Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C263-19-AP-4902
1. Contracting Activity: Department of Veterans Affairs, Network Contract Office (NCO 23), Fargo North Dakota Organizational Activity: VISN 23, Sioux Falls VA Health Care System, (Score Lab Test - 4K, 438-20- 1-112-0001, $108,000.00)
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Score Lab Tests, 4K (PSA Blood Tests). The Sioux Falls VA HCS requires Blood Tests services to include labor, equipment, supplies and shipping courier services, kallikrein blood market and associated tests, result interpretation and overhead costs. The tests need to be entered into a database maintained by OPKO laboratories. The contractor must meet all National Privacy, HIPPA and Security Requirements regarding Patient Information. Any delay could result in serious injury, financial or other to the government and VHA patients.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Urgent and Compelling: The current vendor was under contract for the final period of BPA VA263-16-A-0005. Due to an administrative error the option to exercise the final option period was inadvertently missed which resulted in the contract expiring. Award must be made as timely as possible in order to maintain the required blood tests. The vendor has knowledge of the deficiency and the capability to provide the needed testing services quickly and to minimize disruption to patient access and care. Any further delay would result in significant disruption to patient and care giver to the hospital.
4. Description of market research conducted and results or statement why it was not conducted: No market research was conducted. The vendor is available to continue providing testing services Additional market research would likely increase delay in delivery of the required blood tests.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
