E.1 52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
*TRADEOFFS WILL BE USED FOR THIS ACQUISITION*
Evaluation Procedures/Factors Basis for Award: The award resulting from this solicitation will be made on a Best Value, Trade-Offs basis. The evaluation team will review each quote and rate the offerors according to the evaluation factors l isted below. The factors provided will be evaluated against the specifications included in the Solicitation.
The factors/subfactors are l isted in descending order of importance. All evaluation factors other than price, when combined, are significantly more important than price.
Each respondent for the award shall meet all the qualifications as outlined in Description/Specifications/Sta tement of Work.
Evaluation Factors: The VA will evaluate vendors on the following factors: vendors must provide the technical information described in the section above entitled Proposals, in addition to their pricing information. Not providing this information may prevent full consideration of the proposal.
Factor A – Technical Characteristics (indicate how factors are l isted i.e. equally important, weighted, etc.)
Technical Specifications: Vendor’s equipment will be evaluated to determine whether it meets all of the basic technical specifications. All such requirements must be met in order for the vendor’s equipment to be considered acceptable for the award of the BPA. In addition, an analysis of the feature l imitations and enhancements of the equipment along with associated products will be considered. A direct response and supporting documentation, if available, are required for each evaluation criteria. Specific evaluation criteria will include the following:
- Sub-factor 1 - Performance ease/efficiency of operation (Technical). Consideration will be given to ease of operation including navigation of software.
- Sub-factor 2 - Test Menu (Technical). Consideration will be given to the breadth of test menu. The Bid Schedule by Facil ity for each facil ity based on the required test menu must be completed. Documenta ti on and/or certification that the instrumentation offered will perform analyses with total allowable error within l imits as defined by the Clinical Laboratory Improvement Act (CLIA) and the Clinical and Laboratory Standards Institute (CLSI – formerly NCCLS).
- Sub-factor 3 - Performance ease/efficiency of operation (Technical). Consideration will be given to equipment maintenance requirements. Summary of operator-performed and vendor-performed maintenanc e procedures including an estimate of time spent in performance for each category of maintenance.
a. Operator performed – Offerors must summarize their maintenance procedures and provide an estimate of time spent in performance for each category, e.g. daily, weekly, monthly, semi-annually, etc. If analyzer is required to be in an offl ine status, the estimate of time spent on maintenance must include time required to put analyzer in offl ine and return to run status.
b. Vendor performed – Offerors must describe the frequency of preventative maintenance and provide an estimate of time required to perform maintenance.
- Sub-factor 4 -Performance ease/efficiency of operation (Technical). Consideration will be given to reagent handling, storage requirements, and inventory control including reagent barcode capability.
- Sub-factor 5 - Performance ease/efficiency of operation (Technical). Consideration will be given to quality control maintenance, quality control stabil ity, and quality control management including ease of submitting data. Vendor to supply a summary of quality control practices in addition to software features that may include Levey-Jennings , peer group comparison program, abil ity to manually enter or remove results, number of results archived and method of data submission.
- Sub-factor 6 - Performance ease/efficiency of operation (Technical). Consideration will be given to amount of time required for completion of analysis.
- Sub-factor 7 - Performance ease/efficiency of operation (Technical). Consideration will be given to the amount of sample required for analysis.
- Sub-factor 8 - Product and Waste Evaluation (Technical) – Consideration will be given to vendors that are environmentally friendly.
A hazardous material and waste determination for RCRA listed waste and characteristics including lethality for all reagents, calibrators, cleaners and any other products used by the instrument before use.
A hazardous waste determination for RCRA metals and characteristics including lethality for the waste streams from the analyzer consisting of patient samples mixed with chemical reagents, calibrators and cleaners. This requires determination of each individual waste generated by the analyzer at the point of generation before mingling or combining with other wastes. Each discharge pipe or container is considered a separate and distinct waste stream; evaluate each separately.
Required documentation:
i . Documentation requires the manufacturer’s technical staff complete a Chemical Evaluation Form (Attachment A). The Chemical Evaluation Form seeks information on the chemical, product as applicable in an unused or partially used state and as it exists in use per manufacturer’s instructions. All ingredients at any concentration must be taken into account as you respond to the questions on the form.
Documentation must include Toxicity Characteristic Leaching Procedure (TCLP) with results reported in mg/L from a representative sample(s) of each individual waste as described in part A.2.
When determining the representative sample, the vendor must take into account calibrations, cleanings and number and types of tests specific to the analyzer and its use specific to each facility.
If the vendor has all required information prepared in a similar format, this may be submitted in l ieu of Attachment A.
i . The vendor must provide Material Safety Data Sheets for all products. A hyperlink to access this data would also be acceptable.
Documentation of all analysis will be provided to the VA Contracting Officer for review by the VISN-23 Green Environmental Management Systems (GEMS) Coordinator and the Lab Medical Technologist prior to contract award or introduction of new product after award.
Factor B – Price Price means the proposed price or cost as identified in the price schedule of the solicitation. Offerors are requested to use the attached schedule of items to submit their pricing quote. Failure to use the attached schedule of items may prevent full consideration of the quote.
Additional costs incurred that are necessitated to insure the successful operation of the equipment and that will be borne by the Government will be added to the proposed price to insure a fair and equitable price comparison.
Vendors are asked to submit their proposal in the following format which exemplifies the most advantageous pricing structure for the government:
CPT – a CPT price based on the individual facil ity’s annual volume and proposed instrumentation mix. Pricing is un-tiered and each facil ity may have a different CPT.
The quantities l isted in Bid Schedule by Facil ity are the VA’s best estimate and will be used to evaluate quotations and select the firm to receive the BPA. However, the VA does not guarantee to order thes e quantities – neither the total for the entire VISN nor the separate quantities per site l isted.
Factor C – Past Performance Shall be conducted util izing the Past Performance Information Retrieval System (PPIRS).
*LACK OF PAST PERFORMANCE INFORMATION WILL BE RATED AS “NEUTRAL”
Factor D – SDVOSB Preference -VAAR 815.304 – In an effort to assist SDVOSBs and VOSBs, contracting officers shall include evaluation factors providing additional consideration to such offerors in competitively negotiated solicitations that are not set aside for SDVOSBs or VOSBs. Additional consideration shall also be given to any offeror, regardless of size status, that proposes to subcontract with SDVOSBs or VOSBs.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
