About this file
This is a Notice of Intent to Sole Source document for HemoSphere 360 Light Protection Service Plan for cardiac output monitors at the Minneapolis VA Medical Center. The VA intends to award a sole source, firm-fixed-price contract to Edwards Lifesciences LLC under FAR 13.106-1.
The requirement covers 18 HemoSphere Cardiac Monitors that need ClearSight module servicing/replacement by December 2024 to maintain Joint Commission compliance. Edwards Lifesciences LLC is identified as the only source due to proprietary equipment and service requirements. The service plan includes ClearSight module preventative maintenance, expired heart reference sensor replacement, Total Protection Warranty, bug fixes/patches, parts/labor/shipping, and 24/7/365 technical support. Capability statements from interested vendors must be submitted by December 10, 2024, at 12:00 PM Central Time to Alisha Milander at Alisha.Milander@va.gov. Market research found no eligible SD/VOSBs capable of providing these proprietary services. The opportunity falls under NAICS code 811210 and PSC J065.

DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
1. Contracting Activity: Department of Veterans Affairs, Network 23 Contracting Office, 316 Robert St N, Ste 506, St. Paul, MN 55101 Requesting Activity: Minneapolis VA Medical Center, One Veterans Drive, Minneapolis, MN 55417
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The Minneapolis VA Medical Center (VAMC) has 18 HemoSphere Cardiac Monitors that are almost two years old. Each of these units has a ClearSight module within them that is required to be serviced/replaced every two years, so they must be serviced/replaced in December 2024 to remain in compliance with the Joint Commission standards.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
This equipment is proprietary to Edwards Lifesciences LLC. Only an Edwards Lifesciences LLC engineer/technician can service the ClearSight module per the sole source letter that was provided by the vendor. These modules are removed and sent back to the vendor, who sends new or refurbished replacements to replace them. Although the service/replacement of these modules can be purchased as a single service line item, the cost for servicing/replacing each ClearSight module is the exact same as purchasing a one-year HemoSphere 360 Light Protection Service Plan for each HemoSphere Cardiac Output Monitor unit. That will not only include the ClearSight module preventative maintenance of servicing/replacing these modules, but will also cover any expired heart reference sensors (EVHRS) of which all ours are due for replacement, provides a Total Protection Warranty for the year, provides bug fixes/patches/performance optimization, covers all parts/labor/shipping costs, provides 24/7/365 technical and product phone support, etc.
4. Description of market research conducted and results or statement why it was not conducted:
VetCert was searched using NAICS 811210 – 315 SD/VOSBs were identified. DSBS was searched using 811210 – 122 VOSBs and 500 SDVOSBs were identified. The manufacturer of the HemoSphere Cardiac Monitors, Edwards Lifesciences LLC, was contacted and provided a sole source letter. Edwards Lifesciences LLC is the sole provider of the Edwards’ HemoSphere monitors and its components, including ClearSight modules. All repairs and software upgrades are to be performed only by an Edwards' service engineer/technician at an authorized service center. No other parties can service Edwards' advanced monitoring platforms, including the ClearSight Module. National contracts were searched with no results found, and the vendor confirmed that they do not have any national contracts that include the HemoSphere 360 Light Protection Service Plan or solely the replacement/servicing of the ClearSight modules. There are not two or more SD/VOSBs capable of providing the requested services at the Minneapolis VA Medical Center due to the proprietary nature of the equipment. Neither the VA Rule of Two nor the SBA rule of two can be met. A sole source contract will be awarded to Edwards Lifesciences LLC to meet the needs of this requirement.
