| d. | "NO LOADS": If no loaded at VA Medical Center (i.e., patient will not be ready for transport for an hour or more due to non-availability of medications/supplies, patient refuses transport, patient passes away prior to pick up) the "Base Rate" will apply. The Offeror and resultant contract awardee, by signing the offer and contract, is acknowledging they have reviewed the clause and will fully comply throughout the contract period. It is the responsibility of the Contractor to determine and pay the appropriate prevailing wage rate and fringe benefits for the location. The Government will not be held responsible for any mistakes in applying the SCLS. |
VA reminds contractors of the Department of Labor Regulations which implement the SCLS and which read at 29 CFR § 4.155:
Employee coverage does not depend on form of employment contract. The Act, in section 8(b), makes it plain that the coverage of service employees depends on whether their work for the contractor or subcontractor on a covered contract is that of a service employee as defined in section 8(b) and not on any contractual relationship that may be alleged to exist between the contractor or subcontractor and such persons. In other words, any person, except those discussed in §4.156 below, who performs work called for by a contract or that portion of a contract subject to the Act is, per se, a service employee. Thus, for example, a person's status as an “owner-operator” or an “independent contractor” is immaterial in determining coverage under the Act and all such persons performing the work of service employees must be compensated in accordance with the Act's requirements.
References: 29 CFR § 4.155
5. ORDERS:
a. Requests for alteration of services will be made in writing or by telephone by the Contracting Officer or his/her designee at the VA Medical Center. VA must authorize any requested change of specialized transportation that differs from the original destination.
b. A copy of the Contracting Officer Representative (COR) designation will be furnished to the Contractor.
6. DRIVERS AND ATTENDANTS:
| a. | The prices quoted in the Schedule of Items include services of a qualified driver and for medical personnel (attendants) as appropriate for emergency care vehicle on any assignment where a patient is transported in the performance of this contract. | |
| b. | Drivers and attendants must possess a current emergency care course certificate authorized by rules adopted by the board according to chapter 144E; and has received training approved by the licensee’s medical director who must sign and file with the licensee a statement that each has successfully completed appropriate training. | |

Proof in the form of current certificates that appropriate training has been successfully completed must be available upon request.
| d. | Prior to award of contract and during full contract period, all drivers and medical personnel must be certified, licensed or otherwise recognized by the local, state, or regional government or public entity where the ambulance service is operated or by which it is governed. The EMS Regulatory Board is the state agency that licenses ambulance services in Minnesota. | |
| e. | All drivers and medical personnel must be enrolled periodically in "refresher" continuing education, or advanced training programs as required by the local or state government entity but in no instance shall this be less frequently than every two years. Such refresher training must be available to the Contracting Officer or his/her designee for inspection and approval. | |
| 7. | VEHICLES/EQUIPMENT: | |
| a. | The ambulances provided under the terms of this contract must meet the standards for vehicle and equipment established by the EMSRB (to include inspections of facility, vehicle, employee education records, and vehicle maintenance). The government will consider inspections as conducted by EMSRB. However, the government does not waive its right to conduct inspections on either a scheduled or unscheduled basis (see paragraph 12 below). | |
| b. | The Contractor must have an adequate number of vehicles to meet the requirements of this solicitation and resulting contract. If a vehicle is not available within the timelines outlined below (see paragraphs 10, 11), the Contractor will contact and coordinate for alternate in-kind transportation at the Contractor’s expense. | |

Contractor must ensure that the pick-ups and drop-offs are scheduled so that the total distance traveled will result in the most economical charge to the Government.
| b. | Contractor shall not release the patient from his custody, unless custody is released to some responsible party. Contractor shall take every reasonable measure to assure the wellbeing of the patient at their destination. Patients brought in by ambulance for a scheduled clinic appointment shall be delivered directly to that specific clinic, released to the custody of clinic personnel, and picked up in the clinic after the appointment by the ambulance crew. | |
| c. | Contractor is required to notify the Contracting Officer or his/her designee of any unusual events, including but not limited to accidents and safety problems that occur that involve VA beneficiaries being transported under this contract. This notification will be made within one (1) hour by telephone and, if requested, a written report of the event will be delivered to the Contracting Officer or his/her designee by close of business the next working day. Failure to comply with this provision may be grounds for default. | |

| 2. | Unscheduled Trips are those trips required on an as needed basis and advance notice is not given. Response time for ambulance’s arrival at destination is within one and one half (1.5) hours after notification of need. | |
| c. | In the case of inclement weather, the decision as to whether or not a VA beneficiary will be transported will be discussed and made mutually by the COR and the Contractor. |
d. The contractor shall, at all times during the contract period, have on his/her premises a functioning fax machine to communicate requirements with the VA (i.e., requests for service, patient incidents, special correspondence, etc.). | 11. | RESPONSE TIME:
| a. | Response Time: The Contractor agrees to meet or exceed the following timelines for service: 10 minutes for 911 Emergencies, 20 minutes for Acute Hospital transports to St. Cloud Hospital or Minneapolis VA and 1.5 hours for scheduled transports not to an acute care facility. Timelines begin when an MAA or designated representative places a call for service. The MAA official log will be the official record of time keeping. Failures to meet timelines are punitive. A $200 deduction from the cost of service will be assessed for each failure to meet timelines. Disputes will be negotiated between the COR and the Contractor. The contractor must notify the VA as soon as possible if the above time limits will not be able to be met. It is the responsibility of the contractor to make alternate arrangements for transportation if the time limits cannot be met. | |
| b. | Response Time Compliance Rate: The contractor shall maintain, at a minimum, a 95% compliance rate on responses to pick-up or deliver during the contract year. Failure of the contractor to perform in accordance with the compliance rating may constitute sufficient cause for termination of the contract (see FAR clause 52.212-4 (m)). | |
| 12. | INSPECTION: | |

B.5 Quality Assurance Surveillance Plan Ground Ambulance Services
1. PURPOSE
This Quality Assurance Surveillance Plan (QASP) is a Government developed and applied document used to make sure that systematic quality assurance methods are used in the administration of the Performance Based Service Contract (PBSC) standards included in this contract. The intent is to ensure that the Contractor performs in accordance with performance metrics set forth in the contract documents, that the Government receives the quality of services called for in the contract and that the Government only pays for the acceptable level of services received.
2. SCOPE
To fully understand the roles and the responsibilities of the parties, it is important to first define the distinction in terminology between the Quality Control Plan and the Quality Assurance Surveillance Plan. The Contractor, and not the Government, is responsible for management and quality control actions necessary to meet the quality standards set forth in the contract. The Contractor develops and submits his/her Quality Control Plan (QCP) for Government approval in compliance with his contract deliverables. Once accepted, the Contractor then uses the QCP to guide and to rigorously document the implementation of the required management and quality control actions to achieve the specified results. The QASP on the other hand, is put in place to provide Government surveillance oversight of the Contractor’s quality control efforts to assure that they are timely, effective and are delivering the results specified in the contract. The QASP is not a part of the contract nor is it intended to duplicate the Contractor’s QCP. The Government may provide the Contractor an information copy of the QASP as an Attachment to the solicitation to support the Contractor’s efforts in developing a QCP that will interrelate with the Government’s QASP.
3. GOVERNMENT RESOURCES/RESPONSIBILITIES
a. CONTRACTING OFFICER: The Contracting Officer (C.O.) ensures performance of all necessary actions for effective contracting, ensures compliance with the terms of the contract and safeguards the interests of the United States in the contractual relationship. It is the Contracting Officer that assures the Contractor receives impartial, fair, and equitable treatment under the contract. The Contracting Officer is ultimately responsible for the final determination of the adequacy of the Contractor’s performance.
b. Contracting Officer’s Representative (COR) - The COR provides detailed technical oversight of the Contractor’s performance and reports his or her findings to the C.O. in a timely, complete and impartial fashion. The COR is not empowered to make any contractual commitments or to authorize any contractual changes on the Government’s behalf. Any changes that the Contractor deems may affect contract, price, terms, or conditions shall be referred to the Contracting Officer for action.
4. METHODS OF QA SURVEILLANCE
Various methods exist to monitor performance. The COR shall use the surveillance methods listed in the above matrix chart for the administration of this QASP.
a. PERIODIC INSPECTION (AUDITING). Evaluates outcomes on a periodic basis. Inspections may be scheduled [Daily, Weekly, Monthly, Quarterly, or annually] or unscheduled, as required.
b. VALIDATED USER/CUSTOMER COMPLAINTS. Relies on the patient to identify deficiencies. Complaints are then investigated and validated.
c. OBSERVATION and 100% INSPECTION. Evaluates all outcomes.
5. Performance Standards The Performance Requirements Summary in the Performance Work Statement (PWS), includes performance standards. The Government shall use these standards to determine contractor performance and shall compare contractor performance to the Acceptable Quality Level (AQL), and determine incentives.
6. Incentives The Government shall use CPARs Evaluation Ratings (Excellent +) as incentives. Incentives shall be based on exceeding the satisfactory performance standards.
7. RATINGS
Metrics and methods are designed to determine if performance exceeds, meets, or does not meet a given standard and acceptable quality level. A rating scale shall be used to determine a positive, neutral, or negative outcome.

a. ACCEPTABLE PERFORMANCE The Government shall document positive performance. Any report may become a part of the supporting documentation for any contractual action.
b. UNACCEPTABLE PERFORMANCE When unacceptable performance occurs, the COR shall inform the Contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the COR shall document the discussion and place it in the COR file. When the COR determines formal written communication is required, the COR shall prepare a Contract Discrepancy Report (CDR), and present it to the Contractor's Program Manager. The Contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the Contractor is required to prepare a corrective action plan to document how the contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the Contractor has to present this corrective action plan to the COR. The Government shall review the Contractor's corrective action plan to determine acceptability. Any CDRs may become a part of the supporting documentation for any contractual action deemed necessary by the CO.
c. EXCEPTIONAL PERFORMANCE The Government shall document exceptional performance. Any report may become a part of the supporting documentation for any contractual action. Incentives are then applicable.
FREQUENCY OF MEASUREMENT
a. Frequency of Measurement.
During contract performance, the COR will periodically analyze whether the negotiated frequency of surveillance is appropriate for the work being performed.
b. Frequency of Performance Assessment Meetings.
The COR shall meet with the contractor semi-annually to assess performance and shall provide a written assessment.
