NOTICE OF INTENT TO SOLE SOURCE

The Department of Veterans Affairs, Network Contracting Office (NCO) 22, located at 4811 Airport Plaza Drive, Long Beach, CA 90815 is issuing this Notice of Intent (NOI) to inform industry contractors of the Government’s intent to execute a Sole Source Award under FAR Part 13 – Simplified Acquisition Procedures (SAP), specifically FAR Subpart 13.5 – Simplified Procedures for Certain Commercial Items.

This procurement is being conducted using commercial item procedures pursuant to FAR Part 12 and FAR Part 13, specifically FAR Subpart13.106-1(b)(1)(i) allowing the Contracting Officer (CO) to solicit from one source. This will be a Firm Fixed Price (FFP) award and an anticipated award date is set for December 1, 2022

The intended Contractor is Rotech Healthcare Inc., 3600 Vineland Road # 114, Orlando, FL 32811.

Description of Supplies: The New Mexico VA Healthcare System (NMVAHCS), Phoenix VA Healthcare System (PVAHCS), Northern Arizona VA Healthcare System (NAVAHCS), and Southern Arizona VA Healthcare System (SAVAHCS), Prosthetics Departments are in need of a short-term bridge contract for Home Oxygen and Ventilator Services for Veteran beneficiaries that are in need of such services. The contractor is required to deliver and set up VA authorized oxygen therapy systems or ventilators. The contractor will also conduct home visits to provide training to patients and maintain the equipment.

Unusual and Compelling Urgency: These are critical services that will cause great harm to patients if these services are interrupted. There are currently two awarded IDIQ contracts based on geographical area for these services that consist of a base year and four one-year option periods. Both of these contracts have received Government Accountability Office (GAO) protest as well as Small Business Administration (SBA) size protest. Stop-work orders have been issued for both contracts resulting in a need for the incumbent contractor to continue services until GAO and SBA protests determinations have been made.

The North American Industry Classification System (NAICS) for this requirement is 621610, Home Healthcare Services. The Federal Service Code (FSC) for this requirement is Q201 General Healthcare. This acquisition has an estimated value of $630,065.46 which will be paid via Government Purchase Card (GPC).

This notice of intent is neither a formal solicitation nor a request for competitive proposals. No solicitation document is available and telephone requests will not be honored. The intent of this synopsis is for informational purposes only. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this action based on this notice is solely within the discretion of the Government.

All inquiries and concerns must be addressed in writing via e-mail to shavon.bogan@va.gov.
