2. BACKGROUND:
Executive Management, Equal Employment Opportunity (EEO), and Human Resources are charged with conducting administrative investigations on behalf of VA Healthcare System Facilities. Additionally, the Office of General Counsel (OGC) conducts hearings on behalf of the VA. As such, VA Healthcare Systems and OGC requires transcription / court reporting services to create verbatim transcripts of legal and administrative proceedings where the spoken word must be preserved as a written transcript. These legal and administrative proceedings include, but are not limited to: Administrative Investigation Boards (AIB), EEO Hearings, Human Resources Investigations and includes hearings/meetings ordered by the Administrative Judges. These transcripts ensure a complete, accurate, secure, and confidential legal record of proceedings and document all statements made in VA Healthcare Systems and OGC official proceedings.
VALBHS, VASDHS, and OGC require transcription / court reporting services on an irregular, as-needed, basis, often with short notice. Previously these services were managed with a purchase card due to the nature of the services and billing structure (individual bill each day, different interviews, under cost ceiling, etc.). However, as the facility has indicated that these will be more frequent, there is a need for a proactive management of this process has been requested and this is in response to that request.
AIB Authority
Court reporting services for cases from the Risk Management office will primarily be used for capturing testimony involving investigations initiated by the chief executive of VA facilities under the following authority.
The Veterans Affairs Secretary is authorized to “make investigations and examine witnesses upon any matter within the jurisdiction of the Department,” to take affidavits, and to administer oaths and affirmations under 38 USC § 5711. These authorities are delegated to the Heads of VA Administrations and Staff Offices, to the chief executives of VA facilities, and to all authorities senior to any of these officials in the VA organization (collectively, “convening authorities”). Such authority is in addition to any other existing authorities, including the inherent authority of VA officials to make or direct appropriate inquiries into matters within their areas of responsibility. This delegation of authority shall continue in effect until it, or this directive, is specifically rescinded or revoked, and is not subject to the sunset provision of VA Directive 0000, Delegations of Authority.
These authorities may be redelegated to a principal assistant, and may also be redelegated to employees assigned to conduct administrative investigations for the duration of their investigation duties. Senior convening authorities may direct their subordinate convening authorities in the exercise of these authorities. In exercising these authorities, delegates shall comply with applicable requirements of VA Directive 0700 and VA Handbook 0700, Administrative Investigations.
The Secretary’s statutory authority to issue subpoenas, compel attendance of witnesses, and require the production of evidence is not delegated herein but has been delegated separately to other authorities (see 38 CFR Part 2).
EEO Authority
Court reporting services for cases from the EEO office will primarily be used for capturing testimony involving discrimination and sexual harassment cases at all stages of an EEO case.
The EEO office is charged with attempting to resolve employees’ concerns involving discrimination /sexual harassment at the lowest level possible. However, there are times when a complaint requires depositions from the complainant, witnesses, management officials, etc. When depositions are required for testimony the agency, via the EEO office, is required to solicit the services of a court reporting agency to accommodate the proper capturing of statements for factual record. The court reporting services are required as part of investigation of complains and hearings.
In accordance with 29 C.F.R. 1614, 1614.108, Investigation of Complaints, (b) In accordance with instructions contains in Commission Management Directives, the agency shall develop an impartial and appropriate factual record upon which to make findings on the claims raised by the written complaint….
(1) The complainant, the agency, and any employee of a Federal agency shall produce such documentary and testimonial evidence as the investigator deems necessary.
In addition to the investigation of complaints, the discrimination and sexual harassment complaint may potentially proceed to a hearing. In accordance with 29 C.F.R. 1614, 1614.109 (d) Discovery… Evidence may be developed through interrogatories, depositions, and requests for admissions, stipulations or production of documents.
