About this file

This is a Single Source Justification document for a federal contract award under simplified acquisition procedures. The Department of Veterans Affairs, Network Contracting Office 23 (NCO23), Construction Team 2, is seeking to award a sole source contract to Gardner Structures for emergency repair and replacement of a 6-inch Post Indicator Valve (PIV) feeding the fire sprinkler system in Building #5 at the Hot Springs VA Medical Center (VAMC) in Hot Springs, South Dakota. The estimated project cost is $68,289.00, which falls over the micro-purchase threshold but does not exceed the simplified acquisition threshold.

The requirement involves excavating and replacing approximately 2 feet of underground piping located 10 feet below ground in a grassy yard. The vendor must remove all materials necessary for access (including concrete, asphalt, dirt, and damaged piping), provide proper backfill material with compaction, and install NSF-classified piping rated for pressures exceeding 250 psi. The justification cites urgent and compelling circumstances, as Building #5 houses domiciliary patients, a staff cantina, and VA personnel, and the fire sprinkler system may be non-functional or improperly functioning without this repair. Gardner Structures is identified as the sole contractor capable of meeting immediate response requirements due to prior involvement in water line replacement work at the facility and knowledge of the facility's water systems. Market research was minimal due to urgency; an SBA Small Business Search identified no local Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) capable of immediate response. Gardner Structures is identified as a Native American-Owned Small Business located locally. The Contracting Officer, Michael B. Warrick of NCO23, certified the justification on 9 February 2026 in accordance with FAR 13.106-1(b).

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for MPT up to SAT

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the Simplified Acquisition Threshold

Acquisition Plan Action ID: 36C263-26-AP-2067

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 23

(NCO23), Construction Team 2 is responsible for this action. The requesting activity is VISN 23, VA Black Hills Health Care System (VABHHCS) at the Hot Springs VA Medical Center (VAMC), Facilities Management Engineering Department, 500 North, Fifth Street, Hot Springs, SD 57747.

Purchase Request Number (2237): 568-26-2-9951-0006

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: VABHHCS has a urgent and compelling (emergent) need for repair and replace a 6-inch Post Indicator Valve (PIV) feeding the fire sprinkler system in Building #5. The repair will be made with similar piping rated for pressures greater than 250 psi. The new piping will be classified by the National Sanitation Foundation (NSF) for use in potable water. The required repair is estimated to be located 10 feet underground located in the middle of a grassy yard. The vendor will be responsible for the removal of all and any materials that are required for access to the damage pipe. The removal of such material will be included but not be limited to concrete, asphalt, dirt, and damage piping. It is estimated that approximately 2 feet of pipe associated with the PIV will need to be replaced. After the damage pipe has been exposed and removed and prior to the new PIV installed the vendor will provide the proper backfill material to fill in any voids that occurred during the break of the water main. The back fill material will be compacted into place to support the new piping to be installed. The vendor will then install the new piping/PIV and proceed to back fill the trench compacting continuously. The estimated cost of this project is $68,289.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Due to the urgent and compelling (emergent) matter of this need, competition for pricing for this requirement was unable to be completed.

Building #5 at the Hot Springs VAMC houses one (1) floors of domiciliary patients, the Cantina (Mini Shopette), and VA staff members. Due to the 6-inch Post Indicator Valve (PIV) feeding the fire sprinkler system in Building #5 the buildings fire sprinkler system may not work at all or perhaps properly function.

The work to repair and/or replace the 6-inch Post Indicator Valve (PIV) feeding the fire sprinkler system in Building #5 needs to be performed is critical to ensure it functions during an emergency, protecting lives and property from fire damage; therefore, a sole source requirement is in the best interest of the Government to be able to make an award to a contractor who can meet the immediate need of services associated with this requirement, and who has the knowledge of the Hot Springs VAMC and its water line systems involved.

It is in the Government’s best interest to award a sole source contract to a vendor that can respond immediately at a fair and reasonable price. Gardner Structures is the only https://www.acquisition.gov/?q=/browse/far/13

Revision: 02 Effective Date: 12/30/2025 Page 2 of 2 Acquisition ID# 36C263-26-AP-2067 contractor found that can meet all of these needs under this urgent and compelling requirement.

4. Description of market research conducted and results or statement why it was not conducted: Minimal market research was conducted due to urgency of this requirement. A SBA Small Business Search (SBA SBS) query was conducted for a local SDVOSB that would have the capability to respond to this requirement immediately. While SBA SBS shows that there are SDVOSB’s under the appropriate NAICS, none are local to the remote location of Hot Springs, SD. Given these results, there is not two or more SDVOSBs or VOSBs capable of performing the work, and/or likely to submit an offer/quote at a fair and reasonable price that offers best value to the Government.

As stated previously, immediate action needed to be taken by a contractor. The selected contractor has been involved in other domestic water line replacement on the Hot Springs VAMC campus and they have knowledge of the facilities water line system. Additional market research was conducted to ensuring that Gardner Structures, who is a Native American Owned Small Business located in Hot Springs, SD as to their availability to an immediate response. Gardner Structures confirmed that they would be able to start work without delay.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR 13.106-

1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
