About this file

Summary

This is a Justification and Approval (J&A) document for a non-competitive sole source contract award by the Department of Veterans Affairs. The VA's Veterans Health Administration, Regional Procurement Office West, Network Contracting Office 20, is awarding a Firm Fixed Price (FFP) contract to DRI, Inc., a Small Business Administration-certified Service-Disabled Veteran-Owned Small Business (SDVOSB), for roofing system replacement at White City VA Medical Center in Oregon. The project scope includes removal of the existing roofing system and installation of a new single-ply PVC membrane roofing system, encompassing approximately 1,250 square feet of work. Deliverables include removal of failed materials, substrate repairs, new membrane installation, flashings, edge metal, accessories, and provision of all labor, materials, equipment, permits, and coordination necessary to complete a watertight, code-compliant roof system.

The award is authorized under 41 USC §3304(a)(5) and 38 U.S.C. § 8127(c), implemented through VAAR 819.7008, which permits non-competitive sole source awards to certified SDVOSBs up to $5,000,000. Market research was conducted via a Sources Sought notice issued March 26, 2026 (notice number 36C26026R0079) for ten days, which generated nine responses—seven from SDVOSBs and two from non-SDVOSB firms. The seven SDVOSB respondents were: DRI INC, BHPE LLC, 414RESTORE LLC, Veteran Roofing, KB Standard LLC, Crystal Clear SRV LLC, and Panacea Construction Group. DRI was selected based on expected fair and reasonable pricing, quick response capability, and demonstrated positive past performance. The requirement is characterized as a one-time, below-Simplified Acquisition Threshold (SAT) procurement critical to ensuring continued medical center operations. No follow-on competitive procurements are anticipated.

VHAPG Part 819.7008/7009 Sole Source Awards to SDVOSB/VOSB Page 1 of 3 Revision: 05 Effective Date: 12/15/2025

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition

Acquisition Plan Action ID: 36C260-26-AP-2723 JOFOC Log Number: FY26-NCO20-1117

1. Contracting Activity: Department of Veterans Affairs (VA), Veterans Health Administration, Regional Procurement Office West, Network Contracting Office 20, in support of the Veterans Integrated Service Network 20, White City VA Medical Center.

2. Nature and/or Description of the Action Being Approved: The VA requires a new contract for a roofing system for multiple buildings in White City, Oregon. The contract type for this procurement is Firm Fixed Price (FFP). The project includes removing the existing roofing system and installing a new single‑ply PVC membrane roofing system. Work includes removal of failed materials, substrate repairs, new membrane installation, flashings, edge metal, accessories, and providing all labor, materials, equipment, permits, and coordination necessary to deliver a complete, watertight, code‑compliant roof system.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: DRI, Inc., a Small Business Administration (SBA) certified Service‑Disabled Veteran‑Owned Small Business (SDVOSB), has provided the necessary documentation demonstrating both their capability and their understanding of the required work. Based on previous projects, DRI has a history of providing reasonable pricing, and there is every expectation that their proposed price will be fair and reasonable. Given these factors and the need to ensure continued operations at the medical center, the VA is exercising its statutory authority to award non‑competitive contracts to SDVOSBs under $5,000,000. Therefore, a sole source SDVOSB award to DRI under VAAR 819.7008 has been determined to be in the Government’s best interest.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.

Code § 8127(c), as implemented by RFO 6.103-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR

819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:

(X) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): DRI has provided adequate documentation demonstrating their proven technical capability, consistent on time performance, and strong track record of successful roofing projects that meet the VA’s needs. Based on 38 U.S.C. 8127(c), this award will be made to the SDVOSB concern, DRI. DRI has been determined to be a responsible source, and the Contracting Officer has verified that the vendor meets the eligibility requirements outlined in 819.7003 (DEVIATION). The Contracting Officer also anticipates receiving fair and reasonable pricing. This requirement is critical and must be performed as soon as possible to ensure the medical center remains fully operational for continued veteran care.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by RFO 6.301 and, if not, which exemption under RFO 5.101(b)(1) applies: The determination to pursue a Service‑Disabled Veteran‑Owned Small Business (SDVOSB) sole‑source award is a business decision wholly within the discretion of the Contracting Officer under the authority of 38 U.S.C. 8127(c). This authority may be exercised regardless of the presence of other SDVOSBs in the market, and the Contracting Officer has determined that a direct award is in the best interest of the Government.

Use of this authority in this instance supports VA’s need to focus internal manpower on larger, higher‑complexity acquisitions and to execute this requirement expeditiously as it is below the Simplified Acquisition Threshold and as the agency approaches the fourth quarter of the fiscal year.

This approach allows the VA to redirect acquisition resources toward mission‑critical, large‑scale projects that more significantly impact Veterans’ care. Upon receipt of the requirements package, a Sources Sought Notice was issued on March 26, 2026, under notice number 36C26026R0079 for ten days. The synopsis requested capability statements from qualified SDVOSBs capable of performing a PVC roof replacement project of approximately 1,250 square feet, including full removal of the existing system, substrate repairs, installation of a new PVC membrane system, related accessories, and all labor, materials, equipment, and permits required to deliver a complete, watertight, code‑compliant roof system. The notice emphasized that responses were voluntary, that the VA anticipated procuring the requirement as an SDVOSB set‑aside under NAICS 238160, and that only SDVOSB responses would drive the acquisition strategy A total of nine responses were received. Of these, seven respondents were SDVOSBs and two were non‑SDVOSB firms. The non‑SDVOSB respondents were excluded from consideration in accordance with the Veterans First Contracting Program. None of the seven SDVOSB respondents were deemed unacceptable. The purpose of the Sources Sought was to assess market capability, and all seven SDVOSBs demonstrated potential capability to perform the work. However, DRI is expected to provide fair and reasonable pricing, respond quickly, and has demonstrated positive past performance. Based on these factors, the Contracting Officer has determined that awarding to DRI represents the best value to the VA.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The Contracting Officer will ensure the final contract price is fair and reasonable by reviewing the Independent Government Estimate (IGE) and comparing it to pricing from previously awarded contracts of similar scope, size, and technical complexity. Based on previous project pricing, DRI is known to provide fair and reasonable pricing. There is every expectation that the price quoted will be fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: Market research, conducted through a Sources Sought notice posted on SAM.gov, confirmed the presence of capable SDVOSB firms. Based on this market research, the Contracting Officer has determined that proceeding with a direct SDVOSB award is justified under 38 U.S.C. 8127(c). Awarding this requirement as a direct SDVOSB sole source supports operational efficiency, reduces administrative burden, and enables the VA to expedite necessary roof repairs while preserving workforce capacity for higher-priority acquisitions. The intended awardee, DRI, is an eligible SDVOSB certified in VetCert.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None.
