ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS Submission of quotes shall be sent to the Contract Specialist, David Alvarez, via email at David.Alvarez4@va.gov no later than the date and time stated on page 1 of the RFQ. Submitted quotes shall address each factor listed below:
1. Quality Control Plan: Describe how you will adhere to the terms and conditions of the performance work statement to include utilization of a record keeping system, cleanliness, and housing for veterans. In addition, the narrative must include the earliest date in which services can be provided in accordance with the Performance Work Statement. Also, you must provide a copy of your building occupancy license and address of the facility.
2. Staffing Plan: Offerors must provide a staffing plan with Key Personnel noted that indicates the daily availability of staff at the Residential and Transitional Treatment Center. The plan must include staffing information such as how much experience does staff has working with Veterans, Veteran issues, and coordinating with the VA ARTS Director and program staff.
3. Past Performance: Past Performance evaluation will be based on the Contractor having successfully completed verifiable past performance that is similar in scope and nature to that identified in the Performance Work Statement. Past Performance evaluation will be based on the Contractor having successfully completed verifiable past performance that is similar in scope and nature to that identified in the Performance Work Statement. Provide proof of past performances and of adhering to any past fire and life facility practices for a residential and transitional treatment facility. Past Performance shall be from the last 3 years.
4. Transportation: Offerors shall state if they can and will provide any kind transportation services to and from the VA Hospital, Mather, CA and how they plan on doing so, all costs associated with this for Disabled Veterans seeking treatment and make necessary medical appointments.
5. SDVOSB/VOSB Participation: Vendors who wish to participate must represent that they are an SDVOSB/VOSB and include DUNS or show they intend to subcontract to a verified SDVOSB/VOSB (include subcontractor DUNS and description of what the sub will perform this contract) OR state that neither applies to them.
6. Price: Complete the price schedule in Section B. The quote should contain the vendor’s best terms from a price standpoint. The Government will evaluate quotes for award purposes by adding the total price for all contract line items, including options, for a total price. Contractor will not be paid for beds not utilized by Veterans.
Please see VAAR 852.273-73 for required items and additional information regarding the evaluation factors.
Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.
The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:
A.1 VAAR 852.273-73 EVALUATION - HEALTH-CARE RESOURCES (JAN 2003)
(a) The Government will award a contract resulting from this solicitation to the responsible vendor whose quote, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. In accordance with FAR 13.106-2(b)(3), the quotes will undergo a comparative evaluation to determine which vendor provides the best value to the government in terms of the information provided in response to past performance and other non-priced factors while also providing a competitive price. Moreover, the Government is not assigning weight to the factors or listing them in any particular order. The following information or factors shall be used to evaluate offers:
1. Quality Control Plan
2. Staffing Plan
3. Past Performance
4. Transportation
5. SDVOSB/VOSB Participation
6. Price Factor 1 Quality Control Plan: This factor will be used to determine the Contractor’s capability and understanding of the requirement. The Contractor must submit a narrative, not to exceed five pages, that details how the Contractor will adhere to the terms and conditions of the performance work statement to include utilization of a record keeping system, cleanliness, and housing for veterans. In addition, the narrative must include the earliest date in which services can be provided in accordance with the Performance Work Statement. Also, the contractor must mention their proof of past performances and of adhering to any past fire and life facility practices for a residential and transitional treatment facility and provide a copy of your building occupancy license. Offeror shall provide the address of the facility. This factor is a pass/fail.
Factor 2 Staffing Plan: This factor will be used to assess a Vendor’s likelihood of performing successfully in accordance with the PWS. Contractors must provide a staffing plan with Key Personnel noted that indicates the daily availability of staff at the Residential and Transitional Treatment Center. The plan must include staffing information such as how much experience does staff has working with Veterans, Veteran issues, and coordinating with the VA ARTS Director and program staff.
Factor 3 Past Performance: The government will consider the experience indicated to see how recent and relevant it is to the current requirement. Relevant is defined as similar in size and scope to this requirement. If the vendor is relying on a subcontractor, the Government will consider the experience of the subcontractor, but it will not be rated as relevant as that of a prime contractor. Experience that is considered highly relevant will be rated more favorably than less relevant experience. The Contractor shall submit a verifiable Past Performance record to be utilized in this evaluation such as prior social work experience preferably working in health-related setting. The Contractor is responsible for identifying how previous efforts are similar in scope and magnitude to those specified in this requirement. Past Performance shall be within the last 3 years.
Factor 4 Transportation: Contractor shall state if they can and will provide any kind transportation services to and from the VA Hospital, Mather, CA and how they plan on doing so, all costs associated with this for Disabled Veterans seeking treatment and make necessary medical appointments.
Factor 5 SDVOSB/VOSB Participation: This is a standalone factor and contains no sub-factors. Offerors must read the following and respond below to receive ratings as follows:
Basis for award: For evaluation purposes, this factor will be evaluated as follows:
· Full credit for a registered and verified SDVOSB means a reduction of 5% of total price.
· Partial credit for a registered and verified VOSB means a reduction of 2% of total price.
· Partial credit for Offerors proposing to subcontract with a registered and verified SDVOSB or VOSB means a reduction of 1% of total price.
For example, if an offeror is a registered and verified SDVOSB and their total price is $1,000,000.00 then 5% would be $50,000.00. The offerors adjusted price would then be $950,000.00. The adjusted price of $950,000.00 would be the price used for the price evaluation. The same process would be applied to a registered and verified VOSB and non-Veteran proposing to subcontract with an SDVOSB or VOSB, but the reduction percentage would be at the amount listed above. However, the award price will be the offered price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Factor 6 Price:
Complete the price schedule in Section B. The offer should contain the offeror's best terms from a price standpoint. The quote should contain the vendor’s best terms from a price standpoint. The Government will evaluate quotes for award purposes by adding the total price for all contract line items, including options, for a total price. Vendor will not be paid for beds not utilized by Veterans.
(B) Except when it is determined not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are materially unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(C) The evaluation will also consider the possibility that FAR 52.217-8 Option to Extend Services can be exercised at any time and can be exercised in increments of one to six months, but for no more than a total of six months during the life of the contract. The evaluation will assume that the prices exercised under FAR 52.217-8 will be at the same rates as those in effect under the contract at the time the option is exercised. This evaluation will not obligate the Government to exercise any option under FAR 52.217-8.
(D) If this solicitation is a request for proposals (RFP), a written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Vendors who fail to submit the above or where quotes are incomplete such that the Government cannot conduct a meaningful evaluation may not be considered for award and may not be further evaluated.
