DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C262-22-AP-6703
1. Contracting Activity: The Department of Veterans Affairs, VISN 22, Network Contracting Office 22 (NCO 22) in Long Beach, CA, seeks to procure the supplies / services listed in purchase request 501-22-3-7119-0011 for the New Mexico VA Healthcare System (NMVAHCS), Albuquerque, NM.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
NMVAHCS requires MagView MIS Tracking Software Licenses to provide reporting and PS integration in support of patient care.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
NMVAHCS medical staff research found only the Applied Software, Inc. (dba MagView) mammography information system license suite of applications compliant with FDA Mammography Quality Standards, The ACR Standards and the VHA Directive 1105.3 “Mammmography Programs, Procedures and Standards.” The current Mammography Information System in use at NMVAHCS (OmniCare) is outdated and antiquated. The system has not updated its format to comply with newer requirements. This has placed a tremendous burden and workload on the single Mammography Technologist, requiring expenditure of large amounts of time to manually compile, input and track Mammo Data. The system is also not compliant with Windows 10. The Mammo imaging equipment was upgraded this year to Windows 10 but the OmniCare system can no longer be updated. Since the upgrade, the patient history in OmniCare does not transfer to the Radiologist for interpretation and presents a patient safety issue. Due to urgency, time constraints, and exclusive licensing agreements of proprietary software in support of healthcare objectives, circumstances of contract action deem only one source reasonably available, and no other supplies or services will meet agency need. Purchase is in accordance with FAR13.106-1(b).
4. Description of market research conducted and results or statement why it was not conducted:
See Market Research (MR) on file in eCMS briefcase. Results of VIP Query by applicable NAICS code 511210 identified 481 SDVOSB / VOSB vendors. RFI 36C26222Q1545 posted on SAM.gov and GSA eBuy (1580204) generated only one (1) response from Applied Software, Inc. (dba MagView) – OEM. Applied Software, Inc. is the exclusive manufacturer of MagView tracking software and enhancement products and is the sole authorized distributor. VA Rule of Two does not apply. Due to exclusive licensing agreements and nature of requirement, no reasonable expectation exists that qualified SDVOSB / VOSB vendors can or will submit offers to meet need. Recommend small business sole source award IAW FAR Part 13. Circumstances of contract action deem only one source reasonably available due to urgency, time constraints, and exclusive licensing agreements of proprietary software, and no other supplies or services will meet agency need. VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief, and the price offered is determined to be fair and reasonable.
