About this file
This document contains a justification for a sole source award and a presolicitation notice for pest control services at the Minneapolis VA Medical Center. The Department of Veterans Affairs intends to award a sole source, firm fixed price contract to Adam's Pest Control of Hamel, MN for a base year plus four option years to provide emergent and recurring pest control and eradication services using heat treatment and K9 inspection. The justification cites Adam's as the only responsible vendor in Minnesota that can meet the medical center's needs for emergency response within four hours and trained K9 inspection. Interested parties may submit capability statements by November 20, 2023 to be considered, but the sole source award to the incumbent is within the agency's discretion.

Acquisition Plan Action ID: 36C263-24-AP-4465
1. Contracting Activity: Department of Veterans Affairs, Network 23 Contracting Office (NCO23), 4801 Veterans Drive, St. Cloud, MN 56303
Organizational Activity: Minneapolis VA Health Care System, One Veterans Drive, Minneapolis, MN 55417
2. Nature and/or Description of the Action Being Processed: Emergent and reoccurring pest control and eradication services, heat treatment only – no chemicals to be used, K9 Pest control services for the medical facility, reoccurring varmit and insect pest control.
Term: Base + 4 Option Periods
3. Description of Supplies/Services Required to Meet the Agency’s Needs: Emergent and reoccurring pest control and eradication services, heat treatment only – no chemicals to be used, K9 Pest control services for the medical facility, reoccurring varmit and insect pest control.
4. Statutory Authority Permitting Other than Full and Open Competition:
| ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy | |
| Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1; |
(i) Supplies or services may be considered to be available from only one source if the source has submitted an unsolicited research proposal that-
(A) Demonstrates a unique and innovative concept (see definition at 2.101), or, demonstrates a unique capability of the source to provide the particular research services proposed;
(B) Offers a concept or services not otherwise available to the Government; and
(C) Does not resemble the substance of a pending competitive acquisition. (See 10 U.S.C. 3204(b)(A) and 41 U.S.C. 3304(b)(1).)
| ( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2; | |
| ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability | |
| or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3; | |
| ( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4 | |
| ( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5; | |
| ( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6; | |
| ( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7; |
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Adam’s Pest Control is the only found responsible vendor within the state of Minnesota that possesses a K9 trained pest inspector as well as the ability to meet the emergency timeframe of reporting within 4 hours of an emergency request to the Minneapolis VA Medical Center.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The above described has been solicited several times within the last year ~ SAM Postings #36C26322Q0727, 36C26323Q0592, 36C26323Q0354, 36C26323Q0520
In these solicitations/award there have been several issues; performance issues with previous awarded contracts, protests with changing market research and an unstable market (employment, local service offerings, changes in business operations), inability to determine fair and reasonable pricing, and inability to determine responsibility in interested vendors. Pest control has been deemed an inherent medical center function and a crucial service provided to the Minneapolis VA to operate per Federal regulations. These aforementioned challenges can no longer delay a long term contracted need for the facility.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Adam’s Pest Control has been providing pest eradication services to the MPLS VA in the interim while working on an established long term contract. They are still priced fair and reasonable by under half of the proposed/quoted costs throughout the several solicitations this procurement has underwent.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research has been conducted several times within the last 16 months to procure a long term contract. At each time, the industry responds with differentiating results. There is a gap in what the industry can provide against the Minneapolis VA’s specific requirements.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A
10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Annually review the needs of the facility against the market. Will assess if this contract is in the best interest of the Government at a fair and reasonable price at an annual interval.
11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
