DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

1. Contracting Activity:

Network Contracting Office 23, Services Team, 2501 W 22nd Street, Sioux Falls, SD 57106.

Requesting Program:

VA Nebraska-Western Iowa Health Care System, 4101 Woolworth Avenue, Omaha, Nebraska

68105.

Title of Procurement: Document Destruction Services

Purchase Requisition Number: 636-19-1-5127-0052

Acquisition Plan Action ID: 36C263-19-AP-2050

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

This is an individual sole source justification and approvals for the procurement of document destruction services. VA intends to award one, firm fixed price contract. The VA Nebraska- Western Iowa Health Care System is requesting continued document destruction services from Innovative Federal Operations Group, Incorporated (doing business as IFOG), DUNS 829402309, and verified service disabled veteran owned small business. VA documents and records are to be destroyed/shredded at multiple on-site locations utilizing contractor provided mobile shredding equipment. The contractor shall provide shredding and disposition of paper and other media that contain sensitive information from the VA facilities.

The anticipated period of performance consists of a four-month base period of performance starting 04/01/2019 and ending 07/31/2019, followed by two three-month option periods with an estimated ultimate end date of 01/31/2020. The base period of performance estimate is $97,050.48 with a procurement aggregate estimate of $209,640.96, inclusive of all periods of performance.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

As provided for in FAR 13.106-1, VA intends to solicit from and award to a single source. The incumbent contractor for the document destruction services is IFOG and the contractor has fully qualified personnel and all necessary equipment in place and is familiar with the highly specialized service requirements/deliverables and legal requirements utilized for and required to complete this service without interruption. IFOG is the only firm capable of providing the equipment and services in a timely, urgent manner without a lapse. Any other contractor would require time to phase-in and begin providing the document destruction services.

Contract VA263-13-C-0192 with IFOG to provide document destruction services for the VA Nebraska-Western Iowa Health Care System ended on 12/31/2018. Previous to the expiration of the contract, specifically on 11/17/2018, VA posted Solicitation 36C26318Q0600 to the Federal Business Opportunities website at www.fbo.gov as a request for quotes (RFQ). The purpose of the solicitation was to request quotes from prospective offerors to provide Document Destruction Services for the VA Nebraska-Western Iowa Health Care System and its Community Based Outpatient Clinics (CBOCs). The solicitation was a total service disabled veteran owned small business set-aside, and the procurement used NAICS code 561990 All Other Support Services with a size standard of $11 million. The closing date and time for the solicitation was set for 11/30/2018 at 5:00 PM.

At the closing of the solicitation, a total of three quotes had been received. During the source selection process of the procurement, delays in awarding a resulting contract came about, such as a protest to the Small Business Administration (SBA). In the end, after evaluation of the quotes received in response to the solicitation, no award was made and Solicitation 36C26318Q0600 was cancelled on 03/27/2019.

To ensure services were not interrupted between the expiration of Contract VA263-13-C-0192 and the start of the instant procurement (proposed for 04/01/2019), VA procured the document destruction services from IFOG via the Government Purchase Card. However, the use of the purchase card was intended and approved only for a short-term period of performance until a contract could be put into place to cover the required services. As such, due to the urgent need to continue the document destruction services to support the VA Nebraska-Western Iowa Health Care System, VA is proposing to enter into a single source procurement with IFOG with contracted services to begin on 04/01/2019. During the base period of performance of the instant procurement (04/01/2019 to 07/31/2019), VA intends to again solicit for a competitive procurement.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted via GSAdvantage for FSS contract holders, System for Award Management, Small Business Administration and the Office of Small and Disadvantaged Business Utilization’s (OSDBU) Vendor Information Pages (VIP) database. Vendors capable of performing this service were located. However, due to the reasons cited above, this procurement will be completed via FAR 13.106-1 soliciting from a single source.

The barriers to competition will be overcome when VA solicits for a competitive procurement.

It is anticipated that VA will complete additional market research, post a competitive solicitation, and award a contract during the base period of performance of the instant procurement.

5. Contracting Officer's Certification:

Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
