B.2 LIMITATIONS ON SUBCONTRACTING-- MONITORING AND COMPLIANCE (JUN 2011)

This solicitation includes FAR 52.219-6 Notice of Total Small Business Set-Aside. Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

B.3 SUBCONTRACTING COMMITMENTS--MONITORING AND COMPLIANCE (JUN 2011)

This solicitation includes VAAR 852.215-70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, and VAAR 852.215-71, Evaluation Factor Commitments. Accordingly, any contract resulting from this solicitation will include these clauses. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) to assist in assessing contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. B.4 SCHEDULE OF SERVICES

This is a fixed price (FFP) price purchase order to provide the Joint Commission Statement of Conditions (SOC) Continuous Readiness Program with Internet Management System for VA Loma Linda Healthcare System (VALLHS), 11201 Benton Street, Loma Linda, CA 92357. The period of performance shall be ninety (90) days.

DESCRIPTION OF SERVICES/STATEMENT OF WORK

I. Background Information:

The Joint Commission Statement of Conditions (SOC) Continuous Readiness Program with Internet Management System is needed to ensure VA Loma Linda Healthcare System (VALLHS) and its inherent fire protection features will protect the lives of patients and staff during a fire. This program will be evaluated based on the updated standards of The Joint Commission and NFPA 101 2012 Edition. This survey is required to be completed every 3 years and has not been completed since 2015. This hospital, the total sq. footage is 850,000. Services shall comply with all Department of Veteran Affairs, Local, State, and Federal policies and regulations.

II. General Procedure:

The Contractor shall furnish all labor, materials, supplies, tools, equipment, and qualified personnel to perform the update to the SOC per the statement of work.

III. Required Information:

The Contractor shall communication with the facility to establish the scheduling plan and to ensure that appropriate information will be available prior to the on-site survey (e.g., 8.5” x 11” floor plans, necessary policies, step ladder).

IV. Initial Review:

The Contractor shall meet with the facility leadership and life safety team to review life safety compliance status, process and initiatives and provide feedback to the team on current Joint Commission life safety trends, hot topics, and interpretations. Contractor to allocate a minimum of 4 hours for meeting.

V. Basic Building Information:

The Contractor shall review and update Basic Building Information (BBI), provide VALLHS with strategies for better configuration of the BBI, and include potential consolidation of buildings, if applicable.

VI. Survey:

The Contractor shall provide a wall-to-wall, roof-to-basement Life Safety Code® survey for 6-12 days, and shall include the following:

a. Field conditions of life safety features including, but not limited to, rated doors, exit signage, means of egress, hazardous areas, etc. (Excludes the records review for any inspection, testing and maintenance of fire protection and/or life safety system).

b. Full survey of all required smoke and fire rated barriers, vertical openings, corridor walls and travel distances (If barrier walls are found to be inadequate or significantly deficient, contractor shall identify and survey alternative solutions for wall alignment to be reflected on Life Safety Compliance Drawings after approval and agreement.).

c. Support the VALLHS in addressing alternative ways to review spaces (suites, etc.) to reduce overall costs while maintaining compliance and best practices.

d. Survey Briefings: Conduct daily, weekly briefings of findings to address red flag issues and/or review items that will require discussion on remediation options.

VII. Report of Recommendations:

The Contractor shall provide a life safety excel deficiency report for management review. Final report output shall include NFPA 101® 2012 Edition Code References as applicable. The final report output shall include remediation actions that define the steps for remediation of a deficiency and provide the following:

a. Projected costs. (Cost data shall be determined using the R.S Means database and other industry practices, and shall be reviewed with the facility to determine final costing strategies for known deficiencies.)

b. A list of inaccessible access areas for inspection that were deemed inaccessible during the wall-to-wall life safety survey.

VIII. AutoCAD Services:

The Contractor shall provide field verified Life Safety Compliance Drawings. (Note: Current AutoCAD backgrounds for all surveyed areas will be provided by the facility in AutoCAD 2010 for Windows format).

Drawing packages shall include:

a. One (1) master set of Life Safety Code® compliance drawings with the specific features to include:

· Required Smoke Barriers

· Required 1 & 2 Hour Fire Barriers and 1 & 2 Hour Building Separations

· Required Rated Corridor Walls

· Horizontal Exits

· Required Exit Stairs

· Required Exit Passageways

· Required Exterior Exit Discharge

· Known Vertical Openings

· Linen and Trash Chutes

· Hazardous Areas

· Listing of Sprinkled and Non-sprinkled smoke compartments

· Any approved equivalencies or waivers

b. One (1) master set of Deficiency Location drawings. These drawings shall indicate deficiency locations utilizing unique deficiency ID nomenclature.

c. One (1) master set of Smoke Compartment and Suite Designation drawings. These drawings shall outline suite boundaries, denote type of suite (sleeping vs. non-sleeping), suite size, smoke compartment boundaries and indicate smoke compartment size.

d. Drawings shall be submitted in hardcopy, electronic PDF and scanned for insertion into the Life Safety Internet Management Solution.

IX. Education/Training:

Offeror must possess a 30-hour Occupational Safety and Health Administration (OSHA) safety card.

XI. Safety Requirements:

The Contractor shall perform work in accordance with existing relevant, accredited standards and codes to minimize the possibility of injury to personnel, or damage to Government equipment. Every effort shall be made to safeguard human life and property.

XII. Insurance Requirements:

The parties agree that the Contractor’s personnel working on this purchase order shall not be considered VA employees for any purpose and shall be considered employees of the contractor. The Contractor shall be responsible for providing:

i. Workers Compensation.

ii. Professional liability insurance.

iii. Health examinations.

iv. Income tax withholding.

v. Social Security payments.

XIII. Changes:

The awarded Contractor is advised that only the Contracting Officer, acting within the scope of the contract has the authority to make changes which affect the contract in terms of quality, quantity, price or delivery.

In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment shall be made in the purchase order price to cover any increases.

XIV. Reporting:

For services to be performed during normal working hours, the contractor shall report upon arrival to the shall check in with Prior to work each day, workers or a designated lead or supervisor are/is to check in with the Graphics Control in the plant. This check in is mandatory.

XV. Smoking Policy:

Smoking is not permitted within or around the VA except in designated areas.

XVI. Badges and Parking:

a. All Contractor personnel are also required to wear Vendor ID Badges noting Contractor Name, Personal Name, and Photo of Contractor personnel.

b. It is the responsibility of the Contractor’s personnel to park in the appropriate designated parking areas. Parking information is available from the individual VA Healthcare System Police Station. VA shall not validate or make reimbursement for parking violations of the Contractor's personnel under any circumstance.

XVII. Hours/National Holidays:

The contractor shall perform the services as specified herein Monday through Friday except for National Holidays (see below) between the hours of 7:30 a.m. – 4:00 p.m. The contractor is not required to provide service on the following U.S. Government holidays, nor will the Contractor be paid for these holidays.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within ten (10) days.

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of California . Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.
