About this file

This document is a sole source justification for a contract awarded by the Department of Veterans Affairs to provide wheelchair and hired car transportation services. The VA San Diego Healthcare System had an urgent need for these services due to the expiration of its current contract and deficiencies in the request for quotation process. The sole source bridge contract was awarded to the incumbent, Laudan LLC, for the period of February 1, 2024 to April 30, 2024 with a value of $748,572.36. Market research found this pricing to be fair and reasonable when compared to similar contracts at other VA facilities. A follow-on competitive contract is planned for award by May 1, 2024.

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C262-24-AP-2258

1. Contracting Activity: Department of Veterans Affairs, VISN 22, VA San Diego Health Care System.

664-24-2-186-0031 applies to this requirement.

2. Nature and/or Description of the Action Being Processed: The San Diego VAHCS has an urgent requirement for a contractor to provide wheelchair and hired car services to Veteran patients of twenty four (24) hours a day, seven (7) days a week include holidays. The requirement will result in a new firm-fixed price contract, 36C26224P0629 in the amount of $748,572.36.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The San Diego VAHCS has an urgent and compelling need for a contractor to provide wheelchair and hired car transportation services. The current contract is about to expire. Due to deficiencies in the RFQ process, there is not enough time to properly complete the new contract, so a three-month sole source bridge contract will be awarded in the iterim. The period of performance is 2/1/2024 – 4/30/2024. This urgent requirement is valued at $748,572.36

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

( ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

( x ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert

Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The VA San Diego Health Care System has an urgent and immediate need for a contractor to provide wheelchair and hired car transportation services for veterans. Laudan LLC., is the current contractor providing these services.

This requirement has become urgent, necessitating an award of a contract for immediate services to prevent a negative impact to patient care and a lapse in services.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Soliciting competition for this effort would be not be practical.

Providing for full and open competition would delay award and result in a disruption of wheelchair and hired car transportation for Veterans. It is in the best interest of the Government not to delay award.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: Laudan LLC pricing from the current task order, expiring on 01/31/2024, was accepted.

The total amount was $748,572.36. The total quantities were determined based on the needs as projected by the COR.

Research in FPDS indicates that VA facilities across the country are paying similar amounts for wheelchair and hired car services. An initial search by NAICS 485991, drilled down by agency, resulted in 9,719 acontract actions. Of these, the following contracts were identified:

- 36C25022D0850/36C25024N0123l G&M Automotive Transportation l $1,200,00 10/29/2023

Laudan’s quote of $748,572.36 compares similarly to these contracts. Also, as noted above, Laudan’s unit pricing remains unchanged from the previous task order.

Based on the research, Laudan’s LLC quote is determined to be fair and reasonable and the most advantageous to the government.
