Contractor shall sign clause 852.219-75 VA NOTICE OF LIMITATIONS ON SUBCONTRACTING-CERTIFICATE OF COMPLIANCE FOR SERVICE AND CONSTRUCTION (JAN 2023) (DEVIATION) pg 18 of the solicitation.
ALL OFFERS SHALL SUBMIT ALL DOCUMENTATION UNDER SECTION E and all AMENDMENTS, failure to provide any required document and acknowledgment of all amendments will result in the offer to not be acceptable and will not be evaluated.

QUESTION AND ANSWER FOR 36C26225Q1081 SHUTTLE SERVICE
1. Is there an incumbent contractor currently providing these services? If so, what type and size of vehicles are being utilized under the existing contract?
ANSWER: Up to 8-30 passenger buses currently are being utilized.
1. Will designated parking spaces be provided on campus for the contractor’s shuttle vehicles?
ANSWER: No
3. Confirmation of Certificate Submission Timing:
We’ve reviewed the supplemental insurance requirements outlined in Section C.9 and will ensure all minimum coverages are met. Could you please confirm whether the certificate of insurance must be submitted with our proposal, or only prior to the award?
ANSWER: Per clause (d) The successful bidder must present to the Contracting Officer, prior to the award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.
4. Termination for Convenience and Reimbursement:
Under FAR 52.212-4(l), the contract states:
“The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience.”
We understand this means the VA may cancel the contract at any time, for any reason, without prior notice. We plan to invest significantly in performance, including the purchase of two ADA-compliant vans and one to two additional buses. If the contract is terminated for convenience, can you confirm whether the VA will reimburse any non-recoverable expenses incurred in good faith?
ANSWER: No, the government will not reimburse any non-recoverable expenses incurred.
5. Termination for Cause – Risk of Contractor Default:
Under FAR 52.212-4(m), the contract also allows the VA to terminate the agreement if the contractor fails to perform. The clause states:
“If the Contractor fails to deliver supplies or to perform the services within the time specified… or fails to perform any other provision of this contract… the Government may terminate this contract for default.”
In such cases, the Government reserves the right to obtain substitute services from another provider at our expense, and to record the termination against our past performance history. We also note that there is no guaranteed cure period, which means the VA may proceed with default action without prior notice.
This places us at significant financial and reputational risk, even in the event of circumstances beyond our control — such as road closures, severe traffic accidents, mechanical breakdowns, extreme weather, natural disasters, hazardous conditions, or civil disturbances. Could you please clarify whether a written cure notice would be issued before any termination for cause is enforced?

ANSWER: Currently no but the locations are subject to change due to contracting of parking lot and construction at the VA facility.

ANSWER: There needs to be a vehicle available to depart from each location every 15 min.
13. Are new vehicles required, or are late model vehicles used acceptable?
ANSWER: No but all need to meet all federal, state, and local regulations.
14. Is there a minimum year, mileage, or make/model requirement for the vehicles?
ANSWER: No but all need to meet all federal, state, and local regulations.
15. What specific GPS tracking and reporting capabilities are required (real-time, historical data, integration)?
ANSWER: GPS tracking is not required.
16. Will the contractor be required to provide public-facing tracking links or mobile app access?
