B.3 STATEMENT OF WORK

Part 1: Project Scope of Work Overview:
The Department of Veterans Affairs Central California Health Care System (VACCHCS), Fresno
Facilities Maintenance Service, requires a contract to create life safety drawings for Building 2, Building 22, Building 22A, Building 24 and Building 32.
Part 2: Period of Performance (POP):
Period of performance is to be completed 90 days after Notice to Proceed.
Part 3: General Information and Requirements:
3.1 The contractor shall provide all tools, equipment, and personal protective equipment necessary to complete this project as deemed by industry standards, this SOW, all related specifications, applicable code requirements, and site policy.
3.2 Disposal of all waste and debris is at the contractor’s own expense.
3.3 The contractor shall provide quality control of all work conducted and the individual appointed shall be competent and educated/experienced in the field of work this scope encompasses
3.4 All work shall be coordinated with the COR assigned to this project and only commence once approved.
3.5 Schedule: Normal work hours will be 8:00am – 4:30 pm Monday-Friday excluding Official Federal
Holidays, A contractor is not to work on Official Federal Holidays as listed on
OPM.gov(https://www.opm.gov/policy-data-oversight/pay-leave/federal-holidays/#url=Overview).
The contractor, if they need to perform work over the weekends (Saturdays and Sunday) or outside of work hours above that they will need to request authorization prior to performing any work from the COR/Engineer and final approval from the Contracting Officer. Any request to utility shutdowns must be requested in writing at a minimum of 21 days prior to the requested day of shutdown.
3.6 Codes and Standards: The Contractor shall follow all applicable codes and standards for this type of work including but not limited to Health Care System Memorandums (HCSM), OSHA Guidelines, Lock-out-Tag-out, Rules of Station, NFPA, and etcetera. If any code/standard is found to be contradictory; the authority having jurisdiction (COR) shall make the final determination and work shall proceed at no additional cost to the medical center.
3.7 Smoking is prohibited on VACCHCS grounds and inside buildings.
Part 4: Detailed Project Scope of Work:
4.1 The contractor shall provide all tools, materials, equipment, supervision, personnel, and transportation necessary to assure that all services are in accordance with contract and all applicable codes, law, and regulations.
4.2 Contractor shall provide one designated point of contract to the government’s designated representative.
4.3 Site Visit: Conduct a site visit to identify fire and life safety features of the facility.
4.4 Life Safety Plans: Update and prepare Life Safety Plans for Building 2, Building 22, Building 22A, Building 24, and Building 32. One Life Safety Plan set will be delivered. Life Safety Plans will identify on a zone-by-zone basis the occupancy uses, and extent of automatic sprinklers system coverage provided (e.g. fully sprinklered, partially sprinklered, not sprinklered). These drawings will also show the fire and smoke resistive ratings and locations of the following walls and enclosures as required to maintain compliance with latest edition of NFPA 101. These drawings will also provide the structural features of fire protection documentation required by accreditation standards.
A. Areas of building sprinklered (if building only partially sprinklered)
B. Locations of all hazardous storage areas
C. Locations of all fire-rated barriers
D. Locations of all smoke-rated barriers
E. Sleeping and non-sleeping suite boundaries, including size of identified suites
F. Locations of designated smoke compartments
G. Locations of chutes and shafts.
4.5 Life Safety Code Summary & Legends: Upon completing the site visit, a summary of the Life Safety
Code (LSC) requirements concerning existing and new occupancy conditions will be discussed. The plans legend(s) will appear in the drawings detailing the requirements governed by the Authority
Having Jurisdiction (AHJ) and Accreditation Organization (AO). This information will facilitate the inspection and maintenance of the existing life safety features identified in the drawings as accreditation standards and LSC requirements.
4.6 Existing Life Safety Features: Vendor complies with NFPA 101, Chapter 4, Sections 4.6.7.4 &
4.6.7.5 where: Existing life safety features that do not meet the requirements for new buildings, but that exceed the requirements for existing buildings, shall not be further diminished. If life safety features have been designed to exceed the requirements for new buildings, it is permitted to be decreased to those requirements for new buildings.
4.7 Vendor will provide will deliver the following:
A. Updated Life Safety Plan in AutoCAD DWG File
B. PDF version of the updated Life Safety Plan
Part 5: Documentation Requirements:
5.1 Security Badge: Vendor shall notify VA police on arrival and obtain a temporary badge. The VA
Issued Security badge shall be worn on the upper torso and always visible.
5.2 Contractor’s Badge: Vendor employees, and representatives shall always have a company badge or identification visible.
5.3 Physical Security: The vendor shall be responsible for safeguarding their equipment while on government property. Additionally, the contractor shall be responsible for any government equipment, information and property provided for vendor use. Vendors will NOT be provided with a staging area for storage of tools, equipment, material, supplies, and other items. The Government will not be responsible for damage or loss of vendor’s property. Vendor is responsible to safeguard its property.
5.4 OI&T Security: Office of Information and Technology (OI&T) certification and accreditation requirements do not apply for this service contract and therefore a Security Accreditation Package is not required. At no time will the vendor be in contact or have access to VA sensitive information, OI&T systems, or the VA OI&T network.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days prior to contract expiration.

C.3 52.222-90 ADDRESSING DEI DISCRIMINATION BY FEDERAL
CONTRACTORS (DEVIATION APR 2026)
(a)Definitions. As used in this clause—
Program participation means membership or participation in, or access or admission to:
training, mentoring, or leadership development programs; educational opportunities; clubs;
associations; or similar opportunities that are sponsored or established by the contractor or subcontractor.
Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.
(b) In connection with the performance of work under this contract, the Contractor agrees as follows:
(1) The Contractor will not engage in any racially discriminatory DEI activities;
(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;
(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;
(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and
(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.
(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).

(a) Definitions. As used in this clause –
VA Information system is the same as information system and means, pursuant to 38 U.S.C.
5727, a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information whether automated or manual.
VA sensitive information means all VA data, on any storage media or in any form or format, which requires protection due to the risk of harm that could result from inadvertent or deliberate disclosure, alteration, or destruction of the information and includes sensitive personal information. The term includes information where improper use or disclosure could adversely affect the ability of VA to accomplish its mission, proprietary information, records about individuals requiring protection under various confidentiality provisions such as the Privacy Act and the HIPAA Privacy Rule, and information that can be withheld under the Freedom of
Information Act. Examples of VA sensitive information include the following: individually-identifiable medical, benefits, and personnel information; financial, budgetary, research, quality assurance, confidential commercial, critical infrastructure, investigatory, and law enforcement information; information that is confidential and privileged in litigation such as information protected by the deliberative process privilege, attorney work-product privilege, and the attorney client privilege; and other information which, if released, could result in violation of law or harm or unfairness to any individual or group, or could adversely affect the national interest or the conduct of Federal programs.
(b) General. Contractor personnel assigned to work for or on behalf of VA must undergo a background investigation commensurate with the risk and sensitivity level designation associated with the work to be performed at the level indicated in the contract. The Contractor and subcontractors shall comply with VA Directive/Handbook 0710, Personnel Security and

(c) Risk and Sensitivity Levels. The following table identifies the risk and sensitivity levels that apply to any personnel providing services under this contract. *VA Administrations, organizations and staff offices will use the OPM Position Designation Tool.

Security clearances are granted to individuals with a specific requirement for access to classified material (for example, Confidential, Secret and Top Secret). Contractor personnel that are required to obtain a security clearance will be subject to a Tier 3 or Tier 5 investigation. The following sensitivity designations have been assigned for the identified Tier 3 and Tier 5 required by this contract:

(d) Fitness. The results from a background investigation are used to determine if an individual’s fitness is sufficient for that individual to perform work for or on behalf of VA in the position identified in this contract. Contractor fitness determinations are made in accordance with 5 CFR Part 731.202.
Fitness requirements for employment are separate and distinct from job qualifications. If a
Contractor or subcontractor employee is found to be unsuitable or unfit to provide services under this contract, the Contractor shall immediately remove the employee from working on this contract and take those necessary steps that restrict the employee’s logical access to VA data, information, VA sensitive information, or information technology or VA information systems containing such data or information.
The Contractor shall advise the employee that they are not permitted to access any VA controlled building or real property in relation to this contract. The removal of an unfit Contractor or subcontractor employee does not alleviate the Contractor from satisfying the requirements of this contract. The Government will not reimburse the Contractor for any costs associated with the recruitment/replacement of an employee or subcontractor employee who is found to be unfit.
(e) Identification Cards. The Government will provide a Personal Identification Verification
(PIV) card or other identification card, as necessary, to fit Contractor personnel who require physical access to VA facilities and/or logical access to VA data, information, VA sensitive information, or information technology or VA information systems containing such data or information. Contractor and subcontractor personnel shall prominently display their
PIV/identification card on their persons while working at a VA facility and shall present their
PIV/identification card for inspection upon request by a VA official. The Contractor must surrender the employee or subcontractor employee’s PIV/identification card in accordance with the requirements set forth in Directive/Handbook 0735 when any of the following events occur:
1. When no longer needed for contract performance.
2. Upon completion of the Contractor/subcontractor employee’s employment.
3. Upon contract completion or termination.
(f) Lost/stolen. Immediately upon detection, the Contractor shall report a lost or stolen
PIV/identification card to the Government authorities as identified in Directive/Handbook 0735.
Within 48 hours of reporting the lost/stolen PIV/identification card, the Contractor shall submit to the Program Manager an incident report that describes the relevant facts and circumstances regarding the loss/theft. If the loss/theft was reported by the Contractor to the local police, the
Contractor shall further submit a copy of the final police report to the Program Manager within
48 hours of the report being made available by the local police department. The Government will not reimburse the Contractor for any costs that result from lost/stolen PIV/identification card(s).
(g) Regular Reporting. The Contractor shall submit a status report to PIV Sponsor within 5 working days after the end of each calendar quarter and as requested by the Government in order to initiate contract closeout procedures. The report must provide the status of each contractor/subcontractor employee who is required to have a PIV/identification card during the performance of the contract. The report shall identify the Contractor and the contract number, and list the following status for each contractor/subcontractor employee who holds a
PIV/identification card under this contract:
1. Contractor/subcontractor employee name.
2. Name of VA facility where Contractor/subcontractor employee works, if applicable.
3. Date background check submitted for Contractor/subcontractor employee.
4. Date PIV/identification card issued to Contractor/subcontractor employee.
5. Contractor/subcontractor employee’s PIV/identification card number, as applicable.
6. Date Contractor/subcontractor employee no longer has need for PIV/identification card.
7. Date Contractor notified VA that PIV/identification card is no longer required.
8. Date Contractor returned PIV/identification card was returned to VA.
(h) Flow down of clause. The Contractor shall include the substance of this clause in subcontracts, third-party agreements, and BAA’s, in which subcontractors, third-party servicers/employees, and business associates will perform functions where they will have physical access to a VA facility or logical access to VA data, information, VA sensitive information, or information technology or VA information system containing such data or information.

SUBCONTRACTING—CERTIFICATE OF COMPLIANCE FOR SERVICES AND
CONSTRUCTION (JAN 2023) (DEVIATION)
(a) Pursuant to 38 U.S.C. 8127(l)(2), the offeror certifies that—
(1) If awarded a contract (see FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:
(i) [X] Services. In the case of a contract for services (except construction), the contractor will not pay more than 50% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded. Other direct costs may be excluded to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service as set forth in 13 CFR 125.6.
(ii) [] General construction. In the case of a contract for general construction, the contractor will not pay more than 85% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 85% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.
(iii) [] Special trade construction contractors. In the case of a contract for special trade contractors, the contractor will not pay more than 75% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in
852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–
74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 75% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.
(2) The offeror acknowledges that this certification concerns a matter within the jurisdiction of an Agency of the United States. The offeror further acknowledges that this certification is subject to Title 18, United States Code, Section 1001, and, as such, a false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.
(3) If VA determines that an SDVOSB/ VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:
(i) Referral to the VA Suspension and Debarment Committee;
(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and
(iii) Prosecution for violating 18 U.S.C. 1001.
(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract. Contracting officers may, at their discretion, require the contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the contracting officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.
(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance with the limitations on subcontracting requirement. The offeror understands that failure to provide documents as requested by VA may result in remedial action as the Government deems appropriate.
(d) Offeror completed certification/fill-in required. The formal certification must be completed, signed and returned with the offeror’s bid, quotation, or proposal. The Government will not consider offers for award from offerors that do not provide the certification, and all such responses will be deemed ineligible for evaluation and award.

ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS
SUBMISSION INSTRUCTIONS
(a) General Instructions
To assure timely and equitable evaluation of quotes, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.
(1) Electronic Submissions: Contractors must email their quote to Cynthia Diezel at cynthia.diezel @va.gov. Include the solicitation number in the Subject line. Any attachments must be readable using Microsoft Office or Adobe PDF. The size of the email is limited to 5 megabytes (MB) but multiple emails are allowable. Quotes must be submitted electronically and will not be accepted through fax or postal mail.
(2) Follow the quote preparation instructions as given in the solicitation and prepare your response and supporting documents. Contractors must be registered in the System for
Award Management (SAM) and have a Contractor’s Unique Entity ID (SAM) number. All questions regarding this solicitation must be emailed to cynthia.diezel @va.gov no later than seven (7) business days prior to the quote due date. Verbal inquiries or questions will not be addressed or accepted.
(3) Vendor shall submit 852.219-75 VA Notice of Limitations on Subcontracting - Certificate of Compliance for Services and Construction (JAN 2023) (DEVIATION) Paragraph (d) requires certification to be completed, signed, and returned with the offeror's bid, quotation or proposal. Government will not evaluate or award otherwise.”
(4) The quote must be prepared in two parts consisting of a "Technical Approach and Past
Performance" and separate section for "Pricing Information". Each of the parts shall be separate and complete so that evaluation of each part can be accomplished independently.

(2) In accordance with FAR 12.205(a)(2), the quotes will undergo a comparative evaluation to determine which vendor provides the best value to the government in terms of high technical capability and past performance, while also providing a competitive price. The government reserves the right to consider a response that offers more than the minimum and select that response if it provides a benefit to the government. Therefore, it is at the
Governments discretion to consider other than the lowest priced offer for award.
(3) The Government intends to establish a contract without discussions with contractors.
Consequently, Contractors are highly encouraged to offer their best technical and pricing quote in their initial submissions. However, the Government reserves the right to discuss submissions with any or all contractors submitting a technical and price quote, if it is determined advantageous to the Government to do so. This statement is not to be construed to mean that the Government is obligated to conduct discussions. A Contractor may be eliminated from consideration for award without further discussions if its technical and/or pricing quote/information is not among those Contractors considered most advantageous to the Government.

Additionally, Contractor Performance Assessment Reporting System (CPARS) will be reviewed to determine if vendor’s previous work was recent (within the past 3 years) and relevant (similar in size and for Boiler Plant Operator Staffing). Past performance information will also be reviewed to determine the overall trend in the ratings of quality for previous contracts. Federal Awardee Performance and Integrity Information System
(FAPIIS) will be reviewed to determine if the contractor has had any adverse actions associated with federal contracts and grant Per FAR 15.305(a)(2)(iv), “in the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.”
(d) Pricing Information
The quote should contain the vendor’s best terms from a price standpoint. The
Government will evaluate quotes for award purposes by adding the total price for all contract line items, including options, for a total price utilizing the line items at the beginning of this RFQ. Pricing shall be submitted error free. Do not change or add line items in the Price Schedule. Doing so may have your quote be deemed unresponsive and not considered for evaluation.
The evaluation may consider the possibility that the option can be exercised at any time and can be exercised in increments of one to six months, but for no more than a total of six months during the life of the contract. The evaluation may assume that the prices for any option exercised under FAR 52.217-8 may be at the same rates as those in effect under the contract at the time the option is exercised. The evaluation may therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all proposals relative to each other, and should not affect the ranking of proposals based on price, unless, after reviewing the proposals, the Government determines that there is a basis for finding otherwise. (a) The Government will award a contract resulting from this solicitation to the responsible contractor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate the quotes:
1) Factor #1, Technical Capability
2) Factor #2, Past Performance
3) Factor #3, Price
In accordance with FAR 12.205(a)(2), the quotes will undergo a comparative evaluation to determine which vendor provides the best value to the government in terms of high technical capability and past performance, while also providing a competitive price. The government reserves the right to consider a response that offers more than the minimum and select that response if it provides a benefit to the government.
Additionally, the government reserves the right to put price higher than technical capability and past performance.
FACTOR 1 – Technical Capability
The quotes will be evaluated using the information submitted in the technical approach addressing the following elements:
1) Technical:
a. The Government will assess the vendor’s ability to provide the Life Safety drawings with the knowledge of the NFPA, TJC and local amendments.
b. The Government will assess the vendor’s ability deliver the required drawings in accordance with the required formats that are compatible with the facilities systems.
c. The Government will assess the vendor’s methodology for on-site surveys and
“as built” verification.
d. License: The Government will assess the vendor’s ability to provide proof that the plans will be overseen by a licensed Architect or Professional Engineer
2) Experience: The Government will assess the breadth of experience in providing relevant services. Vendors that demonstrate ability to provide lifesaving drawings may be rated more favorably. Vendors that demonstrate relevant experience such that the Government has a higher confidence in successful contract performance may be rated more favorably.
a. Provide evidence showing experience mapping life safety systems for hospitals.

FACTOR 2 – Past Performance

The Government will assess how well a vendor performed on recent and relevant past performance. Vendors with no past performance will not be rated favorably nor unfavorably on this factor.
FACTOR 3 – Price
When submitting pricing information, the contractor will provide a fixed unit prices for the line items in the price schedule. In evaluating the contractor’s price, the Government’s determination will include whether the price reflects a clear understanding of the requirements, is consistent with the information provided in the contractor’s quote and is reasonable in comparison with other quotes that have been submitted in response to the solicitation.
Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
Evaluation of options shall not obligate the Government to exercise the option(s).
Evaluation of Option to Extend Services under 52.217-8. For the purposes of the award of this Contract, the Government intends to evaluate the option to extend services, provided under FAR 52.217-8, as follows:
The evaluation will consider the possibility that the option can be exercised at any time and can be exercised in increments of one to six months, but for no more than a total of six months during the life of the contract.
