About this file
This is a Solicitation Amendment (SF 30) issued by the Department of Veterans Affairs Network Contracting Office 23 (Fargo, North Dakota) for the Legionella Sample Testing Services solicitation number 36C26326R0042. The amendment responds to vendor questions and provides clarifications on key contract requirements. The current incumbent contractor is Hyperion Biotechnology, Inc. under contract number 36C26321P0382.
The amendment clarifies three critical points for prospective offerors: (1) the 24-hour response requirement for non-routine sampling following positive Legionella results is firm and cannot be extended to 48 hours due to the health and safety implications of positive samples requiring immediate resampling; (2) the prime contractor does not need to be an accredited testing laboratory but must subcontract with a laboratory that holds proper accreditation to process samples; and (3) the VA cannot disclose the total contract award amount for the incumbent contract, though the incumbent contractor information is provided for reference. Offerors must acknowledge receipt of this amendment prior to the solicitation deadline by completing and returning copies of the amendment, acknowledging receipt on offer copies, or submitting separate written communication referencing both the solicitation and amendment numbers.

Vendor Questions in Bold/VA Responses to Vendor Questions in Red
1. (Page 11) The solicitation states “For non-routine sampling, the contractor must be able to sample within 24 hours of being notified of the need to sample”. Respectfully request extending that deadline to at least 48 hours to account for possible logistical issues in getting to the site.
A non-routine sample would only be done if there is a sample that is positive for Legionella, the VA must ensure it is resampled as soon as possible. 24 hours is a reasonable amount of time for this task.
2. We would appreciate clarification on whether the prime contractor must be an accredited testing laboratory, or whether subcontracting with a certified laboratory is permissible under the forthcoming solicitation.
The testing laboratory processing the samples must have the accreditation. The prime contractor does not have to be accredited as long as the testing laboratory they are subcontracting to is accredited.
3. Is there a current incumbent performing this service? May we be provided with the contract number or total contract award amount?
The current incumbent performing this service is Hyperion Biotechnology, Inc and the contract number is 36C26321P0382.
No, we can’t provide the total contract award amount.
