In the instructions to bidders on page 11 of 81 of the RFP, part (g) states "Brand Name or equal product information (if applicable) as stated in

SOW/Salient Characteristics" The VA has not included a Brand Name Justification with the solicitation. Because there was not a brand name justification letter posted with the solicitation are we to assume that specific products and/or vendors listed within the solicitation are a "basis of design" only and that we will be allowed to submit on any "equal" product and/or vendor that meets the salient physical, functional, or other characteristics of the product listed within the solicitation documents?

If this is not the case will the government please issue a brand name justification for “every” product and/or vendor that they will not allow an

“equal” product and/or vendor to be used in this project? We come across this issue on a lot of jobs where there is no brand name justification letter issued prior to bid, yet after award the local station refuses to review and/or approve an equal product or vendor. We want to avoid this issue.

Given the statement in paragraph (g) under the instructions to bidders and as quoted above, assuming equal product and/or vendors to those named will be allowed is the government going to

This solicitation is hereby amended to include the provision

FAR 52.211-6 Brand

Name or Equal (see attached S02 - FAR

52.211-6 Brand Name or

Equal Provision).

Each item requiring a

“Brand Name or Equal” offer is included in the specifications. For instance, and without implying limitation, A-dec 5744 Oregon Cart is included in Specification

12 34 00.

It is incumbent on the

Offeror to read and understand the Statement of Work, including any drawings and specifications, clearly identify any “equal” products being offered within the bid package and at the time of bid, expect the products and/or vendors to be approved prior to bid day or will the approval process be done during the normal submittal process?

ensure the “equal” products have the salient physical, functional, or performance characteristic specified in the solicitation, and include descriptive literature in the bid package where appropriate.

The Contracting Officer will then evaluate

“equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting

Officer. The Contracting

Officer is not responsible for locating or obtaining any information not identified in the offer.

See FAR 52.211-6
