About this file

This document is a Single Source Justification under the Simplified Acquisition Procedures for a Department of Veterans Affairs contract to provide Community Based Outpatient Clinic (CBOC) services in Winner, South Dakota. The contract will be a six-month award from September 1, 2024, to February 28, 2025, with an estimated cost of $189,726.00. Due to the lack of capable vendors identified through market research for the follow-on long-term contract, the incumbent is needed to continue services while the two identified SDVOSB vendors complete their build-out. This short-term award will be made to Avera McKennan for $203,000.64 on August 23, 2024, under Solicitation Number 36C26324P0765 to provide the necessary services during the transition period.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Last Updated: 02/01/22 Page 1 of 2

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C263-24-AP-3280

1. Contracting Activity: Department of Veterans Affairs, Network 23 Contracting Office (NCO 23), 4801

Veterans Drive, Saint Cloud, MN 56303.

Ordering Activity: Department of Veterans Affairs, Black Hills VA Health Care System, 113 Comanche Rd, Fort Meade, SD 57741.

2237: 568-24-4-3211-0117

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is for a Community Based Outpatient Clinic(CBOC) Service in Winner, South Dakota. This will be a six month contract from September 1, 2024, to February 28, 2025.

The estimated cost is $189,726.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: A 2268 was previously approved for a ten year Winner CBOC solicitation in 2022 using documentation compiled by a prior CO. However, that market research source documentation was just under one year old at the time the 2268 was approved. That market research indicated that two interested and capable firms of any category did not exist and pointed therefore to full and open competition.

A CO conducted new market research in April and May 2023 to refresh the market research and verify whether or not a set-aside should be used. This second round of market research turned up two interested SDVOSB vendors that they were able to verify as capable. However, both of these vendors identified required a build out period that extended beyond the estimated start date of the follow on contract of 01 September 2023.

Incumbent on the expiring contract is therefore needed to continue CBOC services as the only vendor currently capable of providing services during the additional time needed for the two SDVOSB vendors to complete build out on any potentially successful offer that they submit on the anticipated SDVOSB set-aside solicitation.

4. Description of market research conducted and results or statement why it was not conducted:

Additional market research will not be conducted for this short term contract as market research done for the follow on long term contract already indicates the need for an SDVOSB set-aside and verified that no other vendors in the Winner SD area are capable of performing the contract to cover the need time between September 1, 2024, to February 28, 2025.
