About this file

This document is a Sole Source Justification for a Healthcare for Homeless Veterans (HCHV) bridge contract for the Southern Arizona VA Healthcare System (SAVAHCS) under FAR 13.5 Simplified Procedures for Certain Commercial Items. The incumbent contractor, Old Pueblo Community Services (OPCS), is currently providing HCHV services which are essential for veteran healthcare in Tucson, Arizona. The bridge contract will be a fixed-price, indefinite delivery, indefinite quantity (IDIQ) to ensure uninterrupted healthcare delivery to the veteran population while the procurement process for a long-term contract is completed. The services include temporary housing and supportive services in a community-based setting for healthcare-eligible homeless veterans. Market research indicated limited competition, with only one large vendor showing interest but lacking the required capabilities. This bridge contract will provide the estimated time needed to put a long-term contract in place by October 1, 2024.

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID:____36C262-24-AP-5100_______________________________________

1. Contracting Activity: Department of Veterans Affairs, VISN 22, Southern Arizona VA Healthcare System, by Network Contracting Office (NCO) 22: 2237: 678-24-4-1150-0047.

2. Nature and/or Description of the Action Being Processed: Healthcare for Homeless Veterans (HCHV) is necessary for the needs of our Veterans. The HCHV in Tucson has been conracted since 2020. This service is currently being provided under contract number: 36C25820D0021 which ends June 30, 2024. While the long-term contract is currently being reviewed for a pre-solicitation, the needs for a bridge contract is required to continue to provide services. This bridge contract type will be a fixed-price, indefinite delivery, indefinite quantity (IDIQ).

The bridge contract is necessary to ensure uninterrupted healthcare delivery to our Veteran population in the Tucson and South Tucson area while the procurement process for the long-term contract is completed. This justification and approval outlines the unique circumstances necessitating this approach, including the crucial need to maintain continuity of care and the sole-source capability of the incumbent contractor in providing specialized medical services tailored to the needs of our Veterans

3. Description of Supplies/Services Required to Meet the Agency’s Needs: This procurement is for temporary housing and supportive services in a community-based setting to Veterans with special needs who are experiencing homelessness in the Tucson and South Tucson area. This is for transitional housing services for the most vulnerable and at-risk homeless Veterans to provide a safe, healthy, and secure setting to promote their recovery goals and discharge to permanent housing. Services will be provided to VHA healthcare-eligible Veterans who are experiencing homelessness and may be discharging from the VA Medical Center, another medical facility, living on the streets or preparing for planned entry into a substance abuse program. The contractor will be required to provide a low-barrier therapeutic and rehabilitative milieu, while working with Veterans to secure permanent housing.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert

Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security

Effective Date: 02/01/2022 Page 2 of 3

( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Old Pueblo Community Services (OPCS) is currently providing HCHV services. These services are essential to Veteran healthcare in Tucson, Arizona. A new long term contract could potentially require months after award to move veterans into a new facility and to have all required inspections completed before start of services.

A bridge with OPCS will ensure continuity of care for veterans while the long term contract is put into place.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: During market research for the long-term contract a Sources Sought Notice 36C26224Q0268 was issued on 11/22/2023 and ended on 11/30/2023 and one (1) interested vendor responded. The vendor, Ntrgrated United Solutions is a large entity however, they do not posses the capabilities to fulfill this requirement. A Search in VetBiz using NAICS code 624221 resulted in 65 SDVOSB/VOSB vendors that could potentially provide these services. As search in SBA using NAICS 624221 with key words respite or recuperative show zero (0) vendors that could potentially provide services.

There is a potential that SDVOSB entities can provide these services. However, this requirement is necessary to extend the services of the incumbent vendor with a bridge contract while the long-term contract is currently being reviewed. The government’s requirement can be met with services readily available in the commercial marketplace.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable Prices are deemed fair and reasonable based on the cost of the previous contract. The level of effort required for this procurement is the same as the previous contract and the pricing is remaining the same.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As described in Section 6 above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
