Questions, Answers, and Clarif ication
1. Responsive quotes must include a completed, signed C.8 VAAR 852.219-75 VA
NOTICE OF LIMITATIONS ON SUBCONTRACTING – CERTIFICATE OF
COMPLIANCE FOR SERVICES AND CONSTRUCTION.
2. The following information is to be provided with each quote and will be used to evaluate quotes to determine technical acceptability.
a. Curriculum Vitae (CV)
b. Copies of degrees, licenses, board certif ications
c. Copy of current BLS and ACLS
d. A minimum of 2 years of post-graduate experience
e. Experience in various types of surgical cases, including colo-rectal surgery, general surgery, neurosurgery, Ophthalmology, orthopedic surgery, otoaryngology, podiatry, plastic surgery, urology and vascular surgery
FAILURE TO SUBMIT ANY OF THE REQUIRED INFORMATION, STATEMENTS,
OR CERTIFICATIONS MAY RESULT IN REJECTION OF THE QUOTE WITHOUT
FURTHER CONSIDERATION FOR AWARD.
3. Paragraph 2.9.1 is hereby changed to correct the holiday call coverage hours. The paragraph shall now be, “The VA Full Time Equivalency (FTE) for the services required is (1.0) FTE or 2,080 hours. Offsite Call Coverage (carrying pager) is 624 hours. Holiday Call coverage (carrying pager) is 96 hours. Onsite Call Back coverage is 336 hours.
4. Must a company be an SDVOSB to submit a quote?
Answer: Offerors must be a verif ied SDVOSB upon submission of a quote.
5. Are there any incumbents or is this a new solicitation?
Answer: Procurement history can be researched at fpds.gov.
6. There are not a lot of pager hours on the contract, can you elaborate on what the anticipated call schedule will be?
Answer: See B.2.3 VA Hours of Operation/Scheduling.
7. Approximately how many cases will the Anesthesiologist see each day?
Answer: Approximately 5 to 10 per day.
8. Are there any hearts or heads cases the Anesthesiologist will see?
Answer: Yes
9. Would the VA entertain a CRNA or Anesthesiologist or just Anesthesiologist?
Answer: See section B.2.2 Qualif ications of the Solicitation for the qualif ication requirements.
10. How many total Anesthesiologists are in the department now?
Answer: 11
11. How many total CRNAs are in the department now?
Answer: 28
12. How many CRNAs and/or Anesthesiologists equal a fully staffed department?
Answer: The Minneapolis VA Health Care System currently follows the Medical Direction for CRNA Supervision.
13. Between how many anesthesia providers (CRNAs and/or Anesthesiologists) is called shared?
Answer: CRNAs and Anesthesiologist have separate call schedules. All Anesthesiologists rotate to cover the call time.
14. Is there a secondary On-Call person (CRNA or Anesthesiologist) that the primary On- Call person can summon should the patient’s condition warrant it?
Answer: Yes
15. What are the historic call-back rates when an anesthesia provider is on-call (i.e. the amount of times and/or hours the provider is called back, not the dollar rate)?
Answer: The expected 336 on-site call back hours are based on historic use.
16. (Section 4.5.1.1.1) Can the Government clarify what types of Cardiac Surgery (i.e. open heart surgery, CABG, stent placements, etc.)?
Answer: The Minneapolis VA Health Care System cardiovascular and thoracic team performs a wide range of surgeries on heart, lungs and esophagus, e.g. surgeries include angioplasty, stents, ablation, open heart, CABS and value repair and replacements.
17. Section 1.1.1. mentions an Anesthesiology residency. Section 4.3 says EDUCATION AND SUPERVISION OF HEALTH PROFESSIONS TRAINEES (HPTS): N/A. Can the Government clarify if there is an Anesthesiology or CRNA residency in the anesthesia department at this facility?
Answer: Yes, the Minneapolis VA Health Care System has an anesthesiology residency program and an SNRA training program.
18. Section 2.1.8.6. COVID-19 states Contractors shall comply with VHA Supplemental Contract Requirements for Combatting COVID-19. Can the Government clarify if mandatory Covid vaccination is currently required for this position? If Covid-19 vaccination is a requirement, will the Government accept an Anesthesiologist with medical or religious exemptions?
Answer: The Minneapolis VA Health Care System does have a COVID vaccine policy which requires documentation of COVID vaccine or a recognized exemption. The policy does allow for a religious exemption.
19. E.11 52.212-2, page 83, says to submit a full candidate profile with the quote. Will the Government consider not requiring full candidate profiles with the quote?
Answer: The information requested in E.11 52.212-2 is required to evaluate the offers to ensure the Government awards to a qualif ied contractor.
20. B.3. Can the Government confirm this is just for a base year contract with no option years besides 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)?
Answer: The period of performance is 03/31/2024 to 03/30/2025 with 52.217-8 as the only option to extend services.
C.8 VAAR 852.219-75 VA NOTICE OF LIMITATIONS ON
SUBCONTRACTING—CERTIFICATE OF COMPLIANCE FOR SERVICES AND
CONSTRUCTION (JAN 2023) (DEVIATION)
(a) Pursuant to 38 U.S.C. 8127(l)(2), the offeror certif ies that—
(1) If awarded a contract (see FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:
(i) [X] Services. In the case of a contract for services (except construction), the contractor will not pay more than 50% of the amount paid by the government to it to firms that are not certif ied SDVOSBs listed in the SBA certif ication database as set forth in 852.219–73 or certif ied VOSBs listed in the SBA certif ication database as set forth in 852.219–74. Any work that a similarly situated certif ied SDVOSB/VOSB subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded. Other direct costs may be excluded to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service as set forth in 13 CFR 125.6.
(ii) [] General construction. In the case of a contract for general construction, the contractor will not pay more than 85% of the amount paid by the government to it to firms that are not certif ied SDVOSBs listed in the SBA certif ication database as set forth in 852.219–73 or certif ied VOSBs listed in the SBA certif ication database as set forth in 852.219–74. Any work that a similarly situated certif ied SDVOSB/VOSB subcontractor further subcontracts will count towards the 85% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.
(iii) [] Special trade construction contractors. In the case of a contract for special trade contractors, the contractor will not pay more than 75% of the amount paid by the government to it to firms that are not certif ied SDVOSBs listed in the SBA certif ication database as set forth in 852.219–73 or certified VOSBs listed in the SBA certif ication database as set forth in 852.219–
74. Any work that a similarly situated certif ied SDVOSB/VOSB subcontractor further subcontracts will count towards the 75% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.
(2) The offeror acknowledges that this certif ication concerns a matter within the jurisdiction of an Agency of the United States. The offeror further acknowledges that this certif ication is subject to Title 18, United States Code, Section 1001, and, as such, a false, f ictitious, or fraudulent certif ication may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.
(3) If VA determines that an SDVOSB/ VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:
(i) Referral to the VA Suspension and Debarment Committee;
(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and
(iii) Prosecution for violating 18 U.S.C. 1001.
(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract. Contracting officers may, at their discretion, require the contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the contracting officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.
(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance with the limitations on subcontracting requirement. The offeror understands that failure to provide documents as requested by VA may result in remedial action as the Government deems appropriate.
(d) Offeror completed certification/fill-in required. The formal certif ication must be completed, signed and returned with the offeror’s bid, quotation, or proposal. The Government will not consider offers for award from offerors that do not provide the certif ication, and all such responses will be deemed ineligible for evaluation and award.
