STATEMENT OF WORK

FIRE INSPECTION SERVICES VA PALO ALTO HEALTHCARE SYSTEM

1. Introduction

1.1 The VA Palo Alto Health Care System (VAPAHCS) has a requirement for an inspection and survey to determine Life Safety code compliance (Life Safety Assessment) with the latest Edition of National Fire Protection Association (NFPA) Life Safety Code. The Contractor shall provide all labor, tools, materials, equipment, apparatuses and supervision to perform the inspection and survey.

1.2 This service is required for approximately 50-60 contracted skilled nursing facilities, residential care, nursing homes, and adult day care facilities (see spreadsheet attached as Attachment I for locations). The amount of facilities to be inspected may vary from year to year.

1.3 The Contractor may be asked to re-inspect identified homes after corrections have been made to verify that compliance has been achieved. These instructions will be issued by the Contracting Officer Representative (COR).

1. Background

2.1 This Life Safety Assessment will be used to meet the VAPAHCS requirements for Joint Commission accreditation and development of Plans for Improvement (PFI) as determined by VAPAHCS.

1. Period of Performance

3.1 The period of performance is for the base year beginning October 1, 2018 and continuing with four option years.

1. Scope

4.1 The contractor shall provide a Statement of Condition (SOC) including Life Safety Code Assessment (LSCA) in accordance with the latest NFPA code.

5.0 Performance Requirements

5.1 New facilities - Contractor shall complete the inspection of a new facility within twenty-one (21) days after notification is received from the Contracting Officer Representative (COR) or Facility Designated POC.

5.2 Annual inspections for existing facilities - A scheduled inspection list will be provided to the contractor quarterly. Additional inspections may be arranged with the contractor with a fourteen (14) calendar day minimum notice. Annual inspections shall take place within seven (7) days of annual anniversary of last inspection.

5.2 Contractor shall coordinate inspections with the appropriate facility administrators and shall provide VA a monthly schedule of inspections. The facilities director or persons responsible for the facility will be given a 5 business days’ notice prior to the contractor inspecting the facility. The exception to this is when the need of the veteran is immediate.

5.3 Contractor shall complete the inspection and provide deliverables to the COR or Designated Facility POC within three (3) days after inspections are completed.

5.4 Contractor shall use the VA checklists (Attachments II –XI) as a guide for the appropriate occupancy of the facilities as defined by the LSC. Contractor may suggest changes to improve the efficiency and validity of the checklists.

5.5 Contractor shall sign in with POC at facilities and sign out upon completing inspections.

6.0 Deliverables

6.1 Contractor shall provide the COR or Facility Designated POC with the following deliverables within three (3) days after inspection:

1. A copy of the completed and signed inspection checklist

1. Contractor shall develop a written report with a detailed list of each Life Safety Code deficiency including: a) unique identifier, b) locations of the deficiency, c) a description of the deficiency, d) recommended correction action, e) cost estimate for correcting identified deficiency and f) the specific code reference.

6.2 Contractor shall keep a running spreadsheet of facility inspected, address, square footage, and point-of-contact at the facility. An updated spreadsheet shall be submitted to the COR and Contracting Officer each quarter.

7.0 Hours of Operation

7.1 Inspections shall take place Monday through Friday from 8:00 AM – 4:00 PM, unless otherwise arranged and agreed to by facility or COR.

8.0 Contractor Qualifications

8.1 Contractor shall be a licensed Fire Protection Engineer or degreed Fire Protection Engineer from an ABET accredited program. All surveys shall be reviewed and signed off by a licensed Fire Protection Engineer.

8.2 The Contractor shall have a minimum of three (3) years’ experience in providing this type of service.

9.0 Designation of Contracting Officer’s Representative (COR)

9.1 The Contracting Officer (CO) will appoint a Contracting Officer Representative (COR) to perform tasks related to the execution and surveillance of this contract. The COR will be designated to represent the Contracting Officer (CO) in furnishing technical guidance and advice under this contract. The foregoing is not be construed as authorization to interpret or furnish advice and information to Contractor relative to the financial or legal aspect of the contract. Those matters are the responsibility of the CO and shall not be delegated.

9.2 The CO is responsible for the administration of this contract. The CO is the only individual authorized, to extent indicated in this contract, to take actions on behalf of the Government, which may result in changes in the contract terms, to include deviation from the statement of work, details, and performance schedules. Communications pertaining to contractual matters shall be addressed to the CO. No changes in or deviation from the scope of work shall be affected without a written modification to the contract executed by the CO. No oral statements of any person whosoever will in any matter or degree, modify or otherwise affect the terms of this contract.

9.3 The Contractor will receive a copy of Delegation Letter which will identify the COR appointed by the CO.

10.0 Payment and Invoices

10.1 Invoices shall be submitted to DFAS Austin as stated in SF 1449.

10.2 Payment will be made in arrears of the specified billing period after receipt of a properly prepared invoice provided all required work has been performed in accordance with contract and this Statement of Work.

11.0 Security

11.1 The C&A requirements do not apply to this service requirement and a Security Accreditation Package is not required. Contractor personnel will have NO access to VA sensitive information in their work/service area.

11.2 All contractors, whether they have access to PHI or not, are required to complete the VA Privacy and Information Security Awareness and Rules of Behavior (VA10176) training.

B.2 LIMITATIONS ON SUBCONTRACTING-- MONITORING AND COMPLIANCE (JUN 2011)

This solicitation includes . Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
