About this file

This document contains an amendment to a solicitation and answers to additional questions from offerors. The solicitation is for in-home oxygen and ventilator services for the Southern Arizona VA Healthcare System in Tucson, Arizona. The amendment adds a requirement for compliance with VHA Directive 1193 regarding the COVID-19 vaccination program for healthcare personnel. It also updates the pricing worksheet to remove line items for portable oxygen concentrator rentals intended for travel purposes only, as these will be covered under a single setup line item. The answers clarify that portable oxygen concentrators are for travel use only and not as a primary oxygen source. No line items will be added for after-hours or weekend setups, and those requirements will remain in the performance work statement. The pre-solicitation notice provided describes the incumbent's provision of these services to approximately 1,800 oxygen and 10 ventilator patients. The ensuing solicitation will be issued on August 10, 2021 as a fixed-price IDIQ contract through the VA's Network Contracting Office.

Amendment to the RFP:

Section B.3 PERFORMANCE WORK STATEMENT (PWS) is hereby amended to add paragraph 27 to the PWS as follows:

Para 27. COVID-19 Vaccination Program. Certain Contractor personnel performing work under this contract meet the definition of “Health Care Personnel” as that term is defined in VHA Directive 1193, Coronavirus Disease 2019 Vaccination Program for Veterans Health Administration (VHA) Health Care Personnel (HCP), dated August 13, 2021 (“VHA Directive 1193”). VHA Directive 1193 is attached as section D.5 of this contract, is incorporated by reference herein, and is made part of this contract. Contractor shall comply with the requirements of VHA Directive 1193 while performing work under this contract and Contractor shall ensure that all Contractor personnel performing work under this contract who meet the definition of Health Care Personnel (“HCP”), including Contractor’s subcontractor HCP, comply with the requirements applicable to HCP specified in VHA Directive 1193. HCP include Contractor personnel who, regardless of job title or duties performed, perform work at VHA facilities, as well as those whose duties put them in contact with VHA patients in their homes or outside VHA medical facilities. Contractor’s compliance with the requirements of this paragraph is necessary for the management and control of infectious disease. Contractor’s failure to comply, or failure to ensure that Contractor HCP comply, with the requirements of this paragraph shall be a material default of the contract. VA reserves the right to direct Contractor to immediately remove Contractor HCP from performing work under this contract if VA determines, at its sole discretion, that said Contractor HCP are not in compliance with VHA Directive 1193. Contractor shall timely replace Contractor HCP so removed with HCP who meet the requirements of VHA Directive 1193, at Contractor’s sole expense with no adjustment to contract price, in accordance with a replacement schedule Contractor shall submit to, and request approval by, the Contracting Officer.

Additional Questions and Answers

Question 1 – Ref Amendment A0001, Q17. Page 35 of 82 states: "The Contractor shall perform the services as specified herein twenty-four (24) hours per day seven (7) days per week. Set-ups will normally be requested during normal business hours, however, after hours and weekend set-ups may be required." As it stands now, there is no line item for after hours and weekend set-ups. Can the Government add a line item for after hours and weekend set-ups?

The answer provided for question A17, Amendment 0001. No line item will be added.

Question: Since after hours and weekend set-ups may be required, there needs to be a line item for this service. Should no line item be added, then consider removing this requirement from the PWS.

Answer to Question 1. No line item will be added and the requirement will not be removed.

Question 2 – Ref Amendment A0001 Q18. Line item 0002 states: "Delivery, initial set-up, and education of Government owned portable oxygen concentrator system. Portable system for new set ups includes battery, handcart and/or pouch/backpack. Includes delivery, setup, and education. This is a one-time charge for new set-ups. HCPCS: A9901." And Line Item 0006 states: "Monthly Rental of portable oxygen concentrator system. Portable system includes flow meter, 2 rechargeable batteries, handcart, pouch/backpack and disposable supplies. HCPCS: E1392." Is it the intent of the SAVAHCS that the portable oxygen concentrator systems referenced in these 2 line items are used for portability? Or as the primary source of oxygen?

The answer provided for question A18, Amendment 0001. Portable Oxygen concentrator systems will only be used for travel purposes.

Question: Line Item 0016 states: "Portable Oxygen Concentrator Rental for Traveling Patients. Only models that have continuous flow option or those devices that meet the patients liter per minute as indicated on prescription. E1392" If line item 16 is for Portable Oxygen Concentrator Rental for Traveling Patients, then what is line item 0006 for? It's confusing that there would be 2 line items for the same thing.

Answer to Question 2. SAVAHCS will utilize Portable Oxygen Concentrators (POC) for travel purposes only. The Price Worksheet is amended to update the quantities for CLIN’s 006 & 0016 to zero. CLIN 002 will be utilized for POC’s.
