VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Last Updated: 02/01/22 Page 1 of 1

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C262-23-AP-1353

1. Contracting Activity: Department of Veterans Affairs, NCO 22, Long Beach, CA, Purchase Request # 691-23-1-4098-0014.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The West Los Angeles (WLA) VA Medical Center is seeking a contractor to provide 67 Brand Name MSA Millennium Gas Masks with Mask Carrying Pouches for the Police & Security.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: WLA VA Occupational Health and Safety already have 80 Brand Name MSA Millennium Gas Masks on hand. This request is to buy masks for additional officers to equip the entire force. Mixing mask brand name types would cause unnecessary burdens of both additional labor and the need to stock additional parts.

Additional mask fit testing would be required as each brand of mask fits/wears differently.

Each brand of mask operates differently so additional training for police officers and Safety Department personnel would be required. Additional replacement mask filters for other brand names would need to be stocked as well as current mask filters as mask filters cannot be swapped between manufacturers as that voids the National Institute for Occupational Safety & Health (NIOSH) certification for the mask/filter combination.

4. Description of market research conducted and results or statement why it was not conducted: VA’s VIP database identified 562 SDVOSB/VOSBs for NAICS 339113. A Sources Sought/RFI was published to sam.gov and GSA eBuy with 14 sources responded – 4 SDVOSB, 1 VOSB, 8 SB, and 1 Other. 6 of the SB offered items under a GSA contract.

The Rule of Two can be met for SDVOSB but not for SDVOSB with GSA contracts so an Open Market Solicitation with a SDVOSB Set Aside would be appropriate.

5. Contracting Officer's Certification: Purchase is approved in accordance with

FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
