructions to complete the fields follow:

Project Title

Provide the official name of the project or contract.

Project Location

Provide the city and state where the construction work was performed.

Awarding Entity

Provide the full name of the Government agency or commercial owner for whom the work was performed.

Name

Title

Phone number

Email address

The Government reserves the right to contact references for verification or additional information.

Contract Number (if applicable)

Provide the contract or project number assigned by the awarding entity.

Prime Contractor Role

Describe the offeror’s role as the prime contractor, including the approximate percentage of work self-performed and the overall management responsibilities performed.

Subcontractors

Provide the approximate number of subcontractors managed on the project to include specific trades subcontracted (e.g., electrical, plumbing, fire protection). For purposes of this field, the number of subcontractors managed refers to the number of subcontracting firms or companies under contract, not individual personnel or workers.

Project Description

Briefly describe the construction work performed, including major systems or facility types involved. The project description shall include any staging or phasing requirements, such as work in occupied facilities, sequencing constraints, or coordination needed to maintain operations during construction.

Relevancy to This Project

Actual Completion Date

Provide the date the project was physically completed.

Contract Modifications (General Nature)

Provide a brief explanation of the general causes of modifications (e.g., owner-directed changes, differing site conditions, design revisions). Do not list each modification individually.

DESCRIPTION OF EVALUATION PROCEDURES

Evaluations will be conducted pursuant to Lowest Price Technically Acceptable

(LPTA) procedures conducted pursuant to the Department of Veterans Affairs Class

Deviation implementing the RFO for FAR Part 15, under which the procedures formerly located at FAR 15.101-2 are now located at FAR 15.103-2 in the deviated

FAR text adopted by VA. The Government intends to award without discussions.

The lowest priced offer will be evaluated for price reasonableness using techniques described in the Department of Veterans Affairs Class Deviation implementing the

RFO for FAR Part 15, under which the price analysis procedures formerly found at

FAR 15.404-1(b) are incorporated into the deviated FAR Part 15 text adopted by VA.

If deemed reasonable, this offer will be evaluated under Factor 2 and 3 per procedures listed below.

Proposals will first be ranked by total evaluated price from lowest to highest. The proposal with the lowest evaluated price will then be evaluated for acceptability under the non-price factors. If the proposal is determined to be acceptable under all non-price factors, the Government intends to make an award to that offeror. If the proposal is determined to be unacceptable under any non-price factor, the next lowest-priced proposal will be evaluated, and this process will continue until a proposal is found acceptable.

RATING SYSTEM

Factor 1, Price:

Factor 1 will not be assigned an adjectival or pass/fail rating. Price proposals will be evaluated for completeness, reasonableness, and balance. For purposes of award under the LPTA process, proposals will be ranked in order of total evaluated price.

The total evaluated price will include the base requirement and all options.

Factor 2, Technical Qualifications of Proposed Staffing:

Factor 2 will be evaluated on an acceptability basis (pass/fail) using the adjectival ratings defined below.

Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

Factor 3, Past Performance:

Factor 3 will be evaluated on an acceptability basis (pass/fail) using the adjectival ratings defined below.

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

(See Note 1 below)

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Note 1: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so limited that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)).

Therefore, the offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered "acceptable."

Note 2: The Government will review available past performance data in the

CONTRACTOR

PERFORMANCE ASSESSMENT REPORTING SYSTEM (CPARS); however, the

Government reserves the right to obtain past performance information from any available source and may contact customers other than those identified by the offeror when evaluating past performance.
