About this file

This document is a Justification for Single Source Award under FAR 13.106-1 for the procurement of a PET/CT cover replacement for the Portland VA Medical Center. The requirement is for a one-time firm fixed price service to replace the front assembly cover on a Philips PET/CT Vereos model 6511439 located at the PVAMC. The estimated amount is $43,000.80.

The justification states that Philips North America, LLC is the Original Equipment Manufacturer (OEM) for the Philips PET/CT system and holds the proprietary rights. Philips requires that only certified, trained technicians and OEM parts be used to maintain the equipment. As the OEM, Philips is the sole source for this repair service. Market research was conducted, but no other authorized vendors were identified. The contracting officer has approved the sole source justification in accordance with FAR 13.106-1(b).

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C260-24-AP-0818 JOFOC Log Number: FY24-NCO 20 - 1194

1. Contracting Activity: Department of Veterans Affairs, Veterans Health Administration, Regional

Procurement Office West, Network Contracting Office 20 on behalf of VISN 20, Portland VA Medical Center 2237: 648-24-1-095-0013

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The Portland VA Medical Center (PVAMC) requires a firm fixed price contract for a one-time service to replace the front assembly cover on their Philips PET/CT Vereos model 6511439. The estimated amount is $43,000.80.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Philips North America, LLC is the original equipment manufacturer (OEM) for the Philips PET/CT Vereos model 6511439/serial no. 900039 located at the VA Medical Center in Portland, OR. Philips holds the proprietary license and related authorizations for Philips radiology imaging and therapy systems. Philips requires that only certified, trained technicians provide repair and maintenance on the Philips PET/CT scanner. Additionally, Philips requires only OEM certified parts be used to meet the manufacture’s specifications. Since Philips is the original manufacturer of the equipment and there are no authorized resellers, only Philips can replace the PET/CT cover.

4. Description of market research conducted and results or statement why it was not conducted:

The following sources were survey as part of the market research: VetCert, SBA DSBS, Ability One, UNICOR, GSA eLibrary and Interagency Contract Directory. The National Contract Service listed VA contract No. 797H-17-D-0022 with Philips for radiology imaging equipment. However, the contract did not list the services for the current requirement. Additionally, Sources Sought Notice 36C26024Q0358 was issued on 2/28/2024 and no responses were received.

a certified SDVOSB was contacted, because they are a vendor authorized reseller for Philips radiology imaging and therapy systems. confirmed that they are not authorized to provide the required repair services. Although there were potential sources identified in the market research based on the NAICS or description of the requirement, the market research clearly indicates that only Philips can provide the required services.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
