INTENT TO SOLE SOURCE
The Department of Veterans Affairs, Network Contracting Office 22 (NCO22) intends to sole source a contract for Certification Review Hearing Officer Services for the VA Loma Linda Health Care System. All work is to be completed in accordance with statement of work. This sole source contract will be solicited and negotiated with Michael Maldonado Law Offices 2388 Van Buren Boulevard Riverside, CA 92503 under the authority of FAR 13.106-1 – Single Source Justification.
See attached Draft Statement of Work (SOW).
The North American Industry Classification System (NAICS) code for this procurement is 541110. The Small Business Administration (SBA) size standard is $15.5 Million Dollars.
Interested vendors that can meet this requirement, shall identify their interest and capability, and respond to this notice by 02/13/2024 by 3:00 PM MT. Interested vendors must send a capability statement, no more than one page in length; to include Company Name, ueiSAM Number, Socioeconomic Category, brief description of your business entities capability to handle this project at the VA Loma Linda Health Care System.
This Special Notice of Intent to Sole Source is for planning purposes only. No solicitation will be made available. This is not a request for quotations. All information shall be provided at no cost or obligation to the Government. Responses must be sent via email to the Contracting Specialist at Rochelle.Bennett@va.gov.
Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon the responses to this notice is solely at the discretion of the Government. If no responses are received, Contracting will proceed with the sole source negotiation with Michael Maldonado Law Offices.

DRAFT STATEMENT OF WORK
Certification Review Hearing Officer Services
A. PURPOSE: The VA Loma Linda Health Care System (VALLHCS) requires a contractor to provide Certification Review Hearing services in accordance with California Welfare and Institutions Code, Sections 5256 through 5256.8. These services are required to determine if patients cared for within the in-patient psychiatry unit are required to remain in the locked unit beyond the initial 72-hour hold. All Certification Review Hearings have the potential of leading to reasonable, foreseeable litigation or dispute involving the government in a trial, hearing, or proceeding in any court, administrative tribunal, or agency action.
B. SERVICES TO BE PROVIDED: The contractor will furnish under this contract the following services:
a. The contractor shall preside as Certification Review Hearing Officer over Certification Review Hearings scheduled by the Inpatient Psychiatry Unit of the Jerry L. Pettis VA Medical Center, 11201 Benton Street, Loma Linda, CA 92357 on an as needed basis.
b. The contractor’s services shall be provided virtually to the Inpatient Psychiatry Unit located on 2nd floor of the Jerry L. Pettis VA Medical Center, 11201 Benton Street, Loma Linda, CA 92357 as agreed upon by all parties.
c. The contractor shall comply with State and Federal law in regard to confidentiality of patient health records and information.
C. CONTRACTOR RESPONSIBILITES: Other responsibilities and accountability include:
a. The contractor will conduct the hearings in an informal and impartial manner so that free and open discussion by participants is encouraged.
b. The contractor will conduct the hearings for the Inpatient Psychiatry Unit of the Jerry L.
Pettis VA Medical Center, 11201 Benton Street, Loma Linda, California 92357 in a location that affords privacy and freedom from disruption.
c. The contractor will consider all facts and evidence presented and render a finding of probable cause or no probable cause to continue involuntary hospitalization.
D. PERSONNEL QUALIFICATIONS & CERTIFICATIONS
CONFIDENTIALITY AND SECURITY REQUIREMENT
Contractor shall ensure the confidentiality and security of all patient information and shall be held liable in the event of breach of confidentiality. The Contractor shall comply with the provisions of the Privacy Act (5 USC 522a), Confidentiality of Drug Abuse, Alcohol Abuse, Sickle Cell Anemia and HIV/AIDS Treatment Records (38 USC 7332 and 38 USC 4132), VA Claims Confidentiality Statute (38 USC 5701) and Confidentiality of Medical Quality Assurance Records (38 USC 5705 and 38 USC 3305). The Contractor shall comply with all pertaining confidentiality and security statutes. Contractor shall be HIPAA (Health Insurance Portability and Accountability Act) compliant. Failure to comply with statutes regarding confidentiality and security of patient health information/individually identifiably information may result in financial sanctions.
Access requirements to VA information systems by Contractor personnel shall meet or exceed those requirements established for VA employees as promulgated in VA/VHA administrative issues including directives. Access shall be granted to non-VA users only if the purpose of access is consistent with all privacy and security policies and regulations. Contractor personnel shall be required to sign access agreements before starting work under this contract. These agreements shall require them to abide by VA computer access and confidentiality policies.
Contractor shall sign a Business Associate Agreement (BAA) between itself and the Department of Veterans Affairs.
The contractor will be certified and recognized as a court-appointed Certification Review Hearing Officer by the County of San Bernardino to conduct the Certification Review Hearings in accordance with California Welfare and Institutions Code, Sections 5256 through 5256.8.
E. NORMAL WORKING HOURS
Work to be accomplished during normal work hours Monday through Friday from 8:00 am to 5:00 pm, excluding Federal Holidays or any other holiday declared by the President of the United States as a national holiday. All services shall be performed during stipulated hours of coverage unless requested or approved by COR or authorized personnel at no additional charge to the Government.
F. NATIONAL HOLIDAYS: The contractor shall not be required to provide delivery services on the following national holidays, nor shall the contractor be paid for these holidays:

When a national holiday falls on a Sunday, the following Monday shall be observed as a national holiday. When a national holiday falls on a Saturday, the proceeding Friday is observed as a national holiday by U.S. Government agencies. Furthermore, included, would be any other day, specifically declared by the President of the United States of America to be a national holiday.
