SUBJECT: Notice of Intent to Sole Source
This Notice of Intent is provided to advise that the Government intends to negotiate a Sole Source contractual action via a Firm-Fixed-Price contract to Health Facility Solutions Company (HFS). The purpose of this action is to provide a refresh of the drawings for Project Number 656-18-293, Upgrade Surveillance and Duress Systems, along with Construction Period Services and Site Visits to support and facilitate the administration of the construction contract at the St. Cloud VA Health Care System (VAHCS), 4801 Veterans Drive, St. Cloud, Minnesota 56303. NAICS code 541330—Engineering Services will apply to this procurement.
HFS previously was awarded a competitively bid contract to furnish 100% Construction Documents for this project which were completed in 2020 for the original design of this project. The existing 100% Construction Documents from 2020 are still relevant and constructable today; the only services needed are to provide code updates. In addition, this project will require Construction Period Services which will allow for administration of this project throughout construction, utilizing this firm’s construction design documents. HFS has the experience and technical knowledge to continue to perform these services, without the duplication of costs, labor efforts and unwarranted time delays. HFS is may also be able to obtain the same key personnel to perform these updates.
This procurement will be made under Other Than Full and Open Competition as authorized by the Federal Acquisition Regulation, FAR 6.302-1; Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements and statutory authority, permitting other than full and open competition. A Notice of Justification & Approval document will be made available via Contract Opportunities in accordance with FAR 6.305 after award.
This is a notice of intent of a sole source contract and not a request for competitive proposals. No solicitation will be available or issued for this requirement. If a firm believes the VA should not pursue this sole source procurement with the AE firm HFS, and feel they could provide these services without duplicating time and money, they should submit information by 2:00 pm (CT) on Wednesday, April 26, 2023, to colin.moening@va.gov. No telephone responses/inquiries will be accepted. The Department of Veterans Affairs will NOT be responsible for any costs incurred by interested parties in responding to this notice of intent. A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
