This amendment is to post the responses to the submitted questions for this requirement.
No follow up questions will be accepted.
David J. Alvarez
Contracting Officer
1. Is there an incumbent? I read through the instructions to offerors, but I didn't see the actually submission instructions that provide how and what document need to be submitted as well as the format. Please advise.
Response: This is a new requirement so there is no incumbent. Please see page 68-69 of the RFQ and submit by email.
2. How many of the positions are filled?
Response: Five 1.0 FTE Registered Operating Room Nurses
3. Does the VA accept religious accommodations in lieu of Covid vaccine requirements? If granted accommodation, does VA provide the contract RNs daily/weekly covid tests?
Response: Weekly covid tests will be provided by the contractor.
4. Is orientation billable to the Government?
Response: Yes (orientation occurs the first day on duty).
5. How long is the security process at the VA?
Response: It could be up to 90 days
6. How long is the typical credentialing process for RNs at the VA?
Response: Proof of credentialing is supplied by the contract agency
7. Is Government training to include annual training conducted on duty time billable to the
Government?
Response: Annual training can be conducted during the tour of duty.
8. As non-personal services, mustn’t the RN hold a valid, unrestricted California RN license?
Response: Yes
9. Is the contractor required to be a California Professional Corporation under the Moscone-
Knox Professional Corporation Act, Cal. Corp. Code Section 13400, et. seq. [Codes
Display Text (ca.gov)], or a Professional Nursing Corporation, Cal. Bus. & Prof. Code
Section 2775 – 2781 [Codes : Text Search : Search Results (ca.gov)]?
Response: No.
10. With reference to “Performance of Work Statement,” Section 4.3.1; 4.3.2, does the VA consider the RNs supplied by the Contract to be part of the VA’s workforce?
If the contractor itself is not a health care provider, does the VA still consider the treatment exception applies to the services, and that no HIPPA Business Associate
Agreement is required?
Response: No, this is not a personal services contract. BAA is not required, that will not change based on who the contractor is.
11. Is the VA facility in Palo Alto, California where the work is to be performed, considered a federal enclave?
Response: VA Palo Alto is federal property, in that the land is owned by the Federal
Government. This is all that can be answered from the given information.
12. In paragraph 2.1.1. of the solicitation, completion of "an accredited training course in nesting through the State of California" is listed as a required qualification for RN personnel. Could this requirement be clarified?
Response: Change to ‘an accredited training course in nursing’. See #14
13. Can the Government please clarify if companies are required by California State law to pay nurses that miss shifts due to COVID EXPOSURE? Will the contractor have to pay staff even if the nurses don't have any symptoms but are required to quarantine?
Response: According to California Paid Sick Leave Laws, if the employee has paid sick leave available, the employer must provide such leave with compensation. This can include self-quarantine. Source: https://www.dir.ca.gov/dlse/2019-novel-coronavirus
14. The PWS states that the contractor must present “accredited course in nesting” through the State of California. Can the Government please clarify what this course is?
Response: See response to question 12.: Change to ‘an accredited training course in nursing’. Does not have to be only through the state of California.
15. Can the Government please suggest SCA labor category?
Response: OR Registered Nurses are exempt per 29 C.F.R. Part 541.
16. Referencing Page 25 & the QASP. Performance Requirements mention certification in accordance with ARDMS and CCI standards, but there are no specialty specific certifications requested in the Qualification section of the PWS and these standards do not typically apply to RNs. Can the government please confirm if these are applicable to the current requirement?
Response: They are not applicable to the current requirement.
17. Referencing the Price/Cost Schedule. Option periods 1001-4001 have the Contract Period listed as “Base”. Should contractors update this to reflect the referenced option year?
Response: No need to update the verbiage. The award will be an IDIQ and will have ordering periods and not option periods.
18. Page 23 Section 4.3.6 Direct Patient Care. Do the OR RNs need to float to the Recovery
Room (PACU)? If so, what is the average patient to nurse ratio?
Response: No
19. Page 5 Section B.2(C) IT Contract Security. Contract personnel who require access to national security programs must have a valid security clearance. What is the Clearance
Level for this effort?
Response: Low
