Statement of Work Minneapolis VA Medical Center Tuberculosis Reagents

Introduction Contractor shall provide the Minneapolis VA Healthcare System Immunology Laboratory, 1 Veterans Drive, Minneapolis, Minnesota 55417, hereinafter referred to as the MVAHCS, with Tuberculosis reagents which are approved for use with owned Diasorin Liaison XL analyzer, as listed in the schedule of items.

The MVAHCS has recently purchased the Diasorin Liaison XL analyzer which will perform our Tuberculosis testing. The Diasorin Liaison XL analyzer is the only FDA approved, random access analyzer which performs Tuberculosis testing. Tuberculosis reagents that are compatible with the Diasorin Liaison XL analyzer are required.

1. Contract Term and type:

The MVAHCS is requesting a 4 year and 3-month agreement for Tuberculosis reagents which are approved for use with our owned Diasorin Liaison XL analyzer. The effective period of the contract shall be from 7/1/23-9/30/27.

2. Estimated Quantities:

The quantities as listed in the “Schedule of Items” are estimated annual requirements. The MVAHCS attempts to be as accurate as possible when providing estimated quantities, however, actual quantities required may vary from quantities listed. All products will be requested on an “on demand, as needed” basis. Orders will be placed via telephone or FAX by authorized MVAHCS Laboratory personnel throughout the contract period.

3. PRODUCT QUALITY AND QUALITY CONTROL

All products offered to the MVAHCS must be of the same consistent high quality as would be offered to the general commercial public in the United States.

a. All products are purchased subject to acceptance by the MVAHCS. Products that fail to meet Quality Control criteria of the Laboratory will not be accepted. The MVAHCS will not be financially liable for unacceptable materials.

b. Any substitutions of product must have the written approval of the MVAHCS and the Contracting Officer or his/her designee.

c. All defective or inferior products must be replaced within 48 hours at no cost to the MVAHCS.

d. The MVAHCS is not required to return unacceptable product.

e. It is the vendor’s responsibility to provide the MVAHCS with recall notices on any product that has been delivered to this facility that may be defective. Notification shall be made to the Contracting Officer via the most expedient method.

f. The contractor shall provide MVAHCS, with a listing of the vendor’s products used with this analyzer(s) that are considered hazardous. The listing should also include a determination as to what can be considered harmless to be disposed of by normal methods, such as disposing in the sink or disposing in the trash and what must be specially handled for disposal and how it is handled.

4. CUSTOMER SERVICE/TECHNICAL SUPPORT:

A company representative shall be available to the MVAHCS during the contract period to review the account, provide product information, handle problems or defective merchandise (if required) and address any other issues or concerns that may arise. Technical telephone support must be available Monday through Friday between 8:00am and 5:00pm. Telephone response time shall be within four (4) hours of notification.

5. ONE LOT PER DELIVERY:

Reagent/quality control product must be shipped all in one delivery and all one lot number per line item per delivery order. Multiple lot numbers or multiple deliveries per order will not be accepted. The MVAHCS reserves the right to return all products delivered in multiple lot numbers per line item.

6. ROTATION OF STOCK:

To assure rotation of stock at the distributor, each lot of a product received must have an outdate the same or later than previously received. Only one lot of any item may be shipped per delivery, unless part is the “old” lot previously received and part is the “New” lot which will be shipped for the next delivery.

7. LOT NUMBERS:

The term “lot” as applies to this contract, is defined as being dispensed from a common reservoir (i.e., reagents or quality control are of the same lot only if they were poured from the same reservoir after all ingredients were added).

8. ORDERING PROCEDURES:

Delivery orders will be placed by telephone on an on-demand, as needed basis, by MVAHCS, unless vendor specifies an alternative preferred method. Purchase orders to the contractor shall be placed as follows:

9. DELIVERY:

All supplies shall be delivered FOB Destination to the VA Medical Center, Minneapolis, Minnesota (unless otherwise indicated in the Bid Schedule) and shall arrive at the MVAHCS no later than 5 calendar days after receipt of an order.

All deliveries shall be accompanied by a packing slip which shall contain vendor’s name, purchase order number, date of order, date of delivery, itemized list of products furnished including product description and quantity shipped.

10. GENERAL TERMS AND CONDITIONS:

a. Invoices shall be submitted electronically and processed through Financial Service Center (FSC).

11. CHANGES/MODIFICATIONS:

Changes in the pricing, terms or conditions of this agreement may only be made by written agreement of the parties. All modifications for changes to this agreement will be prepared for signature by the VA Contracting Officer for VISN-23.

SOURCES SOUGHT NOTICE

Before responding please carefully read and consider the following:

Tuberculosis Reagents for the Minneapolis VA Medical Clinic. This is a Sources Sought Announcement Only and no solicitation is currently available. Responses will be used by the Government to make appropriate acquisition decisions. After a review of the responses to this Sources Sought Notice, a solicitation announcement may be posted. A response to this Sources Sought Notice is not an adequate reply to a potentially forthcoming solicitation.

All information contained in this Sources Sought Announcement is preliminary, as well as subject to modification, and is in no way binding on the Government. The Government will not pay for any information submitted in response to this request. Furthermore, the Government reserves the right to cancel this requirement at its discretion. The information requested will be used solely within the Department of Veterans Affairs to facilitate decision making and will not be disclosed outside of the Government. The determination of a procurement strategy, based upon the comments submitted in response to this Sources Sought Announcement, is solely within the discretion of the Government.

The applicable North American Industry Classification System (NAICS) Code is 334516, Analytical Laboratory Instrument Manufacturing, size standard is 1,000 employees. NOTE: Please ensure that the System for Award Management (SAM) indicates this NAICS code if you are interested in the requirement.

As this is a supply acquisition, the Small Business Administration and the Federal Acquisition Regulation have Limitations on Subcontracting requirement.
