About this file
This single source justification document outlines a proposed sole source award to Leica Microsystems Inc. for maintenance services on two Peloris III tissue processors and one IPC printer at the Portland VA Medical Center. The services include annual preventive maintenance, emergency repair, technical support, and OEM replacement parts over a base year plus four option years. Pricing is provided for each service year. The justification cites that the equipment is essential for patient care tasks such as tissue biopsies. Only Leica factory-trained engineers are authorized to service the proprietary equipment, so no other vendor can provide the necessary maintenance and support. Market research found no existing government contracts covered the requirements and confirmed Leica as the only authorized provider. A past sole source award to Leica was used to establish price reasonableness for the proposed requirements.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
In accordance with FAR 13.106-1(b) this will be single sourced to the large business manufacturer, Leica Microsystems Inc. The Portland VAMC currently has 2 Peloris III tissue processors and 1 IPC Printer. These units are essential to patient care as they are used for processes such a tissue biopsy.
Service of these items is proprietary to Leica and they do not authorize third party service. Only the manufacturer trained service engineers are authorized to perform th maintenance and repair of these units. Leica is therefore, the only vendor that can provide the Portland VAMC with the

4. Description of market research conducted and results or statement why it was not conducted:
Government wide data bases of contracts were searched. No existing government contract cover the maintenance service for Leica product. Vetcert was checked, but no SDVOSB or VOSB may perform this service as it is proprietary to Leica and Leica has confirmed that they have no authorized providers. FPDS was searched to establish price reasonableness and revealed contract 36C26020P0011 and 36C25820P0098. Both support price reasonableness. Contract 36C26020P0011 was awarded as a Base plus 3 years, not competed, to Leica for the Portland VAMC and was for one (1) Peloris III Processors, the same unit to be covered in this requirement, unit 45110099. The contract was priced at for the Base year, and , and for the subsequent 3 option years (an increase of ). The Base year for the current requirement is priced at which is less than the previous year under contract 36C26020P0011, and, the subsequent option years for the current requirement are quoted at an increase of for each of the 3 covered units. Therefore, the current quote is fair and reasonable.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
Michael Allred Contracting Officer
