Government Responses to Technical Questions Solicitation: 36C26318Q0346 Description: Pharmacy Benefit Management First Fill Services – Iowa City VA Health Care System

Number
Question
Government Response
1
On page 12 of the solicitation, under the “Privacy Requirements” section it states: “The contractor shall not store patient information on a mobile device. A verbal contact is sufficient to obtain prior authorization when needed. The contactor is prohibited from transferring Personnel Health Information (PHI) by fax or email to and/or from a VA facility.”

Does the VA define mobile devices to include laptop computers? If so, can the contractor request approval to use laptop computers and demonstrate that appropriate security controls have been implemented to protect the confidentiality of data on the device? Can the contractor request the use of secure email for sending and receiving PHI by demonstrating the ability to send and receive secure, compliant email?

Laptops would be considered a mobile device. Per discussion with the VA Information Security Officer (ISO) for Iowa City VA Health Care System, the use of laptop computers for this purpose would not be allowable due to potential PHI issues. In regards to secure e-mail for sending PHI, the VA is not supportive of that approach at this time.

2
On page 53, under “Technical Approach” it states the “page limit for Technical Approach is 20 pages.” Does that 20-page limit also include Past Performance references? If not, is there a page limit for Past Performance references?
Please refer back to solicitation (page 51); page limit for past performance references is five (5) pages.
3
Concerning C.14 “IT Contract Security” (pages 28-37); we have never seen this clause used in other VA procurements for these types of services. In delivering these types services we do not connect to or otherwise interface with VA information system or networks.

Can you please clarify, what, if any, “information system(s)” the contractor will have to host, operate and/or maintain on “behalf of the VA” in fulfilling these requirements? We are specifically trying to determine if the expectation in this contract is for the vendor’s internal commercial information systems be FISMA compliant?

Per discussion with ISO, the only way that vendors can connect to VA equipment from outside of the VA, is if they have an existing Memorandum of Understanding and Interconnection Agreement (MOU-ISA) and a remote connection agreement. Per information shared in this question, this would not be applicable to vendors not connecting to VA systems. Vendors, however, per this clause, must have FISMA compliant internal commercial systems.
